I would agree with your assessment with regards to the contractor. We just had a meeting 2 weeks ago discussing the
need to insure that EC device installation and maintenance is a priority. Aaron is meeting with them today to review
the whole site and said he would follow up with me this afternoon with his thoughts. His email to me yesterday, in
part: In regards to Permit Site 9: 1 hope that a representative with Thalle will be able to provide clarification on the intent
of the actions Wright outlined earlier that resulted in material loss into the wetland. Please note that this loss does not
appear to be a result of significant rainfall, but rather willful neglect on the part of the contractor.
Tomorrow is the bi-weekly construction meeting which I am tentatively planning to attend, pending Aaron's site results
today. I will keep you both posted.

Thanks Nikki. This seems like a mess. Is this particular contractor struggling more than most? The heavy rain is one thing,
but questionable decisions leading to predictably bad results is another. Hopefully they used the good weather
yesterday to button all of this up.

I wish I had an answer for you on why. My best guess is that they wanted to drain the section that they had been
cutting. They basically turned it into a basin/holding pond. I don't think any thought went into where the water was
going to go. There was an old TD that led to the basin that had had been filled in with silt so the water was just ran over
it.
Once the water recedes we will check the wetland area and keep you updated.

The wetland area will need to be reviewed and any and all sediment will need to be removed. Also, there is a
stream that is part of the wetland at Site 9. Investigation will need to be done to determine if sediment is now in that
stream and/or the 48-inch pipe at STA-L-111+00 Rt. As we have done with previous wetland losses, the material needs
to be removed by hand using flat shovels, metal rakes and buckets to carry it out to an upland area where it will not
have the chance to reactivate. The disturbed area will need to be seeded with a wetland seed mix and covered with coir
fiber matting (not excelsior because of wildlife and the location within a JS resource).
The other urgent item here is the need to repair/reset this area so that the stormwater enters the basin as intended
and does not run along the slope or the silt fence. I'll let Aaron address any concerns related to the EC measures —
however please be aware that more rain is coming tomorrow and this area needs to be buttoned up so that we do not
have another loss.
Please keep me posted on progress. I still plan on coming out to the site on Thursday.

See the attached pictures of site 9.
Thalle cut a ditch from their cut section to the edge of the road and let the water free flow down the slope. Some
water made it to basin 11.3 but most of it went between the basin and the silt fence. As seen in the picture, the outlet
behind the basin had the stone wash away and we could not tell how much silt entered the wet land area because of the
water level.
