PROJECT DESCRIPTION Cavenaugh and Associates, P.A., representing Leisure Investments of North Carolina Inc., has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located along Caswell Beach Road, in Caswell Beach, Brunswick County. To find the property, take Highway 17 south from Wilmington and turn left on N.C. State Highway 87. Head south on Hwy 87 and continue towards Oak Island. Once over the high-rise bridge, continue through the stoplight. The road will become Caswell Beach Road and the property will be located approximately''/z-1 mile from the intersection of Caswell Beach Road and Beach Road, on the left hand side of the road, across from Oak Island Beach Villas. The property is bordered by residential properties and the Atlantic Ocean. The site is currently developed and operates as the Oak Island Golf Course. The site currently contains an 18-hole golf course, including a clubhouse, asphalt parking lot, driveways, stormwater system, swimming pool, concrete wall, irrigation pond, and utilities. According to the application package, the site ranges in elevation from 8' to 27' above Mean Sea Level. Vegetation on the tract consists of Live Oak, Long Leaf Pine, lawn grasses and ornamental landscaping. Oceanfront, or dune vegetation, consist of American Beach Grass and Sea Oats. The site is located within the Ocean Erodible Area and the High Hazard Flood Area of Environmental Concern (AEC). The waters of the Atlantic Ocean, adjacent to the project site, are classified as SB by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. The subject property is located within the Ocean Hazard and High Hazard Flood Area of Environmental Concern (AEC), as indicated by Zone VE (elevation 15) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. The long-term average annual erosion rate in the vicinity of the property ranges from 5.0 to 5.5 feet per year. The 100-year storm recession line for this area of Oak Island is 300 feet creating a total Ocean Erodible Area (OEA) of 600 and 630 feet, respectively. PROPOSED PROJECT: The applicant proposes to construct fifteen (15) buildings, providing thirty-five (35) single-family condominium units, five single-family lots, parking areas, driveways, utilities, stormwater collection system and retaining wall. Prior to construction, the applicant proposed to remove the existing parking area located adjacent to Caswell Beach Road, and the existing concrete wall, located just north of the parking area (see Sheet 2 for details). In addition to the removal of the parking areas and wall, the applicant proposes to remove and/or transplant numerous trees located on the southern portion ofthe property (see Sheet 2 for details). Beginning along Caswell Beach Road, the applicant proposes to improve the existing horseshoe shaped driveway by adding additional parking spaces for residents of the proposed units and patrons of the golf course. Seventeen (17) additional spaces would be added to the existing parking area along the eastern entrance. The new parking spaces would be separated from the existing parking area by the installation of 2' x 2' "geoweb" pavers. Just north and east of the proposed parking area (eastern entrance parking), the applicant proposes to install sixteen (16) additional parking spaces. This parking area would tie into another new parking area located north of the existing clubhouse, via an asphalt drive. The horseshoe drive would circle towards the west and provide access to additional parking areas as well as the proposed condominium complex. Entrance/exit to the condominium complex would be provided by a single two-way drive (approximately 13' in width) that would circle the interior units. In order to meet the 5,000 square foot structure limitation, ocean ward of the Ocean Hazard Large Structure setback, the entrance/exit drive would be broken and separated from the parking areas beneath the units located on the ocean side of the driveway by a two-foot wide strip of "honeycomb or geoweb" concrete pavers. Page Three In order to retain the fill, and to keep the entrance/exit drive on grade, the applicant proposes to install a retaining wall along the western portion of the property, immediately adjacent to the entrance/exit drive (between the circle drive and Yaupon Way). The retaining wall would be approximately 90' in length and built to a height of approximately 4' to 5' above grade (see diagram on Sheet 23). The applicant proposes to construct a total of fifteen (15) buildings, providing approximately 30 condominium units and five (5) single-family lots. Five of the fifteen condominium buildings (labeled on the workplan drawings as "Building Type A") would be constructed along the southern side of the entrance/exit drive between the entrance/exit drive and Caswell Beach Road. As proposed, two of these buildings would be separated by the 255' and 270' Large Structure setback line. As such, the applicant has modified each of the buildings by reducing the amount