Grubb St. Hertford, NC, 27944 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Ms. Jewett: You have our approval, in accordance with the attached conditions, to shade 0.09 acre of Estuarine Shoreline, Public Trust Area and 404 Wetlands in order to construct a boardwalk, covered shelter, fishing pier, and canoe launch on Raccoon Creek in Perquimans County, as described in your application received by the Division of Water Quality on February 20, 2004. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/newetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you maybe required to send us anew application for anew certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre; compensatory. mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; N. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters (March 1997). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: The Town of Hertford proposes to construct a boardwalk, covered shelter, fishing pier, and canoe launch on Raccoon Creek in Perquimans County. PROJECT SETTING The Town of Hertford, Perquimans County, operates a housing authority on its property located at 104 White Street, off Church Street (SR 1336) and adjacent to Raccoon Creek. The property is approximately 5 acres in size and has an elevation of approximately 4 feet above Normal Water Level (NWL) at its highest point. Approximately one-third of the property has a cypress and phragmites wetland fringe along the waterline that varies in width from 200 feet to 250 feet. The upland area of the property is developed with apartment buildings, a street with curb and gutters, an office, a paved basketball court, and grounds that are vegetated with indigenous grasses and are maintained. Adjacent properties consist of a NC Department of Transportation (DOT) bridge and SR 1336 causeway, right of way on the west, and an undeveloped lot on the east. Raccoon Creek is classified as SC by the Division of Environmental Management, and is closed to shellfish taking. The water depth of Raccoon Creek in this area range from -2 feet to -5 feet below NWL. DEVELOPMENT PROPOSAL In order to provide community access to Raccoon Creek, the applicant proposes to construct an elevated 8 feet wide walkway, starting at the existing basketball court, heading 200 feet through the existing wetland fringe to the Creek. The structure will continue for 50 feet out into Raccoon Creek to a proposed 12 feet by 16 feet covered deck. The deck's roof will have a one-foot overhang. The structure will continue for an additional 92 feet, where it will have an "L" to the west 8 feet wide and 100 feet long. On the east side of the structure by the "L", there will be an 8 feet by 16 feet canoe launch. The proposed structure will be 154 feet from the shoreline and will be 354 feet in total length (200 feet over wetlands and 154 feet over water). Proposed upland improvements include a 135 feet long and 16 feet wide stone aggregate access road from White Street to the existing basketball court which will be used for vehicle parking. ANTICIPATED IMPACTS The proposed 8 feet wide walkway will shade 1000 square feet of phragmites and cypress wetlands and 600 square feet of the same wetlands located within the Estuarine Shoreline Area of Environmental Concern (AEC). The proposed 8 feet wide pier, covered platform, 8 feet wide "L", and canoe launch will shade 2,316 square feet of Public Trust Area and Estuarine Waters. Temporary water turbidity will occur during construction. . The Hertford Housing Authority office is located at the front of the property that borders Raccoon creek. A proposed access road, approximately 135 ' long and 16' wide, will be built from White Street to the parking area. The road will have a stone aggregate surface. Behind the office an existing cement pad, 50'X 90' will be used for the parking area, by the addition of painted lines, delineating the spaces, and will include one handicapped space. Behind the cement pad is the land where the trail will be built that will allow for water access. The total trail (including the fishing pier), almost 450' of boardwalk will reach the shore of the creek and will extend 92` into the creek ending with a canoe launch to the right and a 100' fishing pier to the left. The total length of the boardwalk will have a 32" rail for safety. The 12'X 16' hip roofed shelter, located 50' from the shore on the boardwalk, will provide covered access for fishing and viewing the creek for seniors, physically challenged and the general public. Both the fishing pier and the shelter will have built-in benches. In addition, because of the location, the 4 schools in the county will be able to utilize the site for an environmental classroom. The 7 or 8' wide boardwalk trail will minimally disturb the existing vegetation, but some of the phragmities will need to be cleared. At the shore end is a natural inlet bordered on both sides by cypress trees. By locating the trail through this inlet (see drawing) no trees will need to be removed. The site is not designed to accommodate the launching of canoes/kayaks, but rather to be used as a rest stop/picnic area for paddlers already on the water. It will become one of several planned access/respites in order to increase recreational opportunities on the river for all residents. - Also included in the project are 2 picnic tables, which will be located at the end of the access road, near the parking on an existing grassy field. A trash receptacle and signage will complete the project. The access area will be used for outdoor recreation activities that include bird watching, viewing the creek and river, picnicking, fishing and a canoe/kayak rest area on Raccoon Creek and the Perquimans River. For safety reasons, it will be open from dawn until dusk, so there is no necessity for lights. Upon completion of the road construction of the boardwalk will commence and clearing of the vegetation, as well.
