APPROVAL of 401 Water Quality Certification with Additional Conditions
To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to shade 0.005 acre of Public Trust Waters in
order to construct a multi-use trail with a wood bridge along the Dismal Swamp Canal in Camden County, as described in
your application received by the Division of Water Quality on January 5, 2004. No fill in wetlands or water is involved in this
work. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification
Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetiands . This Certification
allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also
this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you.must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.

3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources: has released the project;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

PROJECT SETTING
Camden County has been awarded a grant from the North Carolina Department of Transportation's (DOT) TEA-
21 Program to construct a 4.5 mile long multi-use path within DOT's right-of-way. The proposed path originates
at the Dismal Swamp Canal Welcome Center located west of US 17 and terminates in the village of South Mills.
A vegetated area lying between US Highway (HWY) 17 and the canal will be cleared and graded to create the
northernmost 3 miles of trail. Existing pavement along NC 343 and along Mullen Drive will be widened by 4
feet on each side to create the remaining 1.5 miles.
The waters of the Dismal Swamp Canal in the vicinity of the project are classified as WS-IVSW by the NC
Environmental Management Commission. These waters are classified as Inland Waters by. the NC Marine
Fisheries Commission and NC Wildlife Resources Commission and as Public Trust Waters by the NC Coastal
Resources Commission. Water depths in the project area (within a 16 feet wide slough) measure 1 foot to 2 feet
below NWL.
The presence of submerged aquatic vegetation was not noted within the project area. Review of available
information suggests that there are no known archeological sites or geologic formations associated with the
project. However, the canal has been placed in the National Register of Historic Places and is designated a
National Civil Engineering Landmark, having been dug between the years 1793-1805. There is the potential for
the discovery of historic and archeological artifacts during land disturbing activity.
PROJECT DESCRIPTION
The project has been designed, to the maximum extent feasible, to avoid development within the 30 feet buffer
[Public Trust Shoreline Area of Environmental Concern (AEC)]. The northern portion of the proposed trail
extends 3 miles from NC DOT's Welcome Center off US 17 to the US 17/NC Highway 343 intersection. In this
segment, 10 feet wide impervious asphalt is proposed within a 20 feet wide vegetated area lying between the
south-bound lanes of HWY 17 and the canal. Wherever possible, 5 feet wide shoulders are proposed; however,
clearing activities will be limited where the asphalt trail abuts the buffer. In those locations, clearing will be
limited to the removal of overhanging brush and trees likely to impede traffic flow. Four hundred (400) square
feet of impervious asphalt are proposed within the Public Trust Shoreline AEC located 1.1 miles south of the
Welcome Center. At this location, a 16 feet wide slough with water depths ranging 1.0 foot to 2.0 feet juts off
the eastern side of the canal. In order to span the slough's navigable waters, a 14 feet by 41 feet pre-fabricated
bridge with 11 feet of vertical clearance is proposed.
At five locations, the 10 feet asphalt trail changes directions and crosses either an existing drainage swale and/or
an existing drainage culvert. At these locations, new culverts and/or culvert extensions are proposed.
The remaining 1.5 miles of the path consist of 4 feet pavement extensions of the north and south-bound lanes of
NC HWY 343 and Mullen Drive. The southern terminus of the trail is proposed in a graveled parking area
located just north of the South Mills Bridge.

ANTICIPATED IMPACTS
• The 10 feet wide paved approaches to the pre-fabricated bridge will result in the placement of 400 square
feet of impervious coverage within the Public Trust Shoreline AEC (30 feet buffer).
• The 14 feet wide by 41 feet long bridge will shade 224 square feet of Public Trust Waters/Fresh Water
Habitat.
• The construction of the 10 feet wide asphalt path and 4 feet wide pavement extensions will cover 222,000
square feet of High Ground.
• The clearing of a 20 feet wide access way and the installation of culverts and/or culvert extensions will
disturb approximately 317,000 square feet of high ground.

Dear Mr. Harrell:
Enclosed please fmd a detail of the proposed bridge location. It provides the requested
clarification and delineates the AEC as it relates to the ditch and bridge. From this drawing the
impervious surface associated with the bike path in this location is 400 sq. ft ( the bridge is
planked ). Since the bridge terminates 10 feet outside the top of banks, the sedimentation/erosion
control measures stipulated in the plans will mitigate any impact to the surface water.
Furthermore I would like to clarify that the bike path route in general is designed to stay out of
the AEC completely. This includes clearing. The route will follow a "natural" contour and avoid
large trees or other features deemed aesthetically significant. In the event that the impervious
surface of the path falls adjacent to the AEC, the only clearing in the AEC will be removal of
branches or brush to allow unimpeded traffic flow.

PROJECT DESCRIPTION:
The purpose of this project is to construct a 4.5 mile asphalt bike path originating at the
Dismal Swamp Canal Welcome Center and terminating along Mullen Drive in the
Village of South Mills. Construction will consist of clearing and grading 11 acres of land
consisting of a 20 foot wide corridor through the vegetated area between US-17 and the
Dismal Swamp Canal for approximately 3 miles- Care will be taken to insure that the
path is just beyond the 30 foot required buffer between respective edge of pavements
while simultaneously insuring that the impervious surface does come within 30 feet of
the edge of the canal. Upon reaching NC HWY 343, the constructed bike path will take
the form of 5 foot pavement extensions along either side of the road. This method of
pavement extension will be repeated on the last leg of the bike path as NC HWY 343
intersects Mullen Drive. These 5 foot pavement extensions constitute the remaining 1.5
miles of the path.
SITE DESCRIPTION:
The project is located between the historic and scenic Dismal Swamp Canal and U.S.
Highway 17 from the Dismal Swamp Canal Welcome Center to the historic Village of
S-outh-Il lls-in Camden County. Camden County is designated a Tier 1 County by the
North Carolina Department of Commerce and is located in NCDOT Eastern Region 3,
Division 1. The 4.5 mile path will be an asphalt surface of 10 feet in width with 5 foot
cleared grassy shoulders on either side through the vegetated area between U.S. Highway
17 and the Dismal Swamp Canal resulting in 158,400 SF of new impervious surface. The
remaining 1.5 miles of construction along NC HWY 343 and Mullen Drive will be in the
form of 5 foot pavement extensions along either side of the respective roads as well as 5
feet of grassy shoulder adjoining the existing respective vegetated swales thus generating
79,200 SF of new impervious surface respectively. The swales along these roads will be
modified and stabilized to accommodate the pavements extensions as needed Total area
of disturbance for this project is approximately 11 acres.
CONSTRUCTION:
During construction, until a noted growth of grass is established, the following
procedures shall be implemented:
• All seeding operations shall commence within 15 days of disturbance and grass
established within 30 days.
• All disturbed ditches will be stabilized with jute matting after seeding
