Box 216 Hatteras, NC, 27943 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Ms. Robert: You have our approval, in accordance with the attached conditions, to shade 0.034 acres of Public Trust/Estuarine Waters in order to construct a new dockage at the Island Club Grill Dock and Gazebo in Dare County, as described in your application received by the Division of Water Quality on January 15, 2004. No fill in wetlands or water is involved in this work. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change .your project, you must notify us in writing and you may be required to send us a new applicationfor a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and.is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. PROJECT SUMMARY: This project involves the construction of new dockage along the water frontage of an existing restaurant adjacent to the Slash Creek in Hatteras Village, in Dare County. This project also includes the construction of an 800 square feet gazebo directly adjacent to the shoreline of this property. y FIELD INVESTIGATION REPORT: KAREN ROBERT (Island Club Grill Dock & Gazebo) Page 2 Project Setting The application site is located on the east side of NC 12 at the intersection of this highway and the Slash Creek in Hatteras Village. The site is the location of the Island Club Grill, formally the Channel Bass Restaurant. This site is located on the southeast shoreline where the NC 12 Bridge crosses the Slash Creek. According to the North Carolina General Warranty Deed provided with this permit application, this parcel is presently owned by KLR, LLC (Karen Robert of Hatteras Village). The site is level, and according to the application, is approximately 3.5 feet above the Normal Water Level (NWL). Approximately two-thirds the 0.9-acre site is currently covered by impervious surfaces the restaurant and associated parking area. Approximately 2,900 square feet of this area is within the Coastal Shoreline Buffer Area. Approximately 700 square feet of this impervious surface consists of an existing concrete sidewalk. The sidewalk is located between the restaurant building and the bulkhead, and the north side of the building is within 10 feet of the shoreline. The entire shoreline of the property measures over 360 linear feet and is stabilized with a conventional bulkhead structure. The Creek is approximately 120 feet wide at the restaurant/bridge location. The water depths taken during field observation ranged between 3 and 7 feet immediately offshore from the restaurant at NWL. Water depths of the Slash Creek channel are reported by local boaters to be much deeper. Recent scouring from ocean over-wash that occurred during Hurricane Isabel has resulted in greater water depths in portions of Slash Creek. The Slash Creek flows through Hatteras Village and connects to the Pamlico Sound both through Hatteras Harbor (located on the northwest side of the village) and Sandy Bay (located on the northeast side of Hatteras village). The waters of this creek carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in the vicinity of the proposed development are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 feet landward of the NWL. FIELD INVESTIGATION REPORT: KAREN ROBERT (Island Club Grill Dock & Gazebo) Page 3 Project Description This project involves the construction of new dockage along the water frontage of the existing restaurant adjacent to the Slash Creek. The dock will be placed parallel to the shoreline and will be 6 feet in width. The dock will be aligned with an 83 feet section along the bulkhead running in a north-south direction. The dock will commence at the north end of this section and will have a 90- degree turn to the east and a 27.5 feet section along the front of the building and parallel to NC 12. This project also includes the construction of an 800 square feet gazebo adjacent to the 83 feet dock section and will be oriented near the northeast corner of the restaurant building. The gazebo will be 40 feet long and 20 feet wide, and will extend approximately 23 feet beyond the 6 feet wide dock. This will result in the structure extending approximately 29 feet into the Slash Creek waterway. The water depth at the waterward end of the gazebo is approximately 4.5 feet, at NWL. The purpose of the proposed dock and gazebo will be for a waiting area prior to the seating of restaurant clientele. No boat slips are associated with this project. Anticipated Impacts The impact that can be anticipated by this project is associated with the shading of approximately 1,500 square feet of Public Trust Area and Estuarine Waters by the proposed dock and gazebo structures. The proposed dock and gazebo will not extend into the Slash Creek beyond the limit set by the `one-fourth of the width distance' criteria referenced in the Public Trust Use Standards. The proposed development will not extend into any adjacent riparian setback area, and should not interfere with any navigation or public trust uses.
