This is our written notification for the NOD received on our swine farm, as you know on March 15, 2016
we had our irrigation specialist Henry Johnson on our farm doing our spring servicing and check out of
our irrigation pump. We had irrigated on Saturday March 12 and did not have any problems with the
system. Henry serviced the pump and then around 1:00 pm he started the pump and ran it for 12 to 15
minutes, we did not know it but our system had been vandalized on the lower end of our farm the part
that was vandalized was not visible to the eye until the system was in operation (see sheriffs report
attached, also there was vandalism last August to our corn fields on this same farm by four -wheelers) a
stand pipe had been broken off, it discharged thru the field and down thru the woods into Candiff Creek
(legal name but also known as Cundiff Creek). Henry Johnson was been back on our farm on March 17,
2016 and repaired the system, we talked to him about the discharge and he confirmed that the pump
ran for about 12 to 15 minutes and that it would have released 50 gallons a minute, this would result in
approximately 750 gallons of waste being spilled. We took our waste sample to the lab on Friday March
18 to comply with the sample process and this completed everything on the requirements of the permit.
We have thoroughly inspected our system and to ensure we don't have this situation again, we will
make sure that anytime we start the pump someone checks the system to make sure it has not been
vandalized. Please let us know if we need to do anything further to comply, we strive to run our
operation to the best of our ability and regret that this has happened due to someone's immature
actions.

problem was damaged possibly by an A-(U due to the heightthat it was broken at I reviewed the pictures that were taken
by Me Deputy on scene and it does appear thatthiswould be properly damage and notlust a faliurs of the fixture. it Was
reported by Davis that this probably occurred several weeks prior to It being discovered and no evidence is available to
help determine a suspect ortime frame. At this time there are no viable leads or suspects.

This Notice is in response to the reported fish kill that occurred as a result of a March 15, 2016
discharge of animal waste from a vandalized air relief valve located at Cundiff Creek Farm. As
required by Condition Ill. I3.a. of your farm's Animal Waste Management System Permit (permit),
our records document that the Division of Water Resources Winston-Salem Regional Office
(DWR-WSRO) received notification within 30 minutes of your discovery of the discharge. Due to
your exceptionally rapid response, short duration of the spill, and excellent compliance history,
this office has decided to issue a Notice of Deficiency. You will recall that copies of the inspection
report, incident report, and stream sample results were previously provided to Cundiff Creek Farm.
Site Visit Observations:
On March 15, 2016 DWR-WSRO staff documented that the source of the animal waste
discharge was a damaged waste irrigation air relief valve located in solid -set irrigation field #5.
Observations by WSRO, Surry Soil and Water Conservation District, and the Surry County
Sheriffs Office indicate that the valve damage was due to recent vandalism. The discharge was
precipitated by a routine pump test performed by the farm's irrigation company. The discharge
traveled approximately 1000ft. through a dry ditch until flowing into Candiff Creek (class C
waters of the State). From the confluence with Candiff Creek to the site of the fish kill was
another 723ft.
At the time of our investigation, WSRO staff observed that the waste in Candiff Creek had
already flowed downstream of the fish kill site and that the surface water was clear with only a

few of the dead fish remaining on the bank. Onsite measurements document that the upstream
dissolved oxygen (DO) was 9.94mg/L while the downstream DO = 9.52mg/L. The upstream pH
was 7.93 and the downstream pH was 7.98. Laboratory results report that the upstream fecal
coliform was 81 CFU/100ml and 120 CFU/100m1 downstream. At the time of our investigation,
there were no NC stream standard violations.
Violations:
The Division recognizes that the unpermitted discharge was caused by conditions out of your
control. However, the discharge still violates NC General Statute NCGS 143-215.1 (a) which
states in part that "no person shall ... make any outlets into the waters of the State" and Permit
Condition I. 1. which declares that the facility should be operated as a non -discharge system to
prevent the discharge of waste that reaches surface waters.
Required Actions:
1. Please describe, in detail, the cause of the March 15, 2016 discharge. Police reports and
report number(s) and any other observations should also be included.
2. If already completed, the entire waste management system should be inspected and
assessed for any additional vandalism which may have occurred. Any repairs should be
documented.
3. Please respond to our office within thirty (30) days describing the actions you have taken,
or propose to take, to try and prevent possible future vandalism to the waste management
system. Your response should be sent to my attention at the address listed in the footer on
page one.

