APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules (15A NCAC 2B .0233) with ADDITIONAL CONDITIONS
Dear Mr. Vernal:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 39 feet of streams and 3,900 square feet (ft) (or 0.09 acres) of protected riparian buffers for the
purpose of installing a road at the subject property, as described within your application dated February 25, 2004. After
reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ)
General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide
Permit(s) 18 or 39 when issued by the US Army Corps of Engineers (USACE). This letter shall also act,as your
approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition,
you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with
your project including (but not limited to) Erosion and Sediment Control and Non-discharge, regulations. Also, this
approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all
specifications governing the proper design, installation and operation and maintenance of such Best Management
Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites,
borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated
with the project.
2. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters,
or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All
construction activities, including the design, installation, operation, and maintenance of sediment and erosion control

Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or
rules occur.
3. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall
not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion
control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within
six months of the date that the Division of Land Resources has released the project.
4. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
5. Stream & Buffer Impacts - The proposed road and construction corridor shall not exceed 39 feet of stream or 39
linear feet of buffer impact beyond the footprint of the existing culvert and cleared crossing.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to: review as oprovided in
Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. If you have any questions,' please

18) This proposed activity is to replace an existing 48" diameter PVC culvert in an
intermittent drainage channel below Westgate Road (see Figure 2) with a 72"
diameter concrete culvert with concrete headwalls (total width approximately 13 feet;
Figures 3 and 4). The existing culvert is approximately 45 feet in length. The length
of the replacement pipe from end to end is 34 feet. The intermittent channel adjacent
to the existing culvert is approximately 3 feet wide and varies from 0.5 feet to 1 foot
in depth.
The culvert will be placed on the same grade as the existing culvert. Atrackhoe will
be used to remove the existing 48" diameter PVC pipe and install the proposed 72"
diameter concrete pipe. Once the new pipe is in place, footings will be poured and a
form for the headwall constructed. Flow in the channel (if present) will not be allowed
to contact the uncured concrete. Upon completion of the headwall, the culvert will
then be backfilled (above the Ordinary High Water Mark) with a suitable earthen
material compacted at 6" lifts to 95% compaction. A road will then be constructed
over the compacted backfilled material. The road will consist of concrete curb and
gutter with an asphalt road. Two catch basins will be located on this road and drain
into the 72" diameter concrete culvert.
At the downstream and upstream end of the culvert a riprap outlet protection apron
will be installed as required by the NC DENR Erosion and Sediment Control Planning
and Design Manual. These specifications require that the downstream apron consist
of 3" to 5" riprap placed along the channel at a depth of 8" and length of 44' at a
width sufficient to stabilize the channel. The upstream riprap apron should be at a
length of 7' and at a width sufficient enough to stabilize the channel. Apron widths
will be consistent with requirements of the NC DENR Erosion and Sediment Control
Planning and Design Manual.
19) The owner's property is accessed from Fleet Service Drive to the east through a 60'
wide easement across property owned by Piedmont Truck Tires, Inc. The
intermittent channel and existing crossing is located on the owner's property at the
end of the easement. The improvements to the existing access will be used to carry
traffic to and from a proposed asphalt manufacturing facility. Construction is
estimated to begin March 2004 and be completed by June 2004.
20) As discussed in question 18, riprap will need to be placed in the channel for erosion
control as specified by the NC DENR Erosion and Sediment Control Planning and
Design Manual. The downstream riprap apron will be 44' long and at a width
sufficient to stabilize the channel. The upstream apron of riprap will be 7' long and at
a width sufficient to stabilize the channel. To reduce the culvert's length and
minimize the activity's impact to the intermittent channel, the culvert will be designed
with concrete headwalls in lieu of flared pipe end sections.
21) Materials discharged will consist of riprap and concrete. Each of the two headwalls,
upstream and downstream, will be constructed of concrete. These headwalls will
have a concrete foundation that will require approximately 3 cubic yards of concrete
each. The two aprons will consist of 3" to 5" riprap with a length of 44 feet
(downstream) and 7 feet (upstream) at an approximate depth of 8". Filter fabric will
be placed under the riprap to help stabilize the channel. The existing channel
configuration averages 3 feet in width and 0.5 to 1.0 feet in depth below the Ordinary
High Water Mark (OHWM). The volume of riprap fill below the existing OHWM is
estimated to be 5 cubic yards. The aprons' width specifications will require
excavation and placement of approximately 10 additional cubic yards of riprap. The
total fill volume of concrete and riprap below the OHWM will therefore be 21 cubic
yards.
22) No riparian wetlands will be impacted by the proposed activity. Riprap will be placed
in approximately 40 linear feet of channel beyond the existing culvert footprint.
Based on an average existing channel width of 3 feet, the total channel area to be
filled is 120 sq. ft. A backhoe or trackhoe will be used to remove material from the
existing crossing and the material will be placed into a dumptruck. The material will
then be transported to an upland location onsite for subsequent use as fill material.
An Erosion and Sedimentation Control Plan will be submitted to the N.C. Division of
Land Resources, which will specify Best Management Practices to prevent runoff of
material back into the waterbody.

