APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. and Mrs. Johnson:
You have our approval, in accordance with the attached conditions, to place fill in 0.02 acre of coastal wetlands and
estuarine waters in order to construct a bulkhead to stabilize a man-made canal to the Pamlico Sound at Lot 10, 39005
Tarpon Lane, Hatteras Colony Subdivision in Dare County, as described in your application received by the Division of
Water Quality on January 5, 2004. After reviewing your application, we have determined that this fill is covered by General
Water Quality Certification Number 3400, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed,
Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you.change your
project, you must notify us in writing and you may be required to send us .a new application} for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to, protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.

3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
.installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

along the shoreline of a man-made canal to the Pamlico Sound in Hatteras Colony Subdivision,
Avon, Dare County.

Project Setting
The site is located at lot 10, in the Hatteras Colony Subdivision at 39005 Tarpon Lane, in Avon
Village, Dare County. The site consists of a 10,000 square feet lot, with a total of approximately
63 linear feet of shoreline along a man-made canal that connects to the Pamlico Sound. Allen and
Leonora Johnson are the owners of this property, and this property includes a single family
residence with an L platform of 10 feet by 6 feet. The footprint of the existing residential structure
is entirely inside the Estuarine Shoreline AEC, and partially within the Coastal Shoreline 30 feet
Buffer.
This lot has a level grade and has a reported elevation of 3 feet above the Normal Water Level
(NWL). The soils on this lot are sandy with more organic-hydric type soils located directly
adjacent to the shoreline. This lot is vegetated in mostly upland grasses.. The area directly adjacent
to the shoreline is vegetated with an irregular 3 to 6 feet wide Juncus roemerianus coastal wetland
fringe (approximately 350 square feet) that receives occasional flooding from the connecting
waters of the Pamlico Sound. A bulkhead structure is located along the shoreline of the adjacent
lot to the west.
Evidence of shoreline erosion exists along portions of the shoreline of lot 10. Portions of this
shoreline are being undercut and have eroded, resulting in some clumps of existing vegetation
washing off into the canal. Some evidence exists that some erosion has occurred behind the return
walls of the adjacent bulkhead structure. The application states that 2 feet of erosion have
occurred on this lot along this shoreline within the last year. The rear house pilings are within 10
feet of the erosion escarpment.
The canal width is approximately 100 feet. The water depth at this site, at a distance of 3 feet
offshore, is less than one foot. The canal bottom consists predominately of sand with little organic
material. No significant areas of submerged aquatic vegetation were observed along the shoreline
during the application site visit. The waters of this canal carry the same water classification as the
Pamlico Sound. The North Carolina Environmental Management Commission has designated these
waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in
this vicinity are closed to the commercial harvest of shellfish. During the site investigation visits,
no shellfish were observed along the water bottom in the vicinity of this project. Some juvenile
finfish were observed along the shoreline.
The Coastal Resources Commission (CRC) has also designated these waters as Public Trust Area
and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the rules of the
CRC, the Coastal Shoreline AEC extends in a contour 75 feet landward of the NWL. The CRC
has also designated coastal wetland vegetated areas, like the one described above, as a Coastal
Wetland AEC. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify
the waters of the Pamlico Sound as Coastal Waters.

Project Description
The applicant proposes to stabilize the shoreline of lot 10 with a wood bulkhead, and tie this
structure into the existing bulkhead structure on the adjacent lot to the west. Two 12-feet long
return walls will be installed at the intersections with lots 11 and 9. The applicants have requested
to align the western side of the proposed bulkhead with the neighboring bulkhead on lot 9. The
proposed bulkhead alignment could extend waterward an average of 3 feet beyond the NWL. This
proposed alignment could also result in a bulkhead alignment that could extend a maximum
distance waterward of 7 feet beyond the NWL in some sections where more erosion has taken
place. The proposed bulkhead could be constructed of treated wood and the tieback area could be
backfilled with sand from an off-site source. This bulkhead alignment could result in the
placement of approximately 26 cubic yards of fill material below the NWL, and could allow an
approximately 3 feet wide wetland fringe to remain, waterward of the bulkhead alignment. The
applicants intend to maintain the existing dock at or near its present location. This proposal does
not include any maintenance excavation of the adjacent canal bottom areas beyond the bulkhead
alignment.
Anticipated Impacts
The proposed bulkhead alignment will result in the filling of approximately 175 square feet of
Shallow Water Habitat/Estuarine Waters, as well as the filling and associated loss of
approximately the same area of coastal wetland fringe habitat within and adjacent to these Public
Trust Area and Estuarine Waters. The overall land disturbance within the Coastal Shoreline,
associated with the tieback area, will be approximately 700 square feet. The bulkhead structure,
backfill, tieback and grading activity associated with the bulkhead installation will result in a total
of approximately 875 square feet of land and water disturbance (or displacement) within the
Estuarine System.
An inspection of mapping data on cultural resources revealed that no archaeological or cultural
resource findings had been recorded on the available maps in the immediate vicinity of this
project. However, these maps have not been updated in at least 10 years and the potential for the
existence of cultural or historical resources is possible.
The proposed shoreline stabilization structure and filling activity will result in an increase in
turbidity levels, at least temporarily, along this portion of this waterway. The placement of a
bulkhead structure may result in alteration of the shallow water habitat bottom adjacent to the
existing shoreline. The proposed structure will reduce the erosion of the shoreline of this lot and
in turn, reduce the long-term turbidity associated with unstabilized shorelines. This structure's
alignment location initially will allow approximately one-half of the existing coastal wetland fringe
to remain. Although it is possible that the bulkhead may eventually result in the total loss of the

remaining wetland fringe, several other properties with similar bulkhead alignments have co-
existed with remaining wetland fringes that appear to be stable and provide some habitat and other
coastal resource benefits.
It is noted that this proposed structure will not connect to the adjacent bulkhead structure to the
east of lot 10. The shoreline of this adjacent lot has a slightly wider coastal wetland fringe and the
lot is not developed. It is likely that some refracted wave energy from the adjacent (proposed)
bulkhead may result in some accelerated erosion of this fringe near the return wall area. The
proposed structure and its construction will not interfere with any riparian access or public trust
concerns along this canal, and this proposal does not include any maintenance excavation of the
adjacent canal water bottom.
