Facility Description: This permit was requested in the event that excavation activities during the
restoration of Carolina Theatre lead to contact with contaminated groundwater. Groundwater samples in
2006 and 2007 showed VOC contamination above NC groundwater standards. Samples in June 2018
indicated VOC concentrations have fallen below standards. If contaminated groundwater is encountered, it
will be treated and discharged to storm water system, which discharges to UT Irwin Creek.

RPA: Reasonable Potential Analysis (RPA) - RPA was not conducted because there is no database to date
other than untreated groundwater samples collected sporadically during initial site assessment(s).

Stream and Outfall 001: The facility discharges via Outfall 001 to an unnamed tributary (UT) to Irwin
Creek. The unnamed tributary is under zero flow conditions before it reaches Irwin Creek. For purposes
of effluent limitations, a 7Q 10 of zero and an instream waste concentration (IWC) of 100% will apply.
The UT discharges to Irwin Creek segment [11-137-1] which is currently listed as impaired for Copper,
Lead, Zinc and in the 2014 Integrated Report 305(b) [see attached].
Please see map attached to draft permit for coordinates for Outfall 001, stream information and facility
location.
Frequency of Discharge
Contacted Joe Nestor with ECS to discuss what the expected frequency of discharge would be. He was
unable to confidently advise, due to the nature of the project. The construction involves 35 ft of excavation,
bringing construction to 5 ft below water table, where water is encountered somewhat unpredictably. This
should take place in April and will be fairly short-term. Joe also mentioned that during early construction,
more water than anticipated has already been encountered, and it is highly contaminated to a degree
inconsistent with the initial assessment.
Based on this information, a sampling frequency of 2x/week has been put in place for most parameters.
Permit Parameters of Concern: temporary dewatering and groundwater remediation system for during
construction
Flow (MGD) — Flow is limited as the design flow of 0.029 MGD.
Total Suspended Solids (TSS) — TSS limits of 30 mg/L Monthly Average and 45 mg/L Daily
Maximum [per 40 CFR 133.102] are deemed general indicators of effluent quality for these
facilities, and are hereby recommended as a minimum for effluent management. US EPA requires
both a Monthly Average and a Daily Maximum for all parameters limited [40 CFR 122.45 (d.)].
Turbidity — Groundwater facilities have potential to discharge turbid effluents. Considering that
North Carolina has established standards for Turbidity in accord with receiving -stream
classification, monitoring and permit limits are deemed appropriate to evaluate effluent compliance
for freshwater [NCAC 02B. 0211(21)]. Turbidity monitoring was added.
pH — The accordance with 15A NCAC 02B .0211 (14), .0218 and .0219, shall be normal for the
waters in the area, which range between 6.0 and 9.0. Effluent monitoring "Per Batch" is applied to
this parameter to document contaminant "break -through" of the carbon -filter.
Oil & Grease (O&G) — O&G monitoring is added as monitoring only.
Volatile Organic Compounds (VOCs) and Semi -Volatile Organic Compounds (Semi-VOC) —
Historical groundwater monitoring data provided in the application indicated the presence of the
following VOC compounds listed below at detectable levels in untreated groundwater (Semi-VOCs
were not detected)*:

