This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless the variance is renewed before that time by the EMC. This variance approval shall replace the approval issued on May 7, 2004. This approval is for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed below. Conditions: 1. No Zone 1 Impacts - No impacts (except for "exempt" uses as identified within 15A NCAC 2B .0233) shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. No impervious surfaces shall be added to Zone 1, unless otherwise approved by the DWQ. 2. Diffuse Flow - An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). 3. Protective Fencing - The outside buffer boundary and along the construction corridor within this boundary approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer. This fencing shall be installed prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0233 and this variance approval. The protective fencing should be removed once construction is complete. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. It was denied a septic permit so he purchased the back half which had an existing single-wide and septic system. He then listed the property with Mariner Realty. Hurricane Isabel flooded the property and rendered the single-wide uninhabitable. Mr. Murphrey had it removed from the property and then received a contract to purchase from Mr. & Mrs. Malmo. Our dilemma: The follovAng attachments illustrate our dilemma better than any explanation I can give you. What we need to know is if you can issue an amendment to the existing variance or do we have to start from scratch: (A) This is the variance as issued by DWQ. It includes mitigation which, I believe, should not be required: Paradise Shores was developed long before 1990, 4 has country water and the lot has an existing septic system. (8) A copy of the authorization to use the existing system is attached. The existing variance allows for a drain pipe from the proposed dwelling, through the 50' setback and ending at the existing septic system. Our health department believes this is not permitted. (C) This is the new survey ordered by the buyers who are under contract to purchase subject property. It was done after CAMA visited and flagged the lot and shows a plan of how the buyers would like to develop the property- Impacted area totals approx. 2,150 sq. ft including the driveway and path to the studio. If the Malmo's cannot develop this property as Illustrated, they will need to cancel their purchase contract with Mr. Murphrey. This letter shall act as your Minor Variance approval as described within. 15A NCAC 2B .0233(9)(b). In addition to this approval,-you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and CAMA regulations. The DWQ has determined that you may satisfy this mitigation requirement by planting at least 4 native woody trees and 8 shrubs within the retained portions of the protected buffers. You must ensure their survival for a period of at least five (5) years. You are required to replace any of these trees or shrubs that die within this five (5) year period. You are required to provide proof in writing that the trees have been planted within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit and copied to, the Washington Regional Office. If this mitigation is not acceptable or practicable, then you may choose to make a payment in to the Riparian Buffer Restoration Fund to compensate for 544.5 square feet of mitigation as allowed under 15A NCAC 02B .0242.
