Sullins, Deputy Director Division of Water Quality March 2, 2004 DWQ# 04-0144 Dare County Town of Manteo C/o Mr. Fred Featherstone 407 Budleigh Street Manteo, NC, 27954 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Manteo: a You have our approval, in accordance with the attached conditions, to place fill in 0.16 acre of non-vegetated wetlands in order to refurbish 355 feet of existing riprap along the Shallowbag Bay and Dough's Creek waterfront in Dare County, as described in your application received by the Division of Water Quality on February 3, 2004. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at htti):Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application; for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre; compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the. conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; N. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters (March 1997); 6. Sediment curtains shall be placed in the water around the work area while relocated the existing riprap and throughout construction of the new riprap bulkhead. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The Town of Manteo proposes to refurbish 355 feet of existing riprap along the waterfront with new rock. FIELD INVESTIGATION REPORT Town of Manteo PAGE #2 PROJECT SETTING The project site is located off US 64/264 in the Town of Manteo, at the Bicentennial Park at the end of Queen Elizabeth Avenue, Dare County. Located along the northwest side of the park and in Dough's Creek are three public piers, two with 28 mooring slips and one with a covered gazebo. In the approximate center of the park and in Shallowbag Bay is a 245 feet long, 10 feet wide public pier with 10 mooring slips along one side of the pier and a 70 feet by 70 feet platform at it's waterward end. The platform was built over an existing concrete platform, which formally supported a wastewater holding tank. A replica of the Roanoke Marshes Lighthouse is currently under construction on the platform (see CAMA Major Permit #25-98). Water depth at the pier/platform end is approximately -5 feet. The shoreline along the park has been stabilized with varying amounts of riprap that consists primarily of concrete and brick construction debris. This area is experiencing backfill erosion and is a habitat for rodents, according to the applicant. A small section of shoreline directly adjacent the main pier has a bulkhead with riprap on the waterward side. A wooden walkway is located on the southern end of the park, and is constructed over the riprap shoreline. The surrounding park is sparsely vegetated with lawn grasses and a few small pines. A town-owned building is located at the end of Old Tom Avenue, adjacent to a public parking lot on Fernando Street. The park is bounded on the southeastern property line by a residential lot and on the northwest side by retail shops and condominiums. The western side of the park is bounded by Fernando Street and Queen Elizabeth Avenue. The remainder of the park fronts on Shallowbag Bay and Dough's Creek. Shallowbag Bay is classified as SC waters and Dough's Creek is classified as SC-HQW waters by the Division of Environmental Management. Dough's Creek is a primary nursery area designated by the Division of Marine Fisheries. DEVELOPMENT PROPOSED The applicant proposes to refurbish and enlarge a 355 feet long section of existing riprap along the Town's waterfront. The existing concrete and brick construction debris will be excavated and placed overboard to create a foundation for the placement of more uniform and smaller riprap identified as "18-inch NCDOT Class 2 riprap". The foundation will be approximately 20 feet waterward of Normal Water Level (NWL). Prior to the placement of the riprap, the banks of Dough's Creek and Shallowbag Bay will be graded to facilitate the placement of a geotextile filter material and the new riprap. The applicant proposes to install five timber pilings with hazard to navigation signs approximately 15 feet waterward of the toe of the proposed riprap. FIELD INVESTIGATION REPORT Town of Manteo PAGE #3 ANTICIPATED IMPACTS The proposed development project will result in approximately 7,100 square feet of Public Trust Area and Estuarine Waters, Areas of Environmental Concern (AEC), being filled with riprap material. Approximately 525 cubic yards of riprap material will be placed below NWL. Approximately 7,100 square feet of Estuarine Shoreline will be disturbed during the construction of the riprap and grading. The project will result in increased water turbidity resulting from the bottom disturbance and fill involved. The turbidity should subside after construction.
