Leary Subdivision, Nags Head Township Approval of 401 Water Quality Certification with Additional Conditions Dear Mr. & Ms. Harrell: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 0.062 acres of wetlands for the purpose of constructing a single family residence at the subject property, as described `within your application dated June 1, 2004 and received by the N.C. Division of Water Quality (DWQ) on June 3, 2004. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3402 (GC 3402). The Certification(s) allows you to use Nationwide Permit(s) 18 when issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and CAMA regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The house location and driveway are constrained by the minimum building limits set the Town of Nags Head. Several plans were created to fit the residential home and amenities on the lot, but each plan resulted in an area which needed wetland fill to gain adequate setbacks for the sewage disposal system, parking, and required setbacks. The attached plan represents the most desirable option for the house and associated driveway and septic area. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 5 of 5 If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. IX. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation will involve a proposed payment to the NC EEP for the impacted area 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. Owner: Shall mean Matthew and Nancy Harrell, 1217 Littery Drive, Virginia Beach, VA 23464: contact Matt Harrell, telephone (800) 283-6389 Submittal: Shall mean a specific description of material, equipment, and methods proposed to be installed or executed. 3 PROJECT DESCRIPTION The development is a proposed 4-bedroom residence on the west side of Old Oregon Inlet Road (NCSR 1243) in Nags Head. There will be no on-site stormwater infiltration swales; all stormwater and stormwater runoff will be infiltrated locally at the point of generation. Potable water is provided by the Dare County distribution system. The rear of the site is a delineated regulatory wetland with an irregular boundary. See the attached drawing: C-1, Puraflo Active System and Details DESIGN CRITERIA AND CONDITIONS The design flow for the facility is a maximum of 480 GPD based upon 4 bedrooms at normal occupancy. The site is reported by the Dare County Health Department to have soil wetness at 12 to 14 inches below the existing original grade, and 24 inches of fill is required at the drainfield location. The LTAR is 1.0 GPD/sf of Puraflo bed bottom area. A design for the active Puraflo system is provided. Because the lot was identified in the Dare County Registry Deed Book 41, Page 20, June 6, 1958, a repair area is not required (Regulation .1945) and the minimum horizontal separation to a property line is 5 feet (Regulation .1951). All system components are located at or greater than 5 feet from the nearest property line, at or greater than 5 feet from the building foundations and at or greater than 35 feet from regulatory wetlands. All materials, supplies, procedures, workmanship and installations shall comply with the latest editions and amendments of: North Carolina Building Code, Laws and Rules for Sanitary Sewage Collection, Treatment, and Disposal, Section .1900 of the North 4 Carolina Administrative Code, Title 10, Department of Human Resources, Chapter 10, Health Services; Environmental Health, Subchapter 10A, Sanitation, Laws and Regulations applicable to General Contracting in the State of North Carolina, Sanitation rules and regulations of the Dare County Health Department, Respective manufacturers' instructions and accepted industry standards of good practice, and Bord na Mona recommendations and requirements for the Puraflo Peat Biofilter. All work shall be performed under the direct supervision of a person properly registered with the Dare County Health Department. GENERAL Backfill materials shall be clean and free of organic material and trash or debris that may be harmful to any system components. All work shall cease and be held for inspection and approval at appropriate hold points in accordance with the requirements of the Dare County Health Department and the engineer. The contractor shall provide reasonable prior notice (minimum 24 hours) to the engineer of pending inspection. The contractor shall perform and certify all tests and shall maintain a record of all tests results. Test results shall be provided to the Engineer and the Owner upon request, and shall be transmitted to the owner with the operations and maintenance manuals. 