Dear Mr. Radmon:
Your application for a 401 Water Quality Certification to impact 0.19 acre of wetlands, 230 linear
feet of streams, 65 linear feet of isolated channel, and 31,927 square feet of protected Neuse Buffers in
order to construct the Ravenstone Subdivision in Durham County was received in the Division of Water
Quality's Central Office on March 10, 2004. According to our rules [15A NCAC 2H .0507 (A)], if final
action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to
your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for
your plans to impact waters as described in your March 10, 2004 application materials.
However, if additional impact occurs or your development plans change, this waiver is no longer
valid and a 401 Water Quality Certification and Neuse Buffer Rules approval will be required.

Impacts to streams does not jive. I paaears that they have underestimated by countin the stream
impact asa a straight line like the pipe is. I calculate 420 feet of ape with an existing 170 leaving a
minimum of 250 feet without any curves in the stream.

Dear Mr. Dormy:
On March 10, 2004, a permit application, impact map, etc_ for Ravestone was sent to your office.
Our client requested the use of Nationwide permits 18, and 39, which would have impacts to
wetlands totaling 0.19 acres and channel impacts totaling 2301wear Beet and 65 linear feet of
isolated charnel. A copy of the invoice from Action Couriers showing that the permit application
was received by your office and signed for by Beverly Strickland is included with the attachments.
The Division of Water Quality's 60-day response time expired on May 8, 2004. Please send
written correspondence that the Division of Water Quality has waived its right to further comment
on this project and therefore gives its permission to complete the project as specified in the attached
PCN form and impact map.

Dear Mr. Dorney and Mr. Tugwell:
On behalf of Sherron Road Ventures LLC, we hereby request authorization from the US Army
Corps of Engineers (USACE) to use Nationwide Permits 18 and 39, and from the NC-Division of
Water Quality (DWQ) request Isolated Permits, 401 Certification, and Buffer Compliance for the
subject project to cover permanent impacts to jurisdictional stream channels (unnamed tributaries
of Lick Creek), wetlands, and isolated channels. A Pre-construction Notification Application
(PCN) is attached, as well as an agent authorization form.
The applicant requested that S&EC delineate the wetlands, stream channels, and buffers on the
entire property prior to designing the subdivision in order to minimize impacts. A copy of the
applicable USGS Quadrangle and Soil Survey are attached showing the property. Buffer
confirmation from the NC-DWQ was issued on January 29, 2003. A site meeting with the
USACE was performed on January 10, 2003. We have enclosed the jurisdictional determination
from this meeting.
The proposed project consists of the construction of a residential subdivision to serve the
surrounding community. Impacts include 230 linear feet of jurisdictional channel as part of
improvements to the existing roadways (i.e. installing curb and gutter and culvert extension),
8,254 ft2. of wetland impacts due to road crossings and 22,324 ft2 of zone 1 buffer impacts, 9,603
ft2 of zone 2 buffer impacts due to road crossings. In addition, the construction of an extended
detention wetland will impact 10,222 ft2 of Zone 2 of the riparian buffer. Isolated channel
impacts include 65 linear feet of channel. The proposed impacts are elaborated upon in the
attached PCN form and impact maps. A meeting was held with Mr. John Dorney of the NC-
DWQ on February 12'', 2004 at which time he verbally approved the use of the proposed
extended stormwater wetlands. A separate meeting was held with Mr. Todd Tugwell of the

USACE on the same day at which time he also verbally approved the extended stormwater
wetlands.
The USACE's current policy requires applicants to avoid and minimize wetland and stream
channel impacts to the maximum extent practicable and may require further compensatory
mitigation to offset unavoidable losses of waters of the US when permanent impacts exceed the
requirements for notification (0.1 acre). The applicant requested a detailed delineation of
wetlands present on the property prior to construction in order to minimize wetland impacts. In
order to minimize stream impacts, all road crossings for the proposed subdivision are located
where existing crossings are in place. The proposed crossings are designed to utilize the existing
crossings and extend them as needed reducing the impact. Because the applicant will minimize
impacts to wetlands and stream channels by utilizing perpendicular crossings, S&EC does not
believe compensatory mitigation should be required by the USACE for this project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

approximately 130 acres and is located adjacent to the NC 98 / Sherron Road (SR 1811)
intersection, south of NC 98. The project is located in southeast Durham, North Carolina, and
is within the Neuse River Basin (USGS Hydrologic Unit Code 03020201).

at the time of this application: The site is currently wooded, but the infrastructure (i.e.
Roads and culverts) were installed in the 1980's (see USGS). Land use in the vicinity of the
project is mixed and consists of subdivisions and farmland.

