Box 1411 Manteo, NC, 27954 APPROVAL of 401 Water Duality Certification with Additional Conditions Dear Mr. Hollowell: You have our approval, in accordance with the attached conditions, to shade 0.051 acre of vegetated wetlands and Estuarine Waters in order to construct an elevated walkway/pier access to the Pamlico Sound at the Kinnakeet Shores Subdivision in Dare County, as described in your application received by the Division of Water Quality on February 20, 2004. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application: If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. PROJECT SUMMARY: This project involves the construction of an 8 feet wide wooden elevated walkway/pier structure that will provide kayak/canoe access to the Pamlico Sound. The access will be gated to physically exclude path use by any motorized vehicles or equipment other than a small tractor or cart designed to trailer the kayaks, canoes and passengers to the launch site. FIELD INVESTIGATION REPORT Kinnakeet Shores, LLC, Dare County Page 2 Project Setting The application site is located west of NC 12 in the Village of Avon in Kinnakeet Shores Subdivision in Dare County. The project site is located on a 10.79-acre tract near the north boundary line of the subdivision. The tract is owned by Kinnakeet Shores, LLC, in c/o Ray Hollowell. The 11-acre tract consists mostly of shallow waters and wetlands with some high ground areas located near the southern-most portion of the tract closest to NC 12. The property also includes a narrow high ground strip that extends north to the Pamlico Sound. This property includes over 2,000 feet of shoreline. In addition, the Kinnakeet Shores, LLC owns several thousand feet of additional shoreline that is considered as `open space' for the subdivision. The referenced narrow, high ground area associated with this tract is approximately 15 feet wide, and is aligned parallel to a narrow approximately 1,500 foot long canal/ditch to the west that was originally used for duck hunting in the adjacent wetland marshes and the Pamlico Sound. This canal extends from the Pamlico Sound to the south and terminates near an existing 12 feet wide - 120 feet long wooden bridge that crosses from the adjacent high ground over existing wetlands and shallow waters to access the existing narrow upland area. This narrow high ground strip consists of sand-spoil material that was excavated to probably create the canal. The majority of the high ground vegetation has been cut to provide for a pedestrian path, and a planned small vehicle path to the Pamlico Sound. Much of this area has been mulched to retard any erosion of the upland area and to provide a more eco-friendly access to the Sound. The upland area was previously vegetated with Smilax spp., Toxicodendron radicans, Myrica cerifera, Juniperus virginiana, Liquidambar styraciflua, and Magnolia virginiana. A narrow `404' wetland fringe exists near the upland-wetland interface between the wetland and high ground areas. These `404' plant species include predominately Borrichia frutescens, Myrica cerifera, Iva frutescens, and Baccharis halimifolia. Most of the canal has silted in, and about one-half of the length (the most southern portion) has become heavily vegetated with Typha spp., Juncus roemerianus, Distichlis spicata, Scirpus spp., and Spartina alterniflora. The water depth in this canal does not exceed one foot. A coastal wetland fringe of Spartina patens and Spartina alterniflora is also located along the shoreline of the Pamlico Sound at the northern-most end of the high ground area. The waters of the adjacent canal carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. During the site investigation, no shellfish were observed along the water bottom. Off-shore water depths at a distance of approximately 50 feet out do not exceed 6 inches below the NWL. FIELD INVESTIGATION REPORT Kinnakeet Shores, LLC, Dare County Page 3 The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 feet landward of the NWL. The CRC has also designated coastal wetland vegetated areas, like those described above, as Coastal Wetland AEC. Project Description The applicant proposes to provide an access for the residents, property owners and guests of the Kinnakeet Shores Subdivision. This project involves the construction of an 8 feet wide mulch pedestrian-cart path that will extend to a wooden elevated ramp/walkway/pier/platform/kayak launch structure. The structure is aligned such that it will be at least 15 feet from the neighboring riparian setback to the north. The proposal does not provide for