Brantley Pointe Subdivision, adjacent to the Atlantic Intracoastal Waterway near Shallotte, Brunswick County. No dredging or filling. Approximately 9,000 square feet of shading and incorporation of vegetated and non-vegetated wetlands. ID # 200400419 March 5, 2004. Mariner's Point Home Owners Association. Salter Path, Bogue Banks, Carteret County. Minor dredging (750 ft2) and filling (732 ft2) of non- vegetated shallow water to reconfigure an existing marina, add eleven new slips, and perform maintenance dredging. ID # 200400420 March 5, 2004. Cedar Creek Canal. Cedar Creek near Sea Level, Carteret County. Maintenance dredging of an existing canal, basin, and channel along Cedar Creek into Styron Bay and Core Sound. Dredging of 49,640 fl 2 (1.14 acres) of previously excavated channel with disposal on high ground. ID # 200400421 March 5, 2004. Pine Knoll Association. Brock Basin Marina in Pine Knoll Shores, Carteret County. Dredging (825 ft2) and fill (880.5 ft2) to replace an existing bulkhead, maintain channel, replace a fixed pier with a floating pier, and a dock expansion to create three boat slips. ID # 200400423. March 5, 2004. David Greer (Pecan Grove Plantation). On mainland adjacent to the AIWW and east of Hampstead in Pender County. Maintenance and new dredging to improve water access and improve an existing boat ramp. No fill and 18,000 ftz of dredging in existing channel and 8,100 ftz of new dredging. These comments are submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act (ESA) of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). We have reviewed occurrence records of federally listed species from the North Carolina Natural Heritage Program database. No federally threatened or endangered species has been reported from the immediate vicinity of these proposed projects. However, four of the six projects involve small-scale dredging, primarily of existing, maintained channels. Dredging can poses a risk to the federally endangered West Indian manatee (Trichechus manatus). Considering the limited nature of the proposed dredging, these projects are not likely to adversely affect manatees. However, the Service suggests that the Corps inform each applicant that manatees could occur in their project area and that care must to taken to avoid harm to this species. Since the Service's web page is not available to the public at this time, we have enclosed the two-page information sheet entitled "West Indian Manatee in North Carolina" and the two-page "Guidelines for Avoiding Impacts to the West Indian Manatee - Precautionary Measures for Construction Activities in North Carolina Waters." If each applicant proposing dredging is provided with a copy of these two documents for information purposes, the Service would concur with a determination by the District Engineer that the proposed activities are not likely to affect species designated as threatened or endangered, or their critical habitat, pursuant to the ESA. Overall, based on the information provided in these PNs, we do not believe that the proposed activities will have significant adverse and/or irreversible effects on fish and wildlife resources under our jurisdiction. Therefore, the Service has no objection, from the standpoint of fish and wildlife, to the issuance of DA permits for the work described in the PNs listed above. FIELD INVESTIGATION REPORT: PINE KNOLL ASSOCIATION / CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicant is responsible for 2.66-acre tract of land adjacent to a manmade basin and canal leading to Hoffman Inlet on Bogue Sound in the Town of Pine Knoll Shores, Carteret County. The aforementioned basin, known as Brock Basin, is located at the intersection of Mimosa Blvd. and Oakleaf Drive within Pine Knoll Shores, which is a developed multi-family residential neighborhood. The area surrounding the basin is considered community property and contains parking, a concrete pavilion with cover, and canoe storage. The terrain is approximately 4' above high water. The vegetation landward of the bulkheaded marina, where not covered with high ground amenities, is lawn and oak trees. The current marina facility includes a boat ramp, a fixed day dock, and two fixed docks with 19 finger piers providing docking spaces for 36 vessels. The average water depth within the basin is -4' at low water except for the bulkhead faces, which are experiencing some shoaling. The properties to the north and south are developed lots with single-family residences. The lots are vegetated with landscape plants, upland grasses and large live oak trees. The shoreline connecting to the basin is currently bulkheaded and the channel adjacent the basin is approximately 90 feet wide. At this location, Bogue Sound is classified SA HQW by the Environmental Management Commission. The property is located in the White Oak River Basin. The waters are not considered primary or secondary nursery areas and are closed to shellfish harvesting. Project Description The project includes maintenance dredging, bulkhead replacement, and dock improvements. There are three areas within the basin that are proposed for maintenance dredging activities. Along the NE side of the basin the applicant has applied to dredge an area 135' by 5' to a depth of 2' below normal low water. In the SE corner of the marina, maintenance dredging is slated for an area 15' by 5' to a depth of 2' below low water. Finally, along the south bulkhead paralleling the center dock maintenance dredging is proposed for an area 15' by 5' to a depth 2' below low water. At the specified dimensions the project proposes to remove a total of 31 cubic yards for the basin bottom. This yardage calculation is based on an average removal of 1' of material to reach the 2' at low water desired depth. Beginning just inside the NE corner of the basin a new vinyl bulkhead is proposed for a distance of 587' until the SE corner of the basin. This stretch does include two small sections running alongside the existing boat ramp. The proposed bulkhead would be positioned 18" from the existing failing bulkhead for the entire length. The applicant in an attempt to create a more usable day dock has proposed to remove the fixed 64' by 4' shore parallel dock on the NE bulkhead and requests to replace the dock with a new floating dock 30' by 8' accessed by a 8' by 4' fixed platform with gangway. The applicant has also requested to add three additional boat slips through a dock and finger pier addition. A new dock extension is proposed oriented south to north from the center dock measuring 15' by 6'. Off of this dock is proposed a finger pier (30' by 2 112') running west to east with two associated pilings creating one of the additional slips. Two of these finger piers would measure 30' by 2 '/z' with the remaining finger pier proposed at 8' long by 2 '/z' wide creating mooring spaces 10' wide by 25' long. The dock expansion on the west side of the existing center dock will not expand into the navigation channel more than 25 % of the channel's width. Anticipated Impacts The proposed maintenance dredging would remove 31 yd3 of shallow water habitat in an 825 ftz area. The proposed bulkhead would result in the filling of 880.5 ft' of shallow water habitat necessitated by the proposed 18" offset for the entire bulkhead length. Finally the proposed dock improvements would consume 2,012 ftz of public trust area. The navigation of the adjacent channel would be altered through the dock expansion in the westerly direction but the expansion is proposed less than '/a distance across the channel. Brad E.