5 The contractor shall be solely responsible for the conduct and supervision of all work associated with this specification. Finish graded slopes for disturbed land shall not exceed 1:3 (rise:run) except as specified on the drawings. All disturbed areas shall be stabilized and vegetated within 15 working days or 30 calendar days after cessation of land disturbing activities. BUILDING SEWERS Wastewater from the building shall be conveyed to the septic tank by gravity flow through PVC sewer pipes. Minimum slope of the sewers shall be 1/4 inch per foot. Sewers installed with a bury of less than 24 inches under pavement or aggregate parking or drive areas shall be schedule 80 PVC pipe and fittings. Sewers installed in unpaved areas and protected from traffic or other severe loads shall be Schedule 40 ABS or PVC pipe and fittings. The following specifications or standards apply: ABS Sewer Pipe ABS-DWV PSP PVC Sewer PSM PVC Sewer PVC-DWV and Fittings Pipe and Fittings Pipe and Fittings ASTM D 2751-73 ASTM D 2661-73 ASTM D 3033-73 ASTM D 3034-73 ASTM D 2665-73 Piping shall be installed on a smooth trench bottom of undisturbed natural soil or compacted clean fill. All piping shall be installed to the appropriate alignment, grade and condition prior to backfilling or placing of encasement. Prior to backfilling or placing of encasement the building sewers shall pass a leakage test of not to exceed 100 gallons leakage per day per inch of pipe diameter per mile of pipe under a 5 foot minimum head for the section under test. Visible or surfacing leakage shall be corrected and the pipe retested. 6 Backfill shall be evenly placed and compacted in shallow lifts not to exceed 6 inches loose to a depth of not less than 4 inches above the top of the pipe. Backfill under or within 5 feet of pavement or building footings or floor slabs shall be placed in lifts not to exceed 10 inches loose and each lift shall be wetted and thoroughly compacted prior to installation of the subsequent lift. All backfill shall be installed free of voids and shall be tamped. In no case shall a backfill lift exceed 12 inches loose. Care shall be taken during backfill and compaction operations to maintain alignment and prevent damage to the piping and joints. Backfill shall be brought up to the local grade. SEPTIC TANK & PUMP TANK The septic tank shall be a 1,000 gallon precast concrete septic tank manufactured by Coastal Ready Mix bearing the imprint STB-913 and shall be equipped with an outlet filter. The pump tank shall be a 1,150 gallon precast concrete pump tank manufactured by Coastal Ready Mix bearing the imprint PT-91. The septic tank shall be installed to allow 1/4 inch per foot fall for the building sewer. Local grade at the tank or tank elevation shall be adjusted as necessary to assure that the top of the tank is a minimum of 6" below local grade. The ground surface elevation from the house to the septic tank inlet shall be sufficient to provide not less than 12 inch cover over the building sewer to the septic tank in non- traffic areas, and 24 inch cover under paved driveway or parking areas. In the event that building sewer cover in paved parking or drive areas is less than 24 inches, or cover in unpaved parking or drive areas is less than 30 inches, ductile iron pipe shall be used. Pump tank inlet invert elevation shall be lower than the outlet of the septic tank by a minimum of 1 inch plus 1/8 inch per foot fall in the connector pipe. 7 Excavations for the tanks shall be of sufficient size and depth to allow unhindered installation of the tanks. Building and deck foundations shall be protected from collapse during installation of the tanks. The tanks shall be installed level on a bed which has been leveled and compacted and which is of sufficient size to enable tank installation on the undisturbed prepared portion of the bed. Tanks shall be leakage tested by filling with clean water to not less than 12 inches above any sidewall seam (using plugs or fittings in inlets and outlets as appropriate). Such level shall be maintained for not less than 24 hours by making up water as necessary. The water level shall then be monitored for 24 hours without adding water or other liquids or materials. A drop in water level of more than 1 inch shall cause the tank to be emptied and repaired or replaced and then tested as a new tank. Backfill shall not be placed above the tank bottom prior to satisfactory completion of the test. Backfill under and adjacent to tanks with undercut sides shall be placed in lifts not to exceed 6 inches loose and shall be wetted and thoroughly compacted until the fill elevation has reached the vertical sides of the tanks. Backfill adjacent to tanks for which the excavation is under or within 5 feet of pavement or within 10 feet of building footings or floor slabs shall be placed in lifts not to exceed 10 inches loose and each lift shall be wetted and thoroughly compacted prior to installation of the subsequent lift. Care shall be taken during backfill and compaction operations to prevent damage to the tanks. Backfill shall be brought up to the local grade. Manholes and risers shall be sealed against intrusion of water or soil and shall be gas tight. Manhole risers shall be brought up to 6 inches above grade and shall be odor free. A 1-1/2" diameter vent pipe shall be installed through the side or end wall of the pump tank at the top of the wall or through a manhole riser wall. The vent pipe riser and 8 vacuum-breaker valve shall be located in a protected position as shown on the drawings or as located in the field and approved by the Engineer at the time of construction. All tank penetrations shall be sealed to the opening through the tank or manhole riser wall