The primary information used to generate this list is the known or expected range of each species. Additional areas of inuence (AOI) for species are also considered. An AOI includes areas outside of the species range if the species could be indirectly aected by activities in that area (e.g., placing a dam upstream of a sh population, even if that sh does not occur at the dam site, may indirectly impact the species by reducing or eliminating water ow downstream). Because species can move, and site conditions can change, the species on this list are not guaranteed to be found on or near the project area. To fully determine any potential eects to species, additional site-specic and project-specic information is often required. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. Some deepwater reef communities (coral or tubercid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery. The proposed project will consist of four soccer fields, a restroom, shelter structure, an access road connected to Hoover Road, stormwater control measures, and underground utilities (i.e. water and gravity sanitary sewer). Project construction will include site clearing and grading, utility installation, and site development. The approximately 50.2-acres project area is located within the city of Durham, North Carolina, within Durham County. The project area of potential effects (APE) is bound by residential homes, commercial development, and Cheek Road to the north. To the east, the APE is bound by commercial development and Junction Road. To the south, the APE is bound by a forested upland area, commercial development, and Junction Road. To the west, the APE is bound by US 70 Bypass and commercial development. The project area is mainly comprised of forested areas with the central portion of the property having been clear-cut within the last 5 years. There are multiple stream and wetland features throughout the APE along the sewer easement and drainages (Figure 1). A Timmons Group Secretary of Interior qualified archaeologist conducted a review of the cultural resources database at the North Carolina Office of State Archeology (OSA) on June 3, 2019. Research at the OSA indicated that no previous archaeological surveys have been conducted in the APE or within a one-mile radius. Research further indicated that a single archaeological site has previously been identified within one mile of the APE. That site (DH586) is described as a prehistoric lithic scatter outside of the current project APE that is not recommend eligible for listing in the National Register of Historic Places (NRHP). Seven historic structures (Table 1) have been recorded within one mile of the project area. None of these previously recorded structures are within the current direct APE and none have been evaluated for listing on the NRHP. The USGS Web Soil Survey (accessed 06/13/2019) defines most soils in the APE as hydric, or frequently saturated. Although the current project area has never been surveyed for the presence of cultural resources, these types of soils are not considered sensitive for the preservation of archaeological remains. However, given the proximity of known historic sites, as well as the presence of a nearby archaeological site, the possibility remains that intact archaeological deposits could be present. As a result, the SHPO may choose to recommend further archaeological studies within the APE as it is currently defined.
