Reference your application for a Department of the Army permit to maintenance dredge an
existing manmade canal and construct a bulkhead, on property located at 138 Gabbard Lane,
adjacent to Hog Quarter Creek and the Currituck Sound, neat Poplar Branch, in Currituck
County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with applicable State authorization and the approved plan. Failure to
comply with the State authorization or conditions of the general permit could result in civil
and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Ms. Dorman:
You have our approval, in accordance with the attached conditions, to dredge, fill or otherwise disturb 2.58 acres of
Estuarine Shoreline and shallow water habitat in order to maintenance dredge a canal and boat basin and to construct
1,650 feet of vinyl bulkhead off Hog Quarter Creek in Currituck County, as described in your application received by the
Division of Water Quality on January 30, 2004. After reviewing your application, we have determined that this fill is covered
by General Water Quality Certification Number 3400, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed,
Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application, for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur; MA

4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A
NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters
(March 1997).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Perhaps we could include a condition prohibiting placement of the spoil pile in wetlands? Of course I
don't know the particulars so I'll wait to hear from you.

8. PROJECT SUMMARY: Maintenance dredge 1,750 feet of canal and 370 linear feet
of a boat basin off Hog Quarter Creek and construct 1,650 feet of vinyl bulkhead.
PROJECT SETTING
Laurie and Robert DeGabrielle own the R and K Horse Farm located at 138 Gabbard
Lane in the Village of Spot, Currituck County, adjacent to Hog Quarter Creek off Currituck
Sound. The farm fronts Hog Quarter Creek, which runs in a north-south direction, a
distance of 1700 linear feet. As early as the 1960's, the high ground portion of the tract
was in agricultural use and products such as peaches and potatoes were shipped to
market via a man-made canal off Hog Quarter Creek. The 2000 feet long, 30-40 feet
wide canal extends off the creek in an east-west direction and lies parallel to and 350 feet
from the farm's southern property line. Sediment has collected in the canal such that the
bottom contour nearest the landward end measures less than 0.5 feet below Normal
Water Level (NWL).
To access the site, turn east off U.S. Highway 158 onto South Spot-Road (SR 1111).
After traveling 7/10 of a mile, turn left onto North Spot Road (SR 1113) and then right
onto a 10 feet wide pathway designated Gabbard Lane. Follow Gabbard Lane up to the
metal gate. The western end of the canal is located just east of the gated entrance.
Man-made features noted on the tract include a horse barn, four sheds, two ponds, wood
fences, and several riding trails. Spoil material has been placed mostly on the canal's
north bank. Along the north side, there is a 25 feet wide, 1200 feet long soil road with a
60 feet wide turn-around at its eastern end. Just to the north of the turn-around there is a
small pier/platform, which extends approximately 10 feet into a man-made boat basin.
High ground banks with an elevation of 4.0 feet above mean sea level were noted along
the most landward 800 linear feet of the canal. Coastal and non-coastal wetlands
vegetated with a mixture of Black Needlerush (Juncus roemerianus), Bulrush (Scirpus
spp.), Saw Grass (Cladium jamaicense), Salt Reed Grass (Spartina cynosuroides), Marsh
Elder (Iva frutescens), Common Reed (Phragmites australis), Wax Myrtle (Myrica
cerifera), and Red Maple (Acer rubrum) were noted along the low-lying banks of the other
1200 linear feet of canal.
The waters of Hog Quarter Creek, in the vicinity of the project, are classified as SC by the
NC Environmental Management Commission. These waters are classified as joint waters
by the NC Marine Fisheries Commission and NC Wildlife Resources Commission, and as
Estuarine/Public Trust Waters by the NC Coastal Resources Commission. Water depths
within the canal range from 0.5 feet at NWL at the western end to a (connecting) depth of
2.5 feet at NWL measured 250 feet from Hog Quarter Creek. The presence of
submerged aquatic vegetation was not noted in the vicinity of the project. The presence
of shellfish and finfish resources was not observed during the site inspection. Review of
available information suggests that there are no known archeological sites or geological
formations associated with the site.

PROJECT DESCRIPTION
• Use a hydraulic dredge to excavate 2,142 cubic yards of silt/sand from 1,750 linear
feet of canal bottom with an existing depth of 1.0 foot at NWL to a final depth of
2.5 feet at NWL. The proposed dredge area averages 20 feet in width.
Maintenance dredge 325 cubic yards of silt/sand from 370 linear feet of a boat
basin with an existing depth of 1.6 feet at NWL to a final depth of 2.5 feet at NWL.
• Construct a 150 feet by 250 feet spoil retention basin with a capacity of 3100 cubic
yards within high ground located 100 feet south of the canal. Proposed
dimensions are:
Berm Base - 30 feet wide
Berm Top - 5 feet wide
Berm Height (inside) - 4 feet tall
The basin's capacity appears adequate to handle the 2,467 cubic yards of spoil
material to be excavated.
• Return the effluent from the bermed disposal area to the canal area being
dredged.
• Construct 1,650 linear feet of vinyl bulkhead landward of any wetlands and just
landward of or at the NWL along both sides of the high ground portion of the canal.
Dewatered spoil material will be used to backfill the 1,650 feet of bulkhead, which
will be installed without excavation. The adjoining shorelines are unstabilized.
ANTICIPATED IMPACTS
Hydraulic dredging within 1,750 linear feet of the canal will eliminate 32,130 square
feet of Estuarine/Public Trust Shallow-Water Habitat.
• Dredging within the 370 feet long boat basin will eliminate 9,750 square feet of
Estuarine/Public Trust-Shallow Water Habitat.
• The backfilling associated with the construction of 1,650 linear feet of vinyl
bulkhead will result in the filling of 33,000 square feet of high ground buffer area
located within the Estuarine Shoreline.