with non-shrink grout or permanent caulking. PURAFLO PEAT BIOFILTER The biofilter assembly shall consist of 4 Bord Na Mona Puraflo Peat Biofilter modules arranged as shown on the drawings. Installation of the biofilter shall be performed by a contractor authorized in writing by the manufacturer and in accordance with the manufacturer's recommendations and the NC state Innovative System approval. The modules shall be installed to the elevations shown on the drawings. The excavation for the modules shall be of sufficient size and depth to allow unhindered installation of the modules. The building and deck foundations shall be protected from collapse during construction of the assembly. The modules shall be installed level on the infiltration bed. Geotextile filter cloth shall be installed on all exposed portions of the infiltration bed immediately after installation of the modules. The assembly shall be leakage tested upon completion of piping connections in accordance with Puraflo recommendations and requirements of the NC state Innovative approval which currently requires a hydrostatic leak test with the modules full, no visible leakage and a water level change of not more than +/- 1/2" in 24 hours. Backfill shall not be placed above the vessel bottoms prior to satisfactory completion of the leakage test. Backfill adjacent to vessels shall be installed without voids and lightly compacted. Care shall be taken during backfill and compaction operations to prevent damage to the vessels and associated piping or disturbance of the filter cloth. 9 Backfill shall be brought up to +/- 3" from the tops of the modules or the grade specified on the drawings. The manufacturer's field representative and the engineer shall provide written confirmation of the installation of the system including, but not limited to, the biofilter, tanks, pumps, controls, drainfield and peripheral equipment in accordance with their respective designs and specifications prior to issuance of an Operation Permit. DISPOSAL BED Gravel fill for the Puraflo bed shall be clean washed gravel or crushed stone graded in accordance with size numbers 3, 4, 5, 57, or 6 of ASTM D-448. The Puraflo bed shall be a minimum of 8 inches deep or greater as specified by the owner. Site preparation, including cutting, filling and grading, shall be performed in strict accordance with the approved drawings and specifications prior to installation of pipe to achieve approximate final grade and to the extent necessary to enable accurate installation of the nitrification lines. The excavated Puraflo bed bottom shall be lightly compacted mixed native soil and clean fill. Gravel shall at all times be maintained clean and free of soil. After placement of the Puraflo units, the top surface of the gravel fill shall be protected by a permanently installed, Trevira Spunbond S-1115 filter cloth, or equal as approved by the Engineer, placed over the gravel fill to prevent migration of soil into gravel voids. Backfill over the Puraflo bed shall be only lightly compacted to assure the absence of voids. Upon completion of the Puraflo module installation, the bed area shall be fine graded the minimum amount necessary to obtain finish grade as shown on the drawings and ground surface sloping away from the Puraflo elements. Fill at the perimeter of the disposal bed shall be not less than 24 10 inches above original grade and shall slope down away from the bed at not more than 1:3 (rise:run). EFFLUENT PUMPS Duplex pumps shall be Meyers Model WHR5 submersible effluent pumps (or equal as approved by the Engineer) driven by 1/2 horsepower motors and shall be capable of delivering 28 GPM at 20.5 feet total dynamic head. Motors shall operate at 230 volt, single phase, 60 hz. The pump discharges shall be provided with unions, check valves and isolation valves accessible from the pump access manhole. The isolation valves and connection tee may be internal to the tank/riser or external. External valves shall be protected by valve boxes. Pump alternation shall be by a Myers electromechanical alternating system (or equal as approved by the Engineer). Pump controls shall include H-O-A switches, elapsed time meters, event counters and run lights for the pumps. Alarm circuitry shall include a H-O-A switch. The alternating system and control panel shall be visible by direct line of sight from the pump access manhole and shall be located on a post adjacent to the pump tank or on the building wall adjacent to the pump tank, as appropriate (as directed by the owner) and in a NEMA 4X enclosure. A 4-switch mercury float switch system as supplied by Meyers (or equal as approved by the Engineer) shall be employed. The "off" float shall be set 18" above the tank bottom. "On" (for the lead pump) shall be set 3 inches above pump "off" to allow a dosing volume of 64 gallons to the Puraflo modules. The alarm float level shall be set 6 inches above the lead pump "on" level. The lag pump float shall be set 2 inches higher than the alarm float. An adjustable dwell timer shall be provided with a minimum of 12 "on/off" events per day, with "on" durations adjustable within a range of not less