APPROVAL of 401 Water Quality Certification with Additional Conditions
To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to dredge, place fill in or otherwise disturb 4.75
acres of non-vegetated wetlands and coastal shoreline in order to install a bulkhead, travel lift, boat ramp, conduct
excavation at a lift site, grade and gravel working areas and cosntruct an office and storage building at 202 Old Cherry Point
Road in Craven County, as described in your application received by the Division of Water Quality on March 1, 2004. After
reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400,
which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use
your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your Project including (but not limited to) Sediment and Erosion Control,
Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will
expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a' new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes., or rules occur; ff

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A
NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters
(March 1997);
6. All fuel storage and hazardous materials must be handled per the Environmental Protection Agency's Spill
Prevention Control and Countermeasure plan. Appropriate spill recovery and containment systems must be
available onsite.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality..under Section 401 of the Clean Water Act. If you

9. NARRATIVE DESCRIPTION
Project Setting
Tidewater Marine Company Inc. owns a 4.74-acre tract of land at 202 Old Cherry Point
Road on the Neuse River adjacent to the Neuse River Bridge Interchange of US HWY 17/70 and
NC 55, in Craven County, North Carolina. The site appears to have been previously used as a
barge staging and loading facility. There are extensive areas of gravel on the site but with the
exception of several concrete pads the site is open. A steel sheetpile bulkhead with a concrete
landing is located along 120' of shoreline along the northeast corner of the property. Historical
filling of these lands appear to have formed a shallow water embayment underneath the bridge
interchange. The water depths adjacent to the landing are extremely deep with depths of -10' to -
11' only feet offshore. Seven dolphin clusters located in 6' to 9' of water extend east some 500'
from the landing. The remaining 480' of sandy shoreline is natural and appears to have
experienced only some slight storm-related erosion. Scattered Spartina patens and several small
pockets of Juncus roemerianus appear along the normal water line. Water depths along this part of
the shoreline are typical of a river system and remain shallow for the first 50' to 75' offshore.
There were no SAVs noted during the field visit. Three residential mobile homes border the site
to the east while the Neuse River bridge north bound lane is located immediately to the west. This
section of the Neuse River is classified as SC Sw NSW and is closed to shellfishing.
Project Description
Tidewater Marine is a service business that provides repair and maintenance services on
larger marine vessels. They propose to install a 60-ton marine travel lift with runway rails to haul
out and service boats up to 65' in length. Maintenance and repairs would be performed on the
boats and engines including pressure washing, boat bottom preparation and painting, and engine
maintenance and overhaul. To facilitate functioning of the travel lift, an odd shaped basin
described as 62' X 120' (for simplicity) in size would be excavated adjacent to the existing
concrete pad and landing. The basin would extend out to the -6' contour line. Approximately 825
yds3 of sandy material would be removed by a dragline and backhoe and deposited in a 120' X
120' temporary dredge spoil area in the southwest corner of the tract. The 60-ton lift would be
supported out over the basin by two 6' wide X 50' long concrete piers. A 4' X 40' service pier
would extend out from the easternmost support pier. Along the shoreline at the head of the
"basin" approximately 115' of steel sheetpile would be installed. A 36' X 90' wash pad with a
trench drain and interceptor would be installed landward of the steel sheetpile. As proposed much
of the bulkhead is landward of the normal water line except for the eastern corner that extends
some 12' waterward of that line. A 10-slip docking facility would originate from a point where
the concrete pad joins the travel lift dock, would be parallel with the existing mooring pilings and
would extend due east for 315' The dock would be 4' wide. Four 3' X 30' finger piers would
extend off the north side of the dock creating six 65' slips while four "side-to" slips would be
created on the south side of the dock. A small recovery dock and concrete boat ramp measuring
16' X 80' would be constructed in the northeast corner and would extend 30' offshore of the
NWL. A 4' X 80' access dock to facilitate loading and unloading of the boats at the ramp. A 16'
X 140' gravel road would lead to the boat ramp. A 50' X 150' office and covered storage would
be constructed along the eastern property line. A 64' X 140' stormwater pond is being proposed

outside the Neuse River Riparian buffer but within the 75' Coastal Shoreline. Sewer and water
lines would be run along the western property line.
Anticipated Impacts
A proposed, excavation for the project would directly impact approximately 7,440 ft' of
shallow estuarine bottom. Approximately 825 yds3 of sandy material would be removed and the
area deepened to -6' NWL. Approximately 594 fe of Estuarine Waters and Public Trust Areas
would be filled as a result of installation of the boat ramp and steel sheetpile bulkhead. All
combined, some 20,868 ft2 of Public Trust Area would be usurped as a result of the 10-slip dock,
the travel lift and the boat ramp access dock. Of that amount some 3,232 fe would be shaded.
According to the application, approximately 4.17 acres would be graded and filled during site
preparation for the office, storage, stormwater pond, gravel drive, and concrete pad construction.
An additional 4,142 ft2 of impervious coverage would be added to the Coastal Shoreline as a result
of the concrete pad, gravel driveway and boat ramp access. According to the application, only 8%
of the Coastal shoreline would be impervious. A copy of the Erosion and Sedimentation Contol
Plan is attached. Also according to the application, a Stormwater Certification was approved on
October 10, 2003.
