As far as requiring a permit, The DWQ always retains the authority to require an individual certification for activities which the Director deems necessary. c~ This cleanup has been far too long in the process and Vista is not showing good faith efforts in that they continue to build roads and houses in a subdivision that is a violation site. I have no issue with the removal of sediment form the Gellar's pond as long as the actoivity does not contrivene stream standards. Additionally, and sources of sediment which have not been stabilized must be stabilized asap. I believe the issued 401 contained a restoration component which must be complied with as well. Vista should mobilize all available personnel to begi work on, and complete all soil stabilization and stream sediment removal as quickly as possible, without violating any stream standards.
