The proposed project does not meet conditions specified in Water Quality General Certification No. 4139 as requiring written authorization, and therefore this application is being provided to NCDWR as a courtesy. We are requesting an email from NCDWR concurring that the project does not require written authorization for our files. Impact to Jordan Lake Riparian Buffers will be permitting through the Town of Cary as the delegated municipality. The project is ±19.24 acres in size and is located at 7005 Carpenter Fire Station Road in Cary, Wake County (Latitude: 35.822885°N; Longitude: -78.880521°W). The project is located on the following three parcels: Parcel 1 - 0735549587 - ±14.51 acres (Western portion of the larger parcel) Parcel 2 - 0735546744 - ±0.83 acres Parcel 3 - 0735546744 - ±3.90 acres The project is located in the Cape Fear River basin (Jordan) and onsite waters drain to Panther Creek. The Water Quality Classification for Panther Creek is WS-IV;NSW, and the Stream Index Number is: 16-41-1-17-3. The cataloging unit for the site is 03030002. Proposed Project The purpose of the proposed project is to construct a residential townhome development to meet the existing demand for housing in Cary. The proposed project consists of construction of 89 townhome units, parking, internal access roads, a greenway trail and associated infrastructure (water, sewer, stormwater management, etc). 219 Station Road,Suite 101 I Wilmington. Project History The USACE issued a PJD (SAW-2014-00835) for the portion of the project on the Crosspointe Church property (Parcel 1) on 9/28/15. A copy of the PJD has been provided as an Appendix. The USACE field verified the delineation for the portion of the project located on the Howard Property (Parcels 2 & 3) on 5/10/18 (SAW-2018-00762). Tasha Alexander with the USACE concurred that the delineation had been field verified in an email dated 6/11/18, which has been provided as an Appendix. As of the date of the application, the AJD has not been issued. We are not requesting issuance of a Jurisdictional Determination in conjunction with issuance of the NWP 29. The Town of Cary issued Buffer Determinations for the Crosspointe Church property (TCRB 14- 011) on 5/28/14 and the Howard Property (TCRB 17-011) on 7/14/19. Copies of the Town of Cary Buffer Determination letters have been provided as Appendices. A portion of the proposed project is located on property owned by Crosspointe Church of Cary. In September 2015, the USACE issued a 404 NWP 39 (SAW-2014-00835) and NCDWR issued a 401 WQC (NCDWR Proj #15-0800) for Crosspointe Church Expansion project which authorized stream impacts for expansion of the church for an onsite YMCA facility and secondary access road to Indian Wells Road. The portion of the Crosspointe Church property within the Carpenters Pointe Townhome project is being sold to HH Hunt and is not an additional phase of the Crosspointe Church expansion, and therefore is not associated with the Carpenters Pointe Townhome project. Proposed Impacts The proposed impacts consist of 52 If of permanent stream impacts and 45 If of temporary stream impacts. The construction of a culverted greenway trail crossing of Stream 1 will result in 52 If of permanent stream impacts (Impacts 2 & 3) and 22 If of temporary stream impacts (Impact 1). The greenway crossing has been designed as a culverted crossing because the Town of Cary is requiring the greenway trail to be constructed to vehicular use standards to allow for both maintenance and emergency vehicle. Use of a bridge crossing was not a feasible alternative, as the bridge would need to span the entire floodplain, which would result in a total bridge length of ±108 If. The substantial cost associated with construction of a ±108 If bridge sufficient to support vehicular traffic could not be supported by an 89 lot townhome subdivision and keep the final product at a price point that the current real estate market could support. The installation of the culvert will result in 25 If of permanent stream impacts (Impact 2) and 22 If of temporary stream impacts (Impact 1). The installation of the rip-rap dissipater will result in 27 If of permanent stream impacts. The rip-rap will be installed by burying the rip-rap such that the Page 2 of 4 Carpenters Pointe Townhomes - Cary,Wake Co. WithersRavenel 110 top of the rip-rap matches the preconstruction contours of the streams, allowing for the passage of aquatic life and preventing a function loss of this section of stream. Headwalls will be constructed on both ends of the culverts to stabilize greenway fill and minimize stream impacts. The construction of a sewer crossing beneath Stream 1 (Impact 4) will result in 23 If of temporary stream impacts. This proposed sewer crossing is necessary to connect the onsite sewer system to the existing Town of Cary sewer line located on the south side of Stream 1. Upon completion of installation of the sewer crossing,the stream channel will be restored to preconstruction contours and temporarily stabilized and seeded until native vegetation growth permanently stabilizes the banks. Avoidance and Minimization Prior to site plan design,the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed impacts have been minimized to those necessary for a greenway crossing and sewer crossing. There are no proposed impacts associated with construction of the townhome development itself. Impacts for the greenway crossing have been minimized through the use of headwalls to stabilize greenway fill and minimize additional stream impacts associated with traditional backslopes. Additionally, the rip-rap dissipater has been designed to embed the rip-rap such that the top of the rip-rap matches the preconstruction contours of the channel, allowing for passage of aquatic life and preventing a function loss of this section of stream. Access during construction will occur from uplands. Silt fencing will be installed around all disturbed areas to prevent loss of sediment into adjacent waters. Mitigation The proposed permanent stream impacts are less than 150 If, and therefore mitigation is not proposed. The current request is for 052 If of permanent stream impacts and 45 If of temporary stream impacts(see the attached maps and PCN for details). Site reviews did not identify any potential habitat for bald eagle, red-cockaded woodpecker or Michaux's sumac. The proposed project is located in the Cape Fear River/Jordan Lake basin, and therefore is not located within the known range of the dwarf wedgemussel, Tar River spinymussel, yellow lance, Carolina madtom and Neuse River waterdog, as these species are endemic to the Neuse and Tar River basins. The onsite perennial stream was not considered potential habitat for the Cape Fear shiner, as the project site drains to Jordan Lake, and the Cape Fear Shiner is not known to occur upstream of Jordan Lake as the dam prohibits migration of the species. Additionally, the onsite perennial stream is small (±4 ft wide)and did not have a gravel, cobble or boulder substrate and therefore was not considered potential habitat for the Cape Fear shiner. The project site is within the known range of the Atlantic pigtoe. However, the onsite perennial stream does not have excellent water quality or flow sufficient to maintain clean, silt free substrates and therefore was not considered potential habitat for Atlantic pigtoe. Therefore, the proposed project will have No Effect on federally listed species. 6. Essential Fish Habitat(Corps Requirement) 6a. So the plans look like all impacts were counted as permanent except the riprap above the main stream crossing and the sewer line. ' Is that correct? Based on the file and plans I believe the site is not in compliance. The detail for the riprap(Sheet D) shows, "top of rip rap to match pre-construction stream contour". As we noted during our field inspection the riprap was not keyed in. I would prefer to resolve this via email rather than sending a notice of non-compliance if possible. Let me know what you think.