than 1 to 3 minutes, and "off" durations adjustable to a range within not less than 1 to 4 hours. The initial timer 11 settings shall be 2.5 minutes "on" and 3 hours between "on" cycles for 8 cycles per day. The timer "on/off" setting shall be controlling when the lead pump "on" condition is satisfied. The lag pump "on" condition shall cause at least the lag pump to run regardless of the timer condition. Alarm shall activate both audible and visible outside alarms. The level controls, alternating system, control panel components and alarms shall be supplied by the pump supplier and shall be compatible with the pump system as determined by the pump supplier. Separate power from separate breakers and cables shall be supplied for pump circuits and for alarm/control circuits. The alarm and control circuits shall be overcurrent protected so that an overcurrent trip in either the alarm or control circuit does not disable the other circuit. There shall be no splices in alarm, control or power wiring in the pump tank or between the pump tank and the control panel. Electrical service to the control panel, and pump and control terminations to the control panel, shall be installed by or under the supervision of a North Carolina licensed electrician. The electrical power source breakers shall not be sub-fed from other building area breakers to assure that power remains available to the pump system when one or more building areas have power available. Electrical conduit between the pump tank and the control panel shall be sealed, waterproof and gastight. The ends of the conduit where wiring passes into the tank and into the control panel shall be sealed waterproof and gas tight to prevent moisture or gasses from migrating from the tank or other source into the control panel. Upon completion of system installation all lines shall be flushed with clear water and the pump tested to assure not less than 28 GPM. The engineer and a representative of the Dare County Health Department shall be present at the final pump test. 12 PURAFLO SUPPLY PIPING The supply line shall be 2" diameter Schedule 40 PVC pipe and fittings and shall conform to the material and installation specifications for Building Sewers. Excavated trench bottoms shall be undisturbed soil or compacted clean fill. The trench bottom shall be smooth and shall have the correct slope in the direction of the pipe run and shall be free of debris or obstructions. Trench width shall be sufficient to allow unhindered installation of the pipe. Supply and manifold pipe shall be installed on a smooth slope between the invert elevations of the ends without dips or air traps. Supply pipe shall be pressure tested for a minimum of 2 hours prior to backfilling. The pipe shall be filled with water and all air removed. The leakage rate shall not exceed 0.017 gallons per hour per inch of pipe diameter per 100 feet of pipe at 50 psig (0.03 gallons per hour for 100' of 2"o pipe). The test shall be witnessed by a representative of the Engineer. 13 OPERATION AND MAINTENANCE The owner shall be responsible for the operation and maintenance of the system. The Puraflo Biofilter system shall be operated in accordance with the manufacturer's recommendations (copy attached), excluding testing of the alarm system and with Dare County and North Carolina maintenance and operations requirements (see the Operation Permit for special requirements specific to the biofilter system). Pump and alarm functions shall be tested monthly. The septic and pump tanks, including sanitary tees, shall be inspected, and the sediment and crust levels determined every three months. The tanks shall be pumped out and sediment removed when the sludge depth reaches 18 inches in the septic tanks and/or 2 inches in the pump tank. Supply lines shall be flushed with both pumps running simultaneously using clean water annually. Corrective action shall be taken when evidence of a problem is found. The contractor shall provide to the owner 2 complete sets of operating, testing and maintenance manuals, and maintenance spares requirements as recommended by the biofilter, pump and controls manufacturers. The owner shall have a spare pump and maintenance spares as recommended by the biofilter, pump and controls manufacturers on hand at all times or shall make arrangements with a local supplier to maintain such spares on hand at all times. INSTALLATION AND TESTING PROCEDURES 1. An on-site preconstruction conference shall be required to be attended by the Puraflo® Peat Biofilter system designer, installer, local health department, licensed soil scientist (as applicable), and property owner or owner's representative prior to beginning construction of the Puraflo® Peat Biofilter and associated ground absorption system. 2. The septic tank, pump tank and peat biofilter modules shall be located to prevent surface/subsurface water inflow/infiltration, and shall meet the horizontal setback requirements of Rule .1950(a). 3. Peat biofilter modules shall be installed level on a rock bed (see Sections F,4. and F.5., above). Elevation shall be high enough to meet constraints established for the site by the final treatment and disposal system. 