This correspondence is in reference to the Louis Berger Mitigation Bank,
Homestead and Second Creek Sites, which you have developed. The Homestead Creek
site is on the southeast side of Third Creek, and the Second Creek site is on the northwest
side of Second Creek, both north of US 70 in Rowan County, North Carolina.
Reference is made to the Year-Five Monitoring Report dated February 2009,
received in our office on February 13, 2009 and the subsequent site inspection conducted
by the resource agencies on May 1, 2009 to review the sites and determine whether the
remaining available credits are releasable. Accordingly, based upon a review of the
information provided in the monitoring reports and the site inspections, all members of
the Mitigation Banking Review Team have determined that remaining credits of the
wetland and stream credits are available as follows:
a. Homestead wetlands: 100% of the credits (6.5 credits), for a cumulative total
of 16.3 (The site met the hydrology and vegetation criteria and appears to be doing well):
6.5 credits.
b. Second Creek wetlands: 100% of the credits (6.1 credits), for a cumulative
total of 15.2 credits: 6.1 credits.
c. Homestead stream: 100% of the credits (625 linear feet (If)), for a cumulative
total of 2,5001f, with a caveat that 2861f of the Homestead stream credits shall be used to
mitigate only for intermittent stream impacts that require mitigation, and the remaining
2,214 if of credits can be used for perennial stream impacts that require mitigation (The
applicant has demonstrated persistent flows downstream of Station 286): 625 If.

d. Second Creek stream: 20% of the credits (1501f), for a cumulative total of
1,5001f (50% of the available credits): the site is demonstrating biological perennial
stream characteristics in -50 percent of the stream channel length): 1501f.
Furthermore, you are hereby released from any further monitoring on either site.