of square footage (total area not to exceed 5,000 square feet) to meet the small structure setback criteria. Each of these units would have two uncovered and open decks, located on both the north and south facing sides. Please refer to the attached workplan drawings labeled as Sheets Al through A4 of 7, for complete details of the proposed units labeled as "Building Type 4-3BR and Type 4-4BR". In the center of the entrance/exit, north of the "Type A Buildings", the applicant proposes to construct four additional condominium buildings, labeled as "Building Type B". Lastly, the applicant proposes to construct six buildings, labeled as "Building Type C and Type D" along the northern side of the entrance/exit drive. Each of the proposed buildings would be structurally independent from one another, and they would be three stories tall, with two habitable floors. Additionally, each building would be less than 5,000 square feet. Parking for each of the units would be located beneath the buildings themselves, as well as around the perimeter of the entrance/exit drive. Just north of the "C & D Buildings", the applicant plans to excavate a 410' x 50' x -7' area of high ground for the proposed stormwater treatment system. According to the applicant's agent, existing topographic features at the site allow for the construction of the proposed "dry" retention pond. The applicant indicates that all high ground material removed form the pond would remain on site and would be used to level the grade around the proposed parking areas, driveway and buildings. Lastly, the applicant wishes to construct five single-family residential lots along the eastern side of Yaupon Way. Construction would consist of driveways and utilities and no actual house construction would be proposed as part of this permit package. Entrance to each of the five lots would be provided by access from Yaupon Way. If necessary, each lot owner would be required to obtain his/her own individual CAMA Minor/Major permit, from the Division of Coastal Management, prior to the initiation of construction. As proposed, no structures would be located ocean ward of the 150' and 165' Small Structure setback. At its closest point, the project measures approximately 185' landward of the First Line of Natural Stable vegetation, which was field located by Division of Coastal Management staff on 1/17/07. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 10.0 acres of high ground. Please note the applicant is aware that the dwellings to be constructed on the single family lots will need individual CAMA Permits prior to construction. This application is strictly for the condominium units and the single family lots with no structures. The site is located in the Town of Caswell Beach directly to the north of Caswell Beach Road (aka SR 1100) and will be developed as part of an existing golf course. The site is bordered to the south by the aforementioned Caswell Beach Road, to the west by Yaupon Way (aka Oak Island Drive) and the Town of Oak Island beyond. To the east and the north are the remains of the associated golf course to which the proposed residential development will be an integral part. Zoning: The project lies within the Ocean Hazard Area of Environmental Concern (AEC) given its proximity to the coast line and will require a NC Division of Coastal Management (DCM) Major Permit as identified within the Coastal Area Management Act (CAMA) Regulations. There are associated setback requirements for permanent structures in conjunction with the associated CAMA erosion zone as identified. Please note the setback line is measured from the first line of stable vegetation which was field verified by the DCM. It is important to note the site from is located within an accepted planned use within the Town's guidelines given the rezoning of the project area through efforts over the years by various property owners and associates. ACCPSS' The five (5) single family lots propose direct access to Yaupon Road (aka Oak Island Drive) and our office foresees no potential problems with tying into this road given the limited traffic which will be generated from the above units. Review of this access should fall under formal site plan review by the Town and its associated professionals. The remaining units, which constitute the condos, will have access to Caswell Beach Road (aka SR 1100) by way of a single two-way access driveway. A permit will be required for work within the right-of-way and for the driveway connection, which will fall under jurisdiction of the state through the NCDOT. Based on prior. experience, a Traffic Impact Analysis maybe required which identifies and clarifies to the State the limited traffic which the condos will generate. Nonetheless during peak hours the traffic may warrant a designated left-hand turn lane into the development on the eastbound side (center lane) in order to accommodate the development which will be driven by the State's review of the project. ..