4. For Type A Puraflo(D Peat Biofilter Systems, the bed shall be constructed as an elongated berm, with the long axis parallel to the ground elevation contours of the slope. The bottom of the bed shall be excavated level (± 1/4") in all directions. The gravel bed shall be immediately installed without allowing machinery to traverse the excavated/exposed bed bottom, Exposed portions of the rock bed (portions not under the modules) shall be covered by a geotextile fabric prior to back filling capable of preventing the downward movement of silt-sized particles while allowing the movement of moisture and gases. 5. For Type B Puraflo(D Peat Biofilter Systems, the gravel bed shall be installed level L 1/4") in all directions, with configuration and specified color-coded modules installed as directed by the system designer for each site. The gravel bed must extend.a least six inches beyond the ends of the modules in all directions. 6. Backfill shall be installed over the gravel bed along the sides of the modules, with the module tops remaining at least six inches above finished grade. Minimum backfrll depth shall be six inches. Backfill shall be installed with a side slope not to exceed a rise to run ratio of 1:4. 7. All tankage, including risers, shall be demonstrated to be watertight by a 24-hour hydrostatic leakage test conducted at the installation site prior to system startup. A water level change of ±1/2-inch or more over 24 hours, or visual observation of leakage shall be cause for failure of the watertightness test. 3. Pump delivery rate shall be measured and determined to be in accordnce with design parameters. The initial settings shall be made to pump timer controls and pump activation elevations in the Biofilter dosing tank based upon these field measurements prior to system start-up. The system's Operator in Responsible Charge (ORC) shall be present during these determinations 9. Specified site preparation steps and construction specifications for the ground absorption system shall be strictly adhered to, including specified depth of trenches in relation to site limiting conditions. H. OPERATION AND MAINTENANCE 1. System classification, management and inspection shall be in accordance with Rule .1961. PurafloO Peat Biofilters shall be classified at a minimum as a Type Va system according to Table V(a) of Rule .1961(b). 2. System Inspections: Both the local health department and the Operator-in-Responsible Charge (ORC) must conduct monitoring inspections of Puraflo® Peat Biofilter Systems at a minimum frequency as specified in Table V of Rule .1961(b) and the Operation Permit. 3. At each'Puraflo® Peat Biofilter inspection the ORC shall, at a minimum, observe and monitor: a. wastewater level in the tanks, b. the septic tank outlet filter or screened pump vault for clogging, c. watertightness of tanks, risers and pipe connections at tanks, d. operation of pumps, floats, valves, electrical controls and alarms, e. pumping frequency from pump impulse counters and elapsed run time meters, f. The peat modules for any structural damage, accessibility, adequate ventilation, excess odors, insect infestations, g. vegetative growth over the drainfield, h. the drainfield area for surfacing the effluent, and i. a sample of peat biofilter effluent collected from the sampling point to check for effluent clarity and odor (note: peat biofilter. effluent may have a brackish to straw color from the humic and fulvic acids naturally present in the peat media). 4. At least twice per year the ORC shall, at a minimum, measure and report to the health department: a. sludge and scum levels in the septic tank, b. sludge level and grease presence in the pump tank, C. pump delivery rate (drawdown test), and d. dosing volume and measure or calculate average pump run time. 5. The ORC shall also conduct other additional observations, measurements, monitoring, and maintenance activities as specified in the Operation Permit and as recommended by the manufacturer. 6, Effluent Samplin; and Analysis: a. Puraflom Peat Biofilter effluent samples shall be collected at least yearly by the ORC. For Type A Systems, samples shall be collected from the sampling chamber (2) For Type B Systems, samples shall be collected from the 4-way cross, P-trap, di=bution box or similar device provided for effluent sampling. (3) The sampling location shall be purged of accumulated effluent and allowed to refill prior to collecting a sample. Sample collection frequency shall be specified by the local health department in the Operation Permit, and can be modified, as needed, by the local health department. C. All samples shall be obtained, preserved, and analyzed in accordance with 40 CFR 136. Samples shall be analyzed by a state certified wastewater laboratory for the treatment performance standards specified in Section B, d. When samples do not meet treatment standards specified in Section B, the system shall be resampled two more times within the next 60 days with samples collected no less than 48 hours apart. The average system performance shall then be calculated as the arithmetic mean (geometric mean for fecal coliforms) of