We have a permitted swine farm that had a release to surface waters (Class C —dry ditch to Candiff Creek) of 750 gallons in
March which resulted in a fish kill of 92 fish. The release originated from a pump test and lasted no more than 12-15
minutes. The release was the result of a vandalized air relief valve on a remote area of the spray field. The resulting fish kill
was observed by a downstream contractor who was working on a stream restoration project on the farm's property. The
test was performed by an irrigation company who was hired by the farm. There was no indication of a problem with the test
or that a release had occurred by those performing the test. Upon being notified there was a problem (within 30 minutes),
the operator found where discharge had occurred and notified S&W. WSROS had staff on -site with S&W within an hour of
the occurrence. The local sheriff's office was notified since there was an indication that the system had been
vandalized. We do have a copy of the police report. The general policy is to issue a NOV in this circumstance, however due
to the vandalism, the short duration and the response of the facility, we would like to consider issuance of a NOD
instead. The facility completed all of their required permit actions related to a discharge without prompting. This facility
has no history of non-compliance and in fact the operator has been nominated for operator of the year as they have been an

Comments :
WSRO received call 1:53pm on 3/1212016 alleging a black, sudsy
and odorous material in Candiff Creek (Class C). Caller contacted
WSRO again at 2:08pm to report fish were now in distress, jumping
and dying and that the stream was on properly owned by Mike and
Everett Johnson. Mike Johnson arrived at 2:30pm. WSRO staff
person, Gary Hudson, was in the county and he and Surry SWCD
staff, Tony Davis, arrived on site 3:00 pm. Discharge occurred from a
damaged pressure relief valve in the irrigation field. Henry Johnson,
irrigation specialist, had serviced system earlier that day and ran
pump 12-15 minutes. Based on calculations, 750 gallons of waste
was discharged. WSRO, Surry SWCD, and Surry County Sheriffs
Office believe damage was due to vandalism (report #16030215).
Waste traveled 1000ft. through wooded terrain until flowing into
stream. Fish kill was observed 723ft. downstream. Event lasted
2-4pm. Approximately 92 fish (2-5") were killed. Kin Hodges,
fisheries biologist for NC Wildlife Resources Commission,
determined that the size, type, and quantity of fish did not warrant
payment to the Commission. Tom Boyd, DWR Public Water, was
also notified. Ms. Rosebrock, WSRO animal waste inspector, arrived
at 5:30pm. Up and downstream samples were sent to DWR lab to
be analyzed for BOD, turbidity, feral coliform, and nutrients. Water
temperature, pH, specific conductance, DO and h saturation were
measured onsite. Photographs were also obtained.
Upstream DO=9.94mg/L; pH=7.93. Downstream DO=9.52mg/L;
pH=7.98. Requirements for discharge response were reviewed with
Everett and Mike Johnson. Five-day report and recent waste analysis
received by WSRO on 3/1812016. Permittee also obtained lagoon
samples per permit requirements.

1-3. WSRO received a telephone call from retired NC Wildlife Resources Commission employee, Joe Mickey, around 1:53pm on
March 15, 2016 regarding a black, sudsy and odorous material in Candiff Creek (Class C waters). Mr. Mickey called the WSRO
again at 2:08pm to report that fish were now in distress and jumping and dying. Mr. Mickey reported that the fish kill was observed
while he was working on a stream restoration project on property owned by Mike and Everett Johnson. After also notifying Mike

WSRO staff person, Gary Hudson was in the area and he and Burry County Soil and Water Conservation staff person, Tony Davis,
arrived on site around 3:00 pm. They determined that a discharge had occurred at Cundiff Creek Farm, a 7650 feeder to finish
permitted swine facility located on Long Dusty Trail (off River Siloam Road) in southern Surry County.
The source of the discharge was a damaged waste irrigation air relief valve (#24) located in solid -set irrigation field #5. Mr.
Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm earlier that afternoon to service the waste
irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750
gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Surry SWCD, as well as the Bury County
Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farm's nearby com fields were
also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office).
The discharge into Candiff Creek occurred from 2:00pm to 4:00pm. Discharge traveled 100011. until flowing into Candiff Creek.
From confluence to fish kill was 723ft. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the
species included (white sucker, rosyside dace, mountain mdbelty dace, and creek and bluehead chubs). Kin Hodges, fisheries
biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead
fish did not warrant payment to the Commission.
Tom Boyd, with the Division of Water Resources' Public Water Section, was also notified of the discharge at approximately

