The initial compliance report was received on June 7, 2019 with a follow-up report on June 13, 2019. The follow-up report highlights numerous deficiencies that have not been corrected. I would like a detailed explanation, in writing, from the contractor stating why the deficiencies have not been corrected. Please be mindful that the 401 WQC requires protection of downstream water quality standards and requires the applicant to ensure that surface waters are not degraded (15A NCAC 02H .0506) and any violation may result in a Notice of Violation. They are still under a suspension of work order and are focusing their efforts on clean up and repair. As I mentioned last week, I was unable to visit the B section (we just ran out of time and daylight) but I do know there were losses there as well (currently being addressed). I have impressed upon them the need to stage seed, finish slopes/grading, permanent seed (where possible) and split up the flow of stormwater so it is not all draining to one outlet/device. We also discussed the need for better communication between the equipment operators and the foremen/superintendents on the project so that errors in judgement don't continue to occur (i.e. cutting a ditch to drain the roadway without thinking about where the water goes). It is my hope they will make significant progress this week as we have a few days of good weather. I'll keep you posted and look forward to seeing you on Wednesday (Dave, sorry we're gonna miss you!)