10. Describe the overall project in detail, including the type of equipment to be used: The
project consists of the construction of a residential subdivision. Proposed impacts will result
from the installation of roads and other utilities required for a normal residential subdivision.
Typical heave equipment will be used for grading and road improvements.
11. Explain the purpose of the proposed work: The purpose of the proposed work is to provide
additional housing; to meet the demand in this area.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
Previous history includes the permit for the sanitary sewer outfall force main for the Ravenstone
Development (DWQ Project # 03-0769). In September 2002 a detailed wetland delineation was
conducted by S&EC at the request of the client in order to minimize impacts to streams and
wetlands to the maximum extent practicable. Buffer confirmation from NC-DWQ was issued on
January 29, 2003. A site meeting with the USACE was performed on January 10, 2003. We
have enclosed the jurisdictional determination from this meeting. A meeting was held with Mr.
John Dorney of the NC-DWQ on February 12t", 2004 at which time he verbally approved the use
of the proposed extended stormwater wetlands. A separate meeting; was held with Mr. Todd
Tugwell of the USACE on the same day at which time he also verbally approved the extended
stormwater wetlands.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No future impacts are anticipated.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be
included at the applicant's discretion. If this proposed impact is strictly for wetland or stream

mitigation, list and describe the impact in Section VIII below. If additional space is needed for
listing or description, please attach a separate sheet.

VII. Impact Justification (Avoidance and Minimization)

In September 2002, a detailed wetland delineation was conducted by S&EC at the reauest of
the client in order to minimize impacts to streams and wetlands. In order to minimize stream
impacts, all stream crossings for the proposed subdivision are located at existing crossings that
need to be upgraded in order to install curb and gutter. The remaining streams/wetlands and
buffers will be preserved.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/newetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide

On behalf of Sherron Road Ventures LLC, we hereby request authorization from the US Army
Corps of Engineers (USACE) to use Nationwide Permits 18 and 39, and from the NC-Division of
Water Quality (DWQ) request Isolated Permits, 401 Certification, and Buffer Compliance for the
subject project to cover permanent impacts to jurisdictional stream channels (unnamed tributaries
of Lick Creek), wetlands, and isolated channels. A Pre-construction Notification Application
(PCN) is attached, as well as an agent authorization form.
The applicant requested that S&EC delineate the wetlands, stream channels, and buffers on the
entire property prior to designing the subdivision in order to minimize impacts. A copy of the
applicable USGS Quadrangle and Soil Survey are attached showing the property. Buffer
confirmation from the NC-DWQ was issued on January 29, 2003. A site meeting with the
USACE was performed on January 10, 2003. We have enclosed the jurisdictional determination
from this meeting.
The proposed project consists of the construction of a residential subdivision to serve the
surrounding community. Impacts include 230 linear feet of jurisdictional channel as part of
improvements to the existing roadways (i.e. installing curb and gutter and culvert extension),
8,254 ft2 of wetland impacts due to road crossings and 22,324 ft2 of zone 1 buffer impacts, 9,603
ft2 of zone 2 buffer impacts due to road crossings. In addition, the construction of an extended
detention wetland will impact 10,222 ft2 of Zone 2 of the riparian buffer. Isolated channel
impacts include 65 linear feet of channel. The proposed impacts are elaborated upon in the
attached PCN form and impact maps. A meeting was held with Mr. John Dorney of the NC-

I have reviewed the maps that you have submitted for the project referenced by the Raleigh Regional Office
as NBRRO-03-025. An evaluation of the stream features was performed on December 17, 2002 to determine
whether the site would require compliance with the Neuse Buffer Rule.
The features represented on the Durham County Soils and the Southeast Durham USGS topographic
maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined that
there are nine features represented on the property between the two maps. These are labeled as Features A
through I as indicated on the attached plat map.
Features G, and H are not subject to protection under the Neuse River Basin-Nutrient Sensitive Waters
Management Strategy: Protection and Maintenance of Existing Riparian Areas, Administrative Code
T15A:02B.0233 (NCAC 0233). A small portion of Feature F (broken subjectivity) and the area of Feature
I that encroaches into the property are subject. The remaining features are subject through the property.
This letter addresses only those issues involving the riparian area. For information relative to the Wetlands

is located adjacent to the NC 98/Sherron Road (SR 1811) intersection, south of NC98, southeast of
Durham, Durham County, North Carolina.
Basis for Determination: The site contains wetlands and stream channels with indicators of ordinary
high water marks, located adjacent to an unnamed tributary of Lick Creek in the Neuse River Basin.
Indicate Which of the Following Apply:
There are waters of the U.S., to include wetlands, on the above described property which we strongly suggest
should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
Because of the size of your property and our present workload, our identification and delineation of your wetlands
cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.
X The waters of the U.S., to include wetlands, on your lot have been delineated, and the limits of the Corps
jurisdiction have been explained to you. Unless there is a change in the law or our published regulations, this
determination may be relied upon for a period not to exceed five years from the date of this notification.
There are no waters of the U.S., to include wetlands, present on the above described property which are subject to
the permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed five years from the
date of this notification.
Placement of dredged or fill material in wetlands on this property without a Department of the
Army Permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A
permit is not required for work on the property restricted entirely to existing high ground. If you