upstream DO=9.94mg/L and the downstream DO=9.52mg/L. Upstream pH=7.93 while downstream pH=7.98.
Ms. Rosebrock reviewed the permit requirements for responding to a discharge with both Everett and Mike Johnson. The five-day
report was received by the WSRO on March 18, 2016. The Johnson's also submitted a copy of their most recent waste analysis
report as required by their permit. Lagoon waste samples were also obtained and taken to Research & Analytical Laboratories,
Inc. as per the permit.

1-3. WSRO received a telephone call from retired NC Wildlife Resources Commission employee, Joe Mickey, around 1:53pm on
March 15, 2016 regarding a black, sudsy and odorous material in Cardiff Creek (Class C waters). Mr. Mickey called the WSRO
again at 2:08pm to report that fish were now in distress and jumping and dying. Mr. Mickey reported that the fish kill was observed
while he was working on a stream restoration project on property owned by Mike and Everett Johnson. After also notifying Mike .
Johnson of the dead fish, Mr. Johnson arrived on site at 230pm.
WSRO staff person, Gary Hudson was in the area and he and Surry County Soil and Water Conservation staff person, Tony Davis,
arrived on site around 3:00 pm. They determined that a discharge had occurred at Cundiff Creek Farm, a 7650 feeder to finish
permitted swine facility located on Long Dusty Trail (off River Siloam Road) in southern Surry County.
The source of the discharge was a damaged waste irrigation air relief valve (#24) located in solid -set irrigation field #5. Mr.
Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm earlier that afternoon to service the waste
irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750
gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Surry SWCD, as well as the Surry County
Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farms nearby com fields were
also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office).
The discharge into Cardiff Creek occurred from 2:OOpm to 4:OOpm. Discharge traveled 1000fl. until Flowing into Cardiff Creek.
From confluence to fish kill was 723ff. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the
species included (while sucker, rosyside dace, mountain redbelty dace, and creek and bluehead chubs). Kin Hodges, fisheries
biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead
fish did not warrant payment to the Commission.
Tom Boyd, with the Division of Water Resources' Public Water Section, was also notified of the discharge at approximately
3:30pm. Mr. Boyd stated that he would notify the downstream water plant operators of the animal waste discharge.

FILTER HAD CAUSED THE WASTE FROM MIKES HOGS TO RUN INTO THE RIVER AFTER SPEAKING AT THE
INCIDENT LOCATIONOF THE RIVER MIKE TOOK ME TO THE PROPERTY ON LONG DUSTY LN TO SHOW ME THE

This is our written notification to comply with our permit that we have on our swine farm, as you know
on March 15, 2016 we had our irrigation specialist Henry Johnson on our farm doing our spring servicing
and check out of our irrigation pump. We had irrigated on Saturday March 12 and did not have any
problems with the system. Henry serviced the pump and then around 1.00 pm he started the pump
and ran it for 12 to 15 minutes, we did not know it but our system had been vandalized on the lower
end of our farm the part that was vandalized was not visible to the eye until the system was in
operation (see sheriff's report attached, also there was vandalism last August to our corn fields on this
same farm by four -wheelers) a stand pipe had been broken off, it discharged thru the field and down
thru the woods into Cundiff Creek (legal name but also known as Cundiff Creek). Henry Johnson has
been back to our farm on March 17, 2016 and repaired the system, we talked to him about the
discharge and he confirmed that the pump ran for about 12 to 1S minutes and that it would have
released 50 gallons a minute, this would result in approximately 750 gallons of waste being spilled. We
will be taking our waste sample to the lab on Friday March 18 to comply with the sample process. To
ensure we don't have this situation again, we will make sure that anytime we start the pump someone
will check the system to make sure it has not been vandalized again. Please let us know if we need to do
anything further to comply, we strive to run our operation to the best of our ability and regret that this
has happened due to someone s immature actions.