Dear Jennifer:
This letter transmits a Pre-Construction Notification (PCN) for a proposed culvert replacement off
Fleet Service Drive in Raleigh. During our telephone conversation of Feb 20, 2004, you indicated
that the project would be eligible for coverage under Nationwide Permit (NWP) No. 18 (minor fill).
We originally anticipated that the volume of fill required would be less than 10 cubic yards, which
would not require submittal of a PCN. However, the City Engineer has stipulated we design the
culvert for the 100-yr flood flow, which will require the use of a 72-inch culvert. Our revised estimate
for fill volume to meet this design standard is 21 cubic yards (6 cu. yd. concrete footings for
headwall, 15 cu. yd. riprap for erosion protection). The 22 cubic yards is still eligible for coverage
under NWP 18, however a PCN is required.
The attached engineering form 4345 serves as the PCN and provides the required information on
the project location and description of activity. We have reviewed the Corps' General and Regional
Conditions, as well the State's WQ Certification #3402 General Conditions for NWP 18, and will be
able to perform the activity in accordance with these conditions.
For your information, Mr. Bob Zarzecki of the N.C. DWQ in the Wetlands/401 Certification Unit has
indicated that the project will be exempt from the Neuse River Buffer Rule as long as we do not
increase the footprint of the existing crossing by greater than 40 linear feet parallel to the stream.
We have designed the project accordingly to maintain this exemption.

