Valone c/o Reedy Creek Road, LLC 14600 Weston Parkway, Suite 300 Cary, North Carolina 27513 Subject Property: Reedy Creek Road Subdivision Modification of AUTHORIZATION CERTIFICATE dated February 19, 2004 APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer Protection Rules (1 SA NCAC 2B .0233) with ADDITIONAL CONDITIONS, DWQ EXPRESS REVIEW PROGRAM Dear Mr. Valone: You have our approval, in accordance with the attached conditions' and those listed below, to place fill within or otherwise impact 65 feet of stream and 10,370'square feet (ft) or 0.23 acres of protected riparian buffers for the purpose of a road crossing at the subject property, as described within your application dated January 28, 2004. After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non- discharge, and Water Supply Watershed regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Written Pocket Wetland Facilities Management Plan (Final Plan Needed) An additional condition is that a final, written pocket wetland management plan (including a signed and notarized Operation and Maintenance Agreement) shall be approved in writing by this Office before the impacts specified in this Certification occur per Condition No. 6 in GC No. 3404. Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the pocket wetland facilities (as approved by this Office) shall be implemented. The structural pocket wetland facilities and maintenance of the facility as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural pocket wetland facilities (other than maintenance) shall be made without written authorization from the Division of Water Quality. 2. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to-assure compliance for future wetland, water and buffer impact., These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401 /Wetlands, Unit web site at hftp://h2o.enr.state.nc.us/ncwettands. 3. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization within the buffer; wetland or water prior.taany land disturbing activities to ensure compliance with `15A NCAC'2B 33 and GC 3404. -4. No Sediment & Erosion Control Measures -w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate. of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 /Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. These. facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. It is our opinion the device provided meets the conventional criteria for level spreader design. The calculations and design for the seepage structure is to demonstrate we are considering the entire 10-year storm event. It is our opinion, based on the outflow hydragraph provided within the seepage dam calculations, the 10-year event will be released to the buffer at a total rate less than 1 cfs and over a width of 20+ feet. The device provided is not intented to replace diffuse buffer flow, it is intended to provide it. However, should you determine the data provided does not meet the conventional intent of the riparian rules, we will provide you with an appropriately sized nutrient removal device for this area. Please note this would require greater disturbance of existing vegetation. Should you determine this project to require a nutrient removal device we would like to discuss the merits of the device provided outside of the context of this project. We feel it could offer a legimate response to diffuse flow requirements while minimizing disturbance of existing vegetation. On February 4, 2004, Ms. Debbie Edwards of the Wetlands Unit discussed deficiencies of the application with your consultant, Mr. Kevin Martin. On February 13, 2004, the DWQ received additional information addressing the stormwater outfalls located southeast of your proposed road crossing that were of concern within the initial Pre-Construction Notification (PCN) Application review. After review of the new information, the DWQ.still believes that the diffuse flow requirement will not be met according to 15A NCAC 213 .0233(5). The additional information provided details an area with a rock berm that will retain stormwater and release the stormwater from the two-gravel seepage seems at slower velocities. However, the DWQ has determined that this plan will not provide diffuse flow through the riparian buffer. According to 15A NCAC 213 .0233(6), within the "Drainage ditches, roadside ditches and stormwater outfalls through the riparian buffet", these activities "are allowed"; New drainage ditches, roadside ditches and stormwater outfalls provided that a stormwater management facility is installed to control nitrogen and attenuate flow before the conveyance discharges through the riparian buffer is an allowable activity. The proposed rock berm design will not control nitrogen and is not listed as an approved BMP in our stormwater design manual. Therefore, the DWQ again suggests the construction of a bioretention area or a pocket wetland at the site so that stormwater will receive the nutrient removal that is required before concentrating and flowing through the riparian buffer. Please respond within three days of the date of this letter by sending this information to me via e-mail or fax and a follow-up copy in writing. The Express Review Program is a process that requires all parties to participate in a timely manner. In addition, we request written concurrence from the North Carolina Division of Water Quality (NC-DWQ) that the project complies with the 401 Water Quality Certifications associated with NWP 14. A Pre-construction Notification Application (PCN) is attached, as well as an agent authorization form. The site is located in the western portion of the town of Raleigh, specifically southwest of the intersection of Trinity Road (SR 1655) and Reedy Creek Park Road (SR 1775). The site is bordered to the east by Reedy Creek Park Road. The surrounding area is currently undeveloped and in agricultural farm use. Please refer to the attached USGS map, which displays the location of the proposed project. The proposed project consists of impacts resulting from the construction of a 38-lot subdivision that includes one single road crossing. The proposed road crossing will result in permanent impacts to 65 linear feet of intermittent stream channel, 5,630 ft2 of zone 1 buffer and 4,740 ft2 of zone 2 buffer. S&EC performed a detailed delineation on November 27, 2002 at request of the client to minimize impacts. Andrea Wade with USACE was contacted on January 15, 2003 about this site and was given appropriate maps showing our results. Ms. Wade determined that no site meeting was required and that she would accept our determination. Because the Corp concurred with our determination no 401 or 404 permit should be required, however DWQ considered an area to be subject to the Buffers that was not considered jurisdictional so buffer approval is required. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the'requirements for notification (0.10 acre). The proposed subdivision will provide housing for the growing area. The proposed road crossing is necessary to fully access all usable upland areas on-site. Because the applicant has minimized impacts to the maximum extent practicable, S&EC believes further compensatory mitigation should not be required by the USACE, however if mitigation is required, payment to the WRP is proposed. NC-DWQ's current policy requires written concurrence for perennial stream impacts of greater or equal to 150 linear feet of stream length per project. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 14. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. Because impacts to wetlands and channels are below the thresholds for mitigation, we do not believe that wetland nor stream mitigation should be required by NC-DWQ. Please also note that following construction the site will contain 22.6% impervious surface according to the project engineer (Withers and Ravenel). Because impervious surface will be less than 30% (22.6%), we do not believe that this project requires a pre-approved DWQ stormwater plan. However, the USACE indicated the section of the feature being impacted would not be considered jurisdictional by them. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. S&EC performed a detailed delineation on November 27, 2002 at request of the client to minimize impacts. Andrea Wade with USACE was contacted on January 15, 2003 about this site and was given appropriate maps showing our results. Ms. Wade determined that no site meeting was required and that she would accept our determination. Because the Corp concurred with our determination no 401 or 404 permit should be required, however DWQ considered an area to be subject to the Buffers that was not considered jurisdictional so buffer approval is required. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed subdivision will provide housing for the growing area. The proposed road crossing is necessary to fully access all usable upland areas on-site. Because the applicant has minimized impacts to the maximum extent practicable, S&EC believes further compensatory mitigation should not be required by the USACE, however if mitigation is required, payment to the WRP is proposed. NC-DWQ's current policy requires written concurrence for perennial stream impacts of greater or equal to 150 linear feet of stream length per project. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 14. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. The proposed road crossing will result in permanent impacts to 65 linear feet of intermittent stream channel, 5,630 ft2 of zone 1 buffer and 4,740 ft2 of zone 2 buffer. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. At the reauest of the client, a detailed wetland delineation and stream buffer determination was conducted by Soil and Environmental Consultants on November 18, 2002. This was done prior to project planning in order to avoid and minimize jurisdictional impacts to streams and wetlands Therefore the only impacts are the crossing of a buffered intermittent channel that is Page 9 of 13 needed to access the other half of the property isolated by the pond and the stream feature above it. However, the USACE indicated the section of the feature being impacted would not be considered jurisdictional by them. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. 1.
