Dear Mr. Smith:
You have our approval, in accordance with the conditions listed below, to impact approximately
750 square feet (W) of Zone 2 of the protected riparian buffers for the purpose of constructing a
residential dwelling, porch and steps on the subject property as described within your application
dated May 22, 2004. This letter shall act as your approval for the use of the "General" Major
Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of
Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal
Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality
Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In
addition, you should get any other required federal, state or local permits before you proceed
with your project including (but not limited to) Sediment and Erosion Control and CAMA
permits. This approval shall expire when the variance expires on April 11, 2006 unless the
variance is renewed before that time by the EMC.
This approval is for the purpose and design that you described in your variance request. If you
change your project, you must notify us and you may be required to send us anew request for
approval. If the property is sold, the new owner must be given a copy of this approval and
is thereby responsible for complying with all conditions. This approval requires you to
follow the conditions listed below.
The Additional Conditions of the Certification are:
1. Certificate of Completion - Upon completion of all work approved within the 401 Water
Quality Certification or applicable Buffer Rules, and any subsequent modifications, the

applicant is required to return the attached certificate of completion to the 401/Wetlands
Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.
2. Diffuse Flow - All new stormwater drainage shall be directed to vegetated areas as
diffuse flow at non-erosive velocities prior to entering the protected riparian buffers as
identified within 15A NCAC 2B .0233(5). No new ditching or piping of stormwater
through the protected buffers is allowed.
3. Protective Fencing - The outside buffer boundary and along the construction corridor
within this boundary approved under this authorization shall be clearly marked with
orange warning fencing (or similar high visibility material) for the areas that have been
approved to infringe within the buffer prior to any land disturbing activities to ensure
compliance with this variance approval and 15A NCAC 2B .0233.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. This approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River
Riparian Buffer Protection Rules (15A NCAC 2B .0233 (9)(b)). Please call Mr. Bob Zarzecki at

Dear John:
Enclosed are resubmission for both Lot 10 & Lot 11, Beards Creek Acres. Your office returned
both these with "Request for Additional Information," on April 27, 2004. Our original submissions
were mailed to DWQ on Jan. 15, 2004.
Project # 04-0510: On Lot 10 our client, Judith Henning, who is buying the lot from Stewart Smith
has agreed to reduce the house size and this and a minor rotation has allowed us to reduce the
encroachment into Zone 2, to 425 Sq. Ft. As this appears to pretty much put this lot in line with the
400 Sq. Ft. recommendation of Mr. Lane I am hopeful this will be sufficient for its approval. But,
please bear in mind that Mrs. Henning says she will not be purchasing this lot if this variance
request is denied and as her contract has gone past its time limits due to the delays with our earlier
submittal she can certainly back out of her contract.
Project # 04-0227: Lot 11 offers more challenge with Mr. Lane's recommendation suggesting only
200 Sq Ft. encroachment is needed. Yes, you can position the house with that size encroachment if
you eliminate some of the driveway and all space for cars to park. That certainly is not reasonable.
This lot has a relatively high ridge running through the center of the lot with the ground braking
sharply to the sides which make adjusting both driveway entrance and parking area impractical.
We have reduced the size of the parking as much as possible and that has allowed us to move the
house to a somewhat more favorable location and reduced its encroachment. Even though it means
moving the garage to a less desirable location due to ground elevations we have repositioned the
garage to be outside the Buffer Zone further reducing the encroachment. All together we have
been able to reduce the requested encroachment from 1,200 down to 750 Sq. Ft. Mr. Smith and I
have made ever effort to reduce the encroachment, have squeezed all we can and are at the point
where any further reduction would make the lot impractical to build on.
While I could make more recommendation for why both these lots should be approved I believe the
efforts and reasoning as submitted should be sufficient and look forward to a speedy resolution
granting these Variances from your office.

1. Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat
map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying
out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area
of buffer impact in ft2.]:

Dear Pamlico County Landowner,
In 1997, the North Carolina Legislature appointed a commission to protect the water quality
and the environment in Eastern North Carolina. Legislation has been passed that may affect the
intended use of your property. In a consolidated effort of the Pamlico County Commissioners and the
Pamlico County Board of Health, the Commission has established a special provision for you. As a
Pamlico County landowner, there is a new window of opportunity to obtain a 'General Variance', as
approved by the Water Quality Committee of the Environmental Management Commission on
51092001. This variance expires on April 11, 2008.
This is your window of opportunity to apply for a variance to plan for future land use. Basically,
you must provide written proof to the State that the land was platted and recorded prior to August 1,
2001. Secondly, the State will recognize a lifetime septic permit issued by the Pamlico County Health
Department as a substantial outlay if dated prior to August 1,2001. Thirdly, the variance remains with
the property just like the septic permit for the life of the land.
Our records indicate that you have a valid lifetime permit for your property in our records. In
order for you to ensure the intended use of the land, you need to complete the enclosed variance
request. This process should be initiated as soon as you possibly can. Applications should be mailed
to DWQ 401AMetlands Certification Unit, 1650 Mail Service, Center, Raleigh, NO 27699-1650.
The Pamlico County Health Department's goal is to assist you as much as possible with our
limited resources. Copies of your permit, plat, and other surveys (if in our records) are available at a
cost of $5.00 and will be mailed directly to you to be included with your application.

On February 16, 2004, the Division of Water Quality (DWQ) Wetlands/401 Unit received your variance request dated
January 15, 2004. On April 5, 2004, the DWQ received additional inforrration regarding your variance request. The DWQ
has determined that your project is eligible for the use of the "General" Major Variance From the Neuse and Tar-Pamlico
Riparian Buffer Rules for residential structures on existing lots within the coastal counties as defined by the Coastal Area
Management Act, Approved 51912001. However, the DWQ needs additional information in order to complete the approval
process of your variance. Therefore, unless additional information is provided as described below, we will have to move
toward denial of your request per 15A NCAC 2B.0233(9) and will place this project on hold as incomplete until we receive
this additional information. Specifically:

• It appears that the house could be rotated, repositioned or otherwise modified to minimize impacts to the protected
riparian buffers from your proposed 1,200 square feet to approximately 200 square feet. Please modify your plans
to minimize the buffer impacts or provide additional justification as to why the impacts cannot be modified.
Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and to Mr.
Tom Steffens of the DWQ Washington Regional Office. If we do not hear from you in three weeks, we will assume that you