any moorings and will not interfere with any adjacent riparian access. This structure will be used to provide kayak/canoe access to the Pamlico Sound. The access will be gated at the existing wooden bridge to physically exclude access by any motorized vehicles other than a small tractor or cart designed to trailer the kayaks and canoes to the launch site. The constructed portion of the structure is designed to be elevated over all wetlands, and as narrow as possible while still allowing a cart or small tractor to trailer kayaks and canoes, along with individuals, to the launch area. The launch area will consist of an elevated platform large enough for the cart to unload equipment and passengers, and to be able to turn around to exit the launch area. The applicant realizes that typically only 6 feet wide elevated access structures are allowed over waters and wetlands unless a wider structure is necessary to provide an access that could otherwise not be provided. The 8 feet wide access, while exceeding this 6 feet limitation, will allow for both pedestrians and cart passage at the same time in a safe manner. The current proposal is also a 4 feet width reduction from the applicant's earlier proposals. This project includes the following site work to provide for the described access. • 1,110 feet of 8 feet wide wood mulch path; • the installation of a metal swing gate at the bridge entrance to the site; • an 8 feet wide by 20 feet long wooden, elevated ramp at the north end of the mulched path to connect to an elevated walkway-limited vehicle and pedestrian access; • an 8 feet wide by 150 feet long elevated walkway-limited vehicle and pedestrian access; • an 8 feet wide by 20 feet long pier to connect to the kayak launch area platform; • a 25 feet by 30 feet kayak launch area platform; • a 12 feet by 15 feet floating dock; • a 5 feet by 5 feet set of steps. FIELD INVESTIGATION REPORT Kinnakeet Shores, LLC, Dare County Page 4 Anticipated Impacts The anticipated impacts from this project are associated with the proposed 1,110 feet long pedestrian-cart path and the shading of existing wetlands by the proposed elevated access and kayak/canoe launch structure. The proposed path will result in approximately 8,800 square feet of land disturbance; however, most of this area has already been previously cleared and mulched. The elevated portion of the structure will result in the shading of approximately 1,200 square feet of wetlands, of which about one-half are coastal wetlands. The structure will also shade 1,115 square feet of public trust area- estuarine waters of the Pamlico Sound. The proposed work will not result in any excavation of waters or wetlands and will not interfere with any adjacent riparian access. The proposed project will result in some temporary turbidity associated with the site work and placement of support pilings for the proposed structure. The proposed structure will provide riparian access to the waters of the Pamlico Sound. The type of watercraft proposed in this project will also increase the opportunity for the residents to enjoy the coastal resources of the area while minimizing impacts to the adjacent waters that could be expected from motorized watercraft. PROJECT NARRATIVE CAMA MAJOR PERMIT - Kinnakeet Shores Northern Boundary Sound Access The purpose of this project is to allow Kinnakeet Shores Resort landowners foot, kayak and canoe access to the Pamlico Sound. An eight foot wide gate is proposed at the entrance bridge to exclude vehicle access only to the proposed golf cart vehicle with trailer to transport people, kayaks and canoes to the sound. This gate will be locked at all times and allows for foot traffic only when locked. An eight foot wide, 1,110 linear foot wood chip path is proposed on highground 30' pedestrian easement from the existing 11.5 foot bridge to the proposed eight foot wide ramp (8'x 20'= 160s.f.) and walkway (8'x 150'= 1,200 s.f.) over Section 404 and coastal wetlands. An eight foot wide, 20 linear foot (8'x 20'= 160 s.f.) wooden pier is proposed to access a platform (25'x 30'= 750 s.f.) to be utilized as a turnaround area to accommodate golf cart with trailer. A wooden floating dock (12'x 15'= 180 s.f.) will be attached to the platform for kayak/canoe launching, with a set of five foot wide steps. Purpose of the eight foot wide ramp, walkway and pier is to allow safe passage of golf cart and foot traffic. The eight foot width will allow a golf cart to safely pass oncoming single file foot traffic. The proposed project does not require fill in Section 404 or coastal wetlands.
