Wake County
On 12 January 2004, 1 visited the site at Capital Blvd and Oak Forest Road as described
in your application dated January 5, 2004 in order to make a determination whether the channel
in the center of the property as well as the one at the corner of Oak Forest Road and Capital
Blvd are subject to the Neuse River Riparian Buffer rules (15A NCAC 2B .0233). Based on this
site visit, the channel in the center of the property is subject to the Neuse River Buffer rules from
the pipe that exits under the parking lot to the culvert under Capital Blvd. The channel at the
intersection of Oak Forest Road and Capital Blvd that is shown on the Wake County Soil Survey
is not subject to the Neuse River Buffer rules since it has been culverted for years.
In a related manner, it is likely that DWQ would approve a crossing of the upper end of
the subject stream channel since the re-development plans for the property would result in a
need to relocate the internal road network on the property. As discussed, as long as there is no
net increase in impervious surface on the property after road construction, then on-site
stormwater management will not be required by DWQ.
