Upon review of your request for 401 Water Quality
Certification to place fill material in 0.25 acres of wetlands
for dam and lake construction located at Silver Springs Section
of Wade Hampton Club, in Jackson County, we have determined that
the proposed fill can be covered by General Water Quality
Certification No. 2671 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.

SUBJECT: A review of an application by A. William McKee for Wade
Hampton Company to construct a dam and create a lake on
an unnamed tributary to Silver Run Creek, Jonathan
Valley, Jackson County.
The N.C. Wildlife Resources Commission (NCWRC) has reviewed
the information provided by Mr. B. Dan Marks of S&ME for Wade
Hampton Company and biologists on our staff are familiar with
habitat values of the project area. An onsite investigation was
conducted on September 15, 1992 to further. assesses potential
construction impacts on wildlife and fisheries resources. These
comments are provided in accordance with provisions of the Clean
Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d.).
The applicant proposes to fill 0.10 acres of stream and
associated wetlands to create a dam. The flooded area that will
be created will cover 0.15 acres of stream and associated
wetland. The dam will include a cold water release to protect
downstream resources.
Silver Run Creek downstream of this project is Designated
Public Mountain Trout Water (DPMTW) and is managed as a Wild
Trout stream. This means that the trout fishery depends on
instream reproduction. This stream offers excellent habitat for
trout as well as other fish species. Fish were not present at
the project site since the stream is to small to support fish.
No federal or state listed threatened or endangered species are
know to be present at this site.
