Response to your questions:
1. There will be no trees equal too or greater than 3" removed in zone 1.
2. The path will be a 3 foot wide mulched walkway with a landscape timber border on each side. It will cross the 50 foot
zone 1&2 width and connect to a future dock walkway at the Duke Energy elevation boundary with Zone 1.

On May 2, 2019, the Division of Water Resources (Division) received an application dated April 30, 2019.
The Division has determined that your application is incomplete and cannot be processed. The
application is on hold until all of the following items are addressed:
1. Please clarify if trees greater than 3 inches in diameter at breast height (DBH) will be removed
from Zone 1 of the Catawba River Buffer for the construction of the gazebo. Any trees greater
than or equal to 3 inches in DBH that are removed must be replaced using at least 2 species of
native hardwood trees.
2. Please clarify the materials and extent (width x length) of the pedestrian access trail (shown on
map provided in your application) through Zone 1 and Zone 2 of the Catawba River Buffer.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please provide a response by July 10, 2019.