Melissa or Gary— My brother Joe just called in a fish kill in Surry County off River Siloam Road on Candiff Creek (he is
working on a stream restoration). Water turned black, sudsy and odorous after lunch. Fish first started jumping then

Pictures 8-10 show dead fish as a result of the discharge. Gary and I counted 92 dead fish from below the
bridge to the farm road ford after the water was starting to clear up around 4 PM (saw white sucker, rosyside
dace, mountain redbelly dace, creek and bluehead chubs). We did see some live fish so it was not a total kill.
Mike Johnston? (landowner) was very cooperative and this spill might have been the result of vandalism or
just an equipment malfunction. Hope your investigation went well and you didn't have to stick around very
long.

Not sure why it did not attach the pictures, the label list said they were there and I did not double check
it. For some reason it would not attach the pictures taken on 3/14/16, the day before the spill, as comparison
pictures. Took me several tries to get them attached, hope they arrived on your end. Computers are such
fun!
I hate that this happened to Mike, he is a good guy who tires to do the correct thing. He has one of the best
managed farms in the county according to Tony. I had no idea the problem was from his hog waste system, I
didn't even know he had hogs. I was just reporting what was real problem that was occurring right before my
eyes. Mike was on top of the problem once he was notified by Tony. I even went with him to track down the
problem area and I followed the run-off creek with pockets of waste sludge to Candiff Creek. I hope the
penalties are not to bad because I'm pretty sure it was an accident, either caused by vandals or equipment
malfunction. I've been on fish kills in the past where the culprit tried to hide the source of the problem. Mike
did no such thing, he was on top of the problem as soon as he found out about it. Mike was really upset about
the spill.
Looks like I'll be seeing Lon and maybe some others from your office on Thursday for Elkin's Creek Day.
I'll try to look after Mike on the trip. Pam's glad Mike is going to look after me!

WHEN I ARRIVED ON SCENE I SPOKE YvTrH THE PROPERTY OWNER MIKE JOHNSON, MIKE EXPLAINED
THAT HIS PROPERTY is EING-USED,FOR A CONSERVATION PROJECT. MIKE HAD RECEIVED A CALL FROWX
FEW WORKERS NEAR CANDISS CREEKVr'HICH RUNS OFF THE YADKIN RIVER AND IS ON MIKES
PROPERTY.THEY ADVISED MIKE OF THE SITUATION WHICH MADE MIKE CHECK HIS PROPERTY AND LOCATE
THE AIR FILTER THE' WORKERS DISCOVERED ROUGHLY 92 DEAD FISH IN THE WATER AND THE WORKERS
CONTACTED THE SOIL AND WATER DEPARTMENT. TONY DAVIS(336-71 D-2140) WAS ALSO ON SCENE, HE
WORKS FOR THE SURRY COUNTY SOIL.AND WATER DEPARTMENT(220 COOPER ST, DOBSON). TONY ADVISED:
THAT HE HAD WORKERS ENROUTE TO THE INCIDENT LOCATION TO TEST THE WATER MIKE AND TONY
ADVISED THAT A AIR FILTER WAS DAMAGED ON MIKES FARM AT 3R3 LONG DUSTY LN. THE DAMAGED AIR
FILTER HAD CAUSED THE WASTE FROM MIKES HOGS TO RUN INTO THE RIVER AFTER SPEAKING AT THE
INCIDENT LOC.ATION'OF THE RIVER, MIKE TOOK ME TO THE PROPERTY ON LONG DUSTY LN TO SHOW ME THE
DAMAGED FILTER I PHOTOGRAPHED THE AIR FILTER MIKE BELIEVES SOMEONEANAS ON HIS PROPERTY
RIDING FOUR WHEELERS WHEN THEY HIT THE AIR FILTER.

Based upon the Compliance and Enforcement Guidance, there should be an NOV because it was a discharge
to water of the state and a fish kill was associated with it. The circumstances can lead you in determining if a
civil penalty enforcement would be warranted or not (perhaps not, based on the information
provided). Because of the discharge and the fish kill we cannot take no action. We can talk about this more —
just give me a call.
I know there is a level of enforcement discretion allowed. If you strongly feel that only an NOD is warranted,
then I would suggested talking to Jon Risgaard before issuing either.
As far as the incident portal, yes. The initial complaint should have been (especially now that a violation has
been found).

Please find attached, copies of the up and downstream samples we obtained on the afternoon of the discharge. You will
note that there were no violations of fecal coliform or turbidity. Additