The purpose of this letter is to request that the NC Division of Water Quality consider amending
the above referenced Water Quality Certification. The original condition is copied below as it
appears on the May 16, 20061etter (dated received May 22, 2006) and is then followed by our
request and justification for the amendment.
Water Quality Certification with Additional conditions:
A final, written stormwater management plan (including a signed and notarized
Operation and Maintenance Agreement) shall be submitted to the 401 Oversight and
Express Permitting Unit (2321 Crabtree Blvd., Suite 250, Raleigh, NC, 27604) within 60
days of the issuance of the 401 Water Quality Certification. The stormwater management
plans shall be approved in writing by this Office before the impacts specified in this
Certification occur per Condition No. 4 in GC No. 3402. You have the option of using
the Express Review Program for expedited approval of these plans. If you propose to use
the Express Review Program, remember to include the appropriate fee with the plan.
Site-specific stormwater management shall be designed to remove 85% TSS according to
the latest version of DWQ's stormwater Best Management Practices manual at a
minimum. Additionally, in watersheds within one mile and draining to a 303(d) listed
waters, as well as watersheds that are classified as nutrient sensitive waters (NSN~,
water supply waters (WS), trout waters (Tr), high quality waters (HQi~, and outstanding
resource waters (ORT~, the Division shall require that extended detention wetlands, bio-
retention areas, and ponds followed by forested filter strips (designed according to latest
version of the NCDENR stormwater Best Management Practices Manual) be constructed

as part of the stormwater management plan when aide-specific stormwater management
plan is required.
Also, the stormwater management plan (as approved by the Wetlands Unit) shall be
implemented before any permanent building or other structure is occupied at the subject
site.
The structural stormwater practices as approved by the wetlands unit as well as drainage
patterns must be maintained in perpetuity. No changes to the structural stormwater
practices shall be made with without written authorization from the Division of Water
Quality.
Prior to the submittal of the Pre Construction Notification, there were several Pre -Construction
Meetings that discussed the phasing aspects of the project. Due to its size (over 800 acres), and
the nature of the proposed development within the subject. property, we are requesting a revision
to the above condition of the 401 Water Quality Certification (issued on May 16, 2006) that
removes the 60 day requirement for the submittal of stormwater management plans. It has been
our intention, from the earliest Pre Construction Meetings, to submit stormwater management
plans for those phases requiring stormwater treatment devices, prior to beginning that phase of
construction.Additionally, specific areas within those phases of the project that require a
stormwater plan have been set aside for stormwater treatment areas to satisfy the above
requirements. We intend to fully comply with all aspects of the 401 Water Quality Certification
and DWQ's Stormwater Best Management Practices manual in that no permanent structures will
be constructed within phases requiring a stormwater management plan prior to DWQ's approval
of that phase's stormwater Management Plan.