18) This proposed activity is to replace an existing 48" diameter PVC culvert in an
intermittent drainage channel below Westgate Road (see Figure 2) with a 72"
diameter concrete culvert with concrete headwalls (total width approximately 13 feet;
Figures 3 and 4). The existing culvert is approximately 45 feet in length. The length
of the replacement pipe from end to end is 34 feet. The intermittent channel adjacent
to the existing culvert is approximately 3 feet wide and varies from 0.5 feet to 1 foot
in depth.
The culvert will be placed on the same grade as the existing culvert. A trackhoe will
be used to remove the existing 48" diameter PVC pipe and install the proposed 72"
diameter concrete pipe. Once the new pipe is in place, footings will be poured and a
form for the headwall constructed. Flow in the channel (if present) will not be allowed
to contact the uncured concrete. Upon completion of the headwall, the culvert will
then be backfilled (above the Ordinary High Water Mark) with a suitable earthen
material compacted at 6" lifts to 95% compaction. A road will then be constructed
over the compacted backfilled material. The road will consist of concrete curb and
gutter with an asphalt road. Two catch basins will be located on this road and drain
into the 72" diameter concrete culvert.
At the downstream and upstream end of the culvert a riprap outlet protection apron
will be installed as required by the NC DENR Erosion and Sediment Control Planning
and Design Manual. These specifications require that the downstream apron consist
of 3" to 5" riprap placed along the channel at a depth of 8" and length of 44' at a
width sufficient to stabilize the channel. The upstream riprap apron should be at a
length of 7' and at a width sufficient enough to stabilize the channel. Apron widths
will be consistent with requirements of the NC DENR Erosion and Sediment Control
Planning and Design Manual.
19) The owner's property is accessed from Fleet Service Drive to the east through a 60'
wide easement across property owned by Piedmont Truck Tires, Inc. The
intermittent channel and existing crossing is located on the owner's property at the
end of the easement. The improvements to the existing access will be used to carry
traffic to and from a proposed asphalt manufacturing facility. Construction is
estimated to begin March 2004 and be completed by June 2004.
20) As discussed in question 18, riprap will need to be placed in the channel for erosion
control as specified by the NC DENR Erosion and Sediment Control Planning and
Design Manual. The downstream riprap apron will be 44' long and at a width
sufficient to stabilize the channel. The upstream apron of riprap will be 7' long and at
a width sufficient to stabilize the channel. To reduce the culvert's length and
minimize the activity's impact to the intermittent channel, the culvert will be designed
with concrete headwalls in lieu of flared pipe end sections.
21) Materials discharged will consist of riprap and concrete. Each of the two headwalls,
upstream and downstream, will be constructed of concrete. These headwalls will
have a concrete foundation that will require approximately 3 cubic yards of concrete
each. The two aprons will consist of 3" to 5" riprap with a length of 44 feet
(downstream) and 7 feet (upstream) at an approximate depth of 8". Filter fabric will
be placed under the riprap to help stabilize the channel. The existing channel
configuration averages 3 feet in width and 0.5 to 1.0 feet in depth below the Ordinary
High Water Mark (OHWM). The volume of riprap fill below the existing OHWM is
estimated to be 5 cubic yards. The aprons' width specifications will require
excavation and placement of approximately 10 additional cubic yards of riprap. The
total fill volume of concrete and riprap below the OHWM will therefore be 21 cubic
yards.
22) No riparian wetlands will be impacted by the proposed activity. Riprap will be placed
in approximately 40 linear feet of channel beyond the existing culvert footprint.
Based on an average existing channel width of 3 feet, the total channel area to be
filled is 120 sq. ft. A backhoe or trackhoe will be used to remove material from the
existing crossing and the material will be placed into a dumptruck. The material will
then be transported to an upland location onsite for subsequent use as fill material.
An Erosion and Sedimentation Control Plan will be submitted to the N.C. Division of
Land Resources, which will specify Best Management Practices to prevent runoff of
material back into the waterbody.

Raleigh office of the US Army Corps of Engineers. As I related to you on Feb 20, 2004, Ms.
Burdette indicated that the project would be eligible for coverage under Nationwide Permit (NWP)
No. 18 (minor discharges). We originally anticipated that the volume of fill required would be less
than 10 cubic yards, which would not require submittal of a PCN. However, the City Engineer has
stipulated we design the culvert to the 100-yr flood flow, which will require the use of a 72-inch
culvert. Our revised estimate for fill volume to meet this design standard is 21 cubic yards. The 21
cubic yards is still eligible for coverage under NWP 18, however a PCN is required.
We have reviewed the Corps' General and Regional conditions, as well the State's WQ Certification
#3402 General Conditions for NWP 18, and will be able to perform the activity in accordance with
these conditions. The drainage does not flow to an impaired water listed under Section 303(d) of the
Clean Water Act. We have designed the project to meet the 40-foot maximum additional footprint to
maintain exemption from the Neuse River Buffer Rule.

that the project would be eligible for coverage under Nationwide Permit (NWP) No. 18 (minor fitl).
We originally anticipated that the volume of fill required would be less than 10 cubic yards, which
would not require submittal of a PCN. However, the City Engineer has stipulated we design the
culvert for the 100-yr flood flow, which will require the use of a 72-inch culvert. Our revised estimate
for fill volume to meet this design standard is 21 cubic yards (6 cu. yd. concrete footings for
headwall, 15 cu. yd. riprap for erosion protection). The 22 cubic yards is still eligible for coverage
under NWP 18, however a PCN is required.
The attached engineering form 4345 serves as the PCN and provides the required information on
the project location and description of activity. We have reviewed the Corps' General and Regional
Conditions, as well the State's WQ Certification #3402 General Conditions for NWP 18, and will be
able to perform the activity in accordance with these conditions.
For your information, Mr. Bob Zarzecki of the N.C. DWQ in the Wetlands/401 Certification Unit has
indicated that the project will be exempt from the Neuse River Buffer Rule as long as we do not
increase the footprint of the existing crossing by greater than 40 linear feet parallel to the stream.
We have designed the project accordingly to maintain this exemption.
