The applicants seek a Department of the Army (DA) permit to construct a private pier and boat lift. The Field Investigation Report (FIR) of the North Carolina Division of Coastal Management states the work would shade 2,670 square feet (ft) of coastal wetlands and incorporate 973 ftz of non-vegetated wetlands (open water). These comments are submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act (ESA) of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). Based on the available information, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on fish and wildlife resources under our jurisdiction. The proposed pier would be oriented approximately north-south and be six feet wide. Plan drawings indicate that the bottom on the pier would be 8.3 feet above mean low water. This design should allow some penetration of sunlight to support vegetation. Therefore, the Service has no objection, from the standpoint of fish and wildlife, to the issuance of a DA permit for the work as described in the FIR. The Service would concur with a determination by the District Engineer that the proposed activity is not likely to affect species designated as threatened or endangered, or their critical habitat, pursuant to the ESA. , The Service appreciates the opportunity to comment on this PN. PROJECT SUMMARY: The applicants are proposing to construct a private pier and boat lift. William and Sephronia Moxley Page Two 9. PROJECT DESCRIPTION The project site is comprised of one single-family residential lot, located at 152 Ocean Greens Lane in the Ocean Greens Subdivision, adjacent to Piney Point Creek in Caswell Beach, Brunswick County. Travel south from US Hwy 17 along SR 87 to SR 133. At Dosher Cutoff Road turn right and proceed to the next traffic light. Turn right again onto SR 211, and proceed to Long Beach Road by making a left turn at the next traffic light. Continue south on Long Beach Road and cross over the bridge to Oak Island. Travel straight through the traffic signal and continue along Caswell Beach Road to the Ocean Greens subdivision located on the left side of the road. Turning into the subdivision, travel on Ocean Greens Lane and 152 Ocean Greens Lane will be on the right side of the road. A single-family residence is located on the lot, and community water and sewer serve the subdivision. The property measures approximately 8100 square feet. The approximate elevation of the lot is 14 feet above mean low water. The highground area is maintained with grass and natural trees and shrub vegetation. The width of the lot along the shoreline is approximately 52 feet. The interface between marsh and high ground consists of mixed high marsh species, including, Sea Ox-eye (Borrichia frutescens), Salt Meadow Grass (Spartina patens) and Black Needlerush (Juncus romerus). There is an approximately 80 foot wide border of high coastal marsh characterized by Black Needlerush (Juncus romerus) and Smooth Cordgrass (Spartina altern fora) that transitions to low marsh vegetation in the proximity of mean high water. From here a broad expanse of Smooth Cordgrass (Spartina alterniora) extends out approximately 430 feet to the open waters of Piney Point Creek. Smaller tidal channels (approximately 30 feet wide) cut through the marsh in front of the applicant's and the neighboring properties. The adjacent shorelines have not been stabilized by bulkheads or rip rap. Water depths in the project area range from zero to about -8.5 feet below mean low water. Adjacent to the applicant's property, the width of the open water of Piney Point Creek is 170 feet. The waters of Piney Point Creek have been classified SA by the NC Division of Water Quality. The creek and adjacent marsh area are designated as a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and are open to the taking of shellfish. c PROPOSED PROJECT The applicants are proposing to construct a private pier and dock system to provide access from the property to the waters of Piney Point Creek. The six foot wide pier structure would have a total length of 720 feet (with 481 feet from Mean High Water). At the waterward end there would be and l' x I l'uncovered stationary deck and a 21' x 12'uncovered boatlift. At approximately 200 feet waterward of mean high water, the proposed pier would cross over a small tidal channel. To allow for navigation under the pier, the structure would be elevated to a height of 12.7' above mean low water and have a piling span of 14'. Near the proposed boatlift, water depths are approximately - 4'mean low water. The proposed dock and boatlift would extend 30'into the creek. The docking structures are located within the applicants' riparian corridors as established by Brunswick Surveying. The 15' setback from the riparian line has been waived by both of the adjacent property owners. I O.ANTICIPATED EWPACTS Construction of the proposed project would cause the shading of 2670 square feet (.06 acres) of coastal wetlands and the shading and incorporation of 973 square feet (.02 acres) of Public Trust Area and Estuarine Waters. There should not be any adverse navigational impacts resulting from placement of this structure.