results from the three samples. System maintenance or repair shall be required whenever the average system performance as calculated above does not meet the applicable treatment standards specified in Section B, 7. Notification and Performance of Maintenance and Repairs a. Tile ORC shall alert the system owner in a timely fashion of needed maintenance or repair activities including, but not limited to, landscaping, tank sealing, tank pumping, pipe or control system repairs,media replacement,and adjustments to any other system component. The ORC shall notify the system owner and local health department whenever the pump delivery rate efficiency or average pump run time are not within 25% of initial measurements conducted prior to system startup, b. The ORC shall keep the septic tank outlet effluent filter or screened pump vault cleaned and in proper operating condition, as per manufacturer's recommendations. C. System troubleshooting and needed maintenance must be provided to maintain the pump delivery rate and average pump run time within 25% of initial measurements conducted prior to system startup. d. The septic tank will be pumped as needed upon recommendation of the ORC. However, at a minimum the septic tank will be pumped whenever the solids level exceeds 25% of the tank's total liquid working capacity or the scum layer is more than 4 inches thick. The ORC shall notify the local Health Department and system owner in writing whenever repairs are required. All maintenance activities shall also be logged and recorded in the ORC reports provided to the local health department. 8. Reporting a. After each required ORC system inspection, the ORC shall provide a completed written report to the system owner and the local health department within 30 days. At a minimum this report must specify; (l) the date and time of inspection, (2) system operating conditions observed according to H.3, above, (3) system operating conditions measured according to HA, and H.5, above, (4) results from any laboratory analysis of any effluent samples, (5) maintenance activities performed since the last inspection report, (6) an assessment of overall system performance, and (7) a determination of whether the system is malfunctioning, and the specific nature of the malfunction. After each required health department system inspection, the local health department shall provide a completed inspection report to the system owner and the State within 30 days. The local health department shall also provide an annual summary each January to the State including; (1) the name of the environmental health specialist in the health department with primary responsibility for the Puraflo® Peat Biofilter program in the county/district, (2) the number of improvement permits, construction authorizations, and operation permits issued for Puraflo® Peat Biofilter systems the prior year in the county/district, (3) the total cumulative number of Puraflo® Peat Biofilter systems installed under this Approval in the county/district, (4) the percentage of ORC reports due to the health department that have been received from the 0 RC' s, (5) an assessment of overall performance of Puraflo® Peat Biofilter systems in the county/district, and (6) the percentage of PurafloO Peat Biofilter systems which malfunctioned during the prior year. the nature of the malfunctions, and any remedies implemented or needed. 4. Design responsibility: Prior to the issuance of an Authorization to Construct for a Puraflo® Peat Biofilter System, site-specific plans and specifications shall be submitted for review and approval by the local health department. Site specific plans and specifications shall be prepared by individuals authorized in writing by the manufacturer (which may include an authorized agent in a local health department), or by a professional engineer. Approval shall be contingent upon the specific Puraflo® Peat Biofilter System proposed being found to be in accordance with all provisions of this approval as applicable to the proposed facility and site. 5. The system shall be installed by a contractor authorized in writing by the manufacturer, who shall coordinate the installation with the designer and manufacturer's field representative. The manufacturer's field representative. and designer shall provide written confirmation of their acceptance of the system installation prior to Operation Permit issuance. 6. For sites required to be evaluated by a Licensed Soil Scientist or Professional Geologist (see Section I.2,above), the health department may specify as a condition on the Improvement Permit and Authorization to Construct that a Licensed Soil Scientist or Professional Geologist oversee critical phases of the ground absorption system installation and certify in writing that the installation was in accordance with their specified site/installation requirements prior to the Operation Permit issuance. 7. The operator requirements of Rule .1961(b) shall be met, including the requirement for a contract to have been executed between the system owner and a private Certified Operator or with a Public Management Entity with a Certified Operator.
