According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described in your February 23, 2004 application materials. However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401 Water Quality Certification will be required. Barrett ,,, SUBJECT: Modification to State Permit #42-00, Issued to the NC Coastal Federation and NC Sea Grant DATE: February 18, 2004 Please find the attached request received February 16, 2004, for a modification to the aforementioned CAMA Major Permit. As you may recall, this permit was issued on March 22, 2000 as a blanket authorization to allow for the installation of "experimental" shoreline stabilization projects. The intent is to document the effectiveness of these methods over the traditional vertical bulkhead. A brief description of the current proposal and site characteristics follows: APPLICANT: North Carolina Wildlife Resources Commission Division of Engineering Services C/o Mr. Tom Covington Site Location - Adjacent to the Chowan River at the site of the Edenhouse Wildlife Ramp facility, east of the Chowan River Bridge. SITE CHARACTERISTICS: Water Quality - B-NSW Shellfish - No Resource PNA - No Land Use Plan Classification - Conservation 2000 Photo 150-1843, Grid 18-H, 17-1 Rover #E020316A This project is on the east side of the Chowan River Bridge in Chowan County, just west of the town of Edenton. The property is owned by the NC Wildlife Resources Commission, and is operated as a public ramp. Hurricane Isabel caused damage to the integrity of the surface, and much of the asphalt is now broken with vegetation growing through. The property is bordered on the west by the Chowan River, and on the north by a created canal in which the ramps are located. The bridge borders the south side of the property, and vacant forested land borders the east. There is an existing and heavily - 0 damaged bulkhead along the Chowan River side of the property. This wall is at best serving as a breakwater. The bulkhead along the canal to the north is functioning. The bottom area within the river itself is sandy, with sparse Taxodium distichum along the shoreline each direction. The river is in excess of one mile wide at the site location. hp- Between the relic bulkhead and the shore there is a fringe of stressed shrub/scrub habitat surviving on the ±2'-3' escarpment. The bulkhead to the southern end, or bridge side of the property is in better repair. Riprap abuts the bulkhead at the south end in the location of the old bridge abutment. The elevations at the top of the escarpment are appr. +2.8' nwl, while bottom soundings in the location of the proposed sill average -3' nwl. No coastal marsh is present along this shoreline. PROPOSAL: The applicant proposes to construct a stone (granite) sill intended to attenuate the energy and allow for the survival of coastal marsh and native woody wetland species. The sill will be approximately 450' in length, with a bottom width of 15' and 1.5:1 side slopes. The top height Page 03 NCCF/NCWRC February 18, 2004 will extend approximately 1' above the nwl elevation, or t45 above substrate. The project will begin abutting the riprap to the south. The rock structure will have 4 drop-down areas with 5' bottom widths to approximately 1' above substrate level. The first drop-down will be approximately 100' north of the neighboring riprap, with subsequent "drop-downs" every 100'. The sill will extend to the entrance of the canal, and will rap around the corner of this shoreline connecting to the canal bulkhead approximately 30' to the east. The landward toe of the rock will be located approximately 12' waterward of the nwl contour of the shoreline, or 18' waterward of the existing bulkhead. The proposal includes placing approximately 460 cubic yards of sandy fill material behind the sill, increasing the substrate elevation by 2' on average. Native marsh species will be planted within this 5000 square foot area. The 13' landward of the fill area for the 450' length will be graded and planted with native high marsh and woody species. POTENTIAL IMPACTS: Direct impacts will be from the loss of public trust area between the nwl contour and the sill in the amount of approximately 5000 sf. Additionally, the sill itself will fill approximately 6750 sf of sandy shallow bottom habitat. Turbidity may be an issue with the use of fill in the open water, but should be reduced by the use of turbidity curtains, timing of sand placement, and the type of fill proposed. ******* Please see the field report dated December 23, 1999, associated with permit #42-00, for additional information.