The construction and filling of the spoil containment basin will result in the
disturbance of 37,500 square feet of high ground located outside the 75 feet wide
Estuarine Shoreline AEC.
Some short-term, localized turbidity will occur as a result of the dredging activity.

and cross-sectional drawings) drawn to scale in black

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Anny Corps of Engineers
regarding that agency's use of larger drawings.) A site
or location map is a part of plat requirements and it

must be sufficiently detailed to guide agency personnel
unfamiliar with the area to the site. Include highway or
secondary road (SR) numbers, landmarks, and the like.
•A Stormwater Certification, if one is necessary.
•A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats by
certified mail. Such landowners must be advised that
they have 30 days in which to submit comments on the
proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Y
The proposed project for R & K Horse Farm, LLC includes maintenance dredging a
manmade canal connecting Hog Quarter, bulkheading a portion of the north and south
sides of the manmade canal, and backfilling bulkhead on highground. Spoil from the
dredge will be located on the applicant's highground property adjacent to the canal
outside the 75'AEC. The purpose of the proposed activity is to stabilize a portion of the
existing canal from further erosion and continue historical use of the manmade canal by
motorized boat. Through the years material from the canal banks have eroded into the
canal along with silt accumulation through wind tides. During west winds portions of the
canal are completely dry restricting boat navigation. Local residents claim the historical
use of this canal was created back in the 60's when the adjacent area was harvested as a
potato fields. The canal allowed for export of potatoes harvested. Waterfowl hunters
also used the canal; a remnant duck pen lies within the canal adjacent to the boat basin,
which hunters used to contain live decoys. It is apparent, dredge spoil created years ago
from digging out a canal, is the highground area north of the existing canal, which has
been historically used as an access to the boat basin and duck pen.
A pre-application meeting was held on site August 12, 2003. AEC staff met with the
applicant Laurie DeGabrielle, Ed Harrell with the Division of Coastal Management and
Tom Walker with the US Army Corp of Engineers. Mr. Walker with USACE confirmed
the access road and turn around area by the boat basin did not fit the criteria of
jurisdictional wetlands, therefore it is considered highground. Mr. Walker also reviewed
the bulkhead alignment area where backfill is proposed and the location of the spoil area.
Mr. Walker confirmed that jurisdictional wetlands would not be impacted by the location
of the proposed bulkhead alignment, backfill and spoil area.
On October 15"' AEC staff met with Ed Harrell to take water depths within the manmade
canal and Hog Quarter. The proposed dredge ends at the point where the connecting
depth does not change. It was determined by observations of the survey crew and others
that the water depth at that time was approximately one foot above normal water level
(NWL). Since that time, AEC staff has confirmed the location of the NWL by revisiting
the site during times of no wind. No submerged vegetation (SAV's) observed during
times of field measurements and site visits. Lack of SAV's would be due to the silty
substrate of the canal bottom.
The existing water depth within the canal averages one foot. The proposed dredge depth
is 2.5 feet, to be consistent with the connecting depth at Hog Quarter. The existing water
depth within the boat basin averages 1.5 feet. The proposed dredge depth of the boat
basin is 2.5 feet. Dredge spoil from the proposed maintenance dredge will be
approximately 2,700 cubic yards. Proposed canal maintenance dredge length is 1,750
linear feet; dredge width varies 15 to 25 feet. Proposed boat basin maintenance dredge is
370 linear feet; dredge width varies 15 to 60 feet.

A small barge with an excavator with pumps will be used to pump the dredge s `i MAR;MAGEMENT
proposed spoil location to be retained behind a pre-constructed berm area on Tract I. AEETM CITY
Berm area (spoil area) will be constructed using an excavator creating a berm three feet
above grade with a 3:1 slope creating a retaining area three feet below grade (excavated
area). The capacity of the bermed area is 3,100 cubic yards.
Equipment used for maintenance dredging will be an excavator, small barge and pumps.
A sediment curtain will be placed at the intersection of the manmade canal and Hog
Quarter before excavation begins. An excavator will be used to create the spoil berm
area. Hydraulic pumps, small barge and hand tools will be used to construct the
bulkhead. Bulkhead length is 1,650 linear feet (840' north side of canal, 810' south side
of canal). Construction of the bulkhead including backfill area will not impact wetlands.
Coastal wetlands will not be crossed during dredging as well.
Once the canal has been dredged and the spoil containment area has settled; bulkhead
construction will take place using the spoil material as backfill. The bulkhead alignment
will be located along the Normal Water Level (NWL), and not to exceed. No wetland
impacts proposed for the construction or backfill of the bulkhead. Proposed bulkhead
length on the north side of the canal is 840', proposed bulkhead length on the south side
of the canal is 810'; a total of 1,650 linear feet of bulkhead. The existing culvert at the
beginning of the bulkhead area will remain. This culvert connects the existing spring fed
pond to the canal. The water flow direction of the spring fed pond flows down into the
canal.
Total disturbance within the 30 foot buffer is excluded to the backfill area behind the
proposed bulkhead, which is approximately 20 feet wide and 1,650 feet in length
(approx. 33,000 s.f.). Proposed temporary highground disturbance (outside the 75'AEC)
is the location of the spoil containment area 37,500 s.f.