North Carolina 15A NCAC 02B Surface Water Standards and Protective Values & EPA Nationally
Recommended Water Quality Criteria that apply to these VOCs are listed in the attached
spreadsheet. Since Irwin Creek is currently classified as C waters both fresh water aquatic (FW)
and human health (HH) standards apply for these VOC parameters. The most stringent standard
will be used for the permit limit. Since the facility discharges to an unnamed tributary to Irwin
Creek with zero flow conditions the water quality standards apply without dilution. The applicable
standard applies at the point of discharge at Outfall 001 and is given as both the daily maximum
and monthly average limit in the permit [see permit Part I, Section A. (1.)].
Total Copper, Lead, Zinc and Hardness — Outfall 001 discharges to an unnamed tributary to
Irwin Creek segment [11-137-1], which is currently listed as impaired for Copper, Lead, Zinc and
in the 2016 Integrated Report 303(d) [see attached]. Quarterly monitoring for Total Copper, Lead,
Zinc and Hardness have been added to the effluent page for this permit to establish a database.
Effluent hardness sampling and instream hardness sampling, upstream of the discharge, is being
inserted into all permits with facilities monitoring for hardness -dependent metals to build a more
robust hardness dataset. This permit only requires effluent hardness samples because of the zero
flow conditions of the unnamed tributary to Irwin Creek. A Total Hardness default value of 25
mg/L is applied for streams with zero flow conditions.
WET Testing —
For temporary dewatering and groundwater remediation system for during construction:
Whole Effluent Toxicity (WET) - Acute, Monitor Only; Monthly (Pimephales promelas) 48-hour
static test. [See Section A. (3)]. Acute toxicity (monitoring only) is recommended because the final
effluent is to be polished with activated carbon, historically rendering effluent too clean to prevent
WET -test failure.
EAA summary:
1. Connect to WWTP — City of Charlotte prohibits discharge of groundwater to POTW
2. Land application — parcel of land is only 95 feet wide (0.434 acres). Neighboring properties are
valued at $5 Million +, not considering demolition costs.
3. Wastewater reuse —Not practical given duration of project (<I month)
4. No viable combinations of aforementioned alternatives
Surface water discharge — opinon of ECS that this is the only viable option given the short
duration of the project, costs of alternatives, and prohibitions to other discharge options. ECS
knows of similar dewatering projects in area that have been approved (NC0088371,
NC0089443, NC0089656).

There is an existing 2-inch diameter PVC pipe that enters the storm drain from a dis-used irrigation vault that should be capped to
prevent unnecessary discharge from entering into the storm drain.
On December 20, 2018 MRO staff performed a technical assistance site visit for permit application NC0089842, Carolina Theatre.
MRO staff met with ECS Limited Staff, Joe Nestor and Chris Orrell, and Mr. Richard Grubbs of Carolina Theatre.
The primary purpose of this permit is to cover a temporary dewatering system to be used during construction where the groundwater is
impacted by chlorinated solvents. The City of Charlotte/Charlotte Water does not allow the discharge of groundwater remediation
system effluent into their collection system and WWTPs. The proposed system is designed to be operated sporadically with discharge
to an established storm drain outfall. Treatment of the water appears to meet requirements to reduce the pollutants, though the most
recent data does not note exceedances of those constituents. The storm drain outfall leads to an impaired stream (Irwin Creek).
Due to the irregularly occurring flow, it is recommended that chronic toxicity sampling be tied to periods when discharge actually
occurs and that the permittee provide additional information about the quantity and frequency of the flow when the operation is put in
place.

Operators Certification Commission is required to classify all water pollution control systems.
Upon review of the subject permit the Water Pollution Control System Operators Certification
Commission has determined that the subject facility is classified as follows:
• Grade I Physical Chemical Water Pollution Control Treatment System (PC -I)
[per 15A NCAC 08G .0306(a)]
As required by 15A NCAC 8G .0201 and your permit, you must designate a Grade I or higher Physical
Chemical Treatment System Operator in Responsible Charge (ORC) and a Back-up Operator with at least a
Grade I Biological Treatment System certification. Please complete and return an ORC Designation Form

This email is intended to document that the pipe in the stormwater drop basin on Tryon Street
adjacent to the referenced project site has been capped. You requested that the pipe be capped
during a site visit on December 20, 2018. Capping of the pipe is also a condition for issuance of the
NPDES permit for this site as indicated by the cover letter for the draft permit dated March 6, 2019.
The attached photograph shows the cap on the pipe in the drop basin.

municipality responsible for the sewer.
➢ A list of any chemicals found in detectable amounts at the site, with the maximum observed
concentration reported for each chemical (the most recent sample must be collected less
than one year prior to the date of this application)
➢ For petroleum -contaminated sites - Analyses for Volatile Organic Compounds (VOC) should
be performed. Analyses for any fuel additives likely to be present at the site and for phenol
and lead should also be performed.
➢ For sites contaminated with solvents or other contaminants - EPA Method 624/625
analysis should be performed.

Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable
by a fine not to exceed $25,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section
1001 provides a punishment by a fine of not more than $25,000 or imprisonment not more than 5 years, or both,
for a similar offense.)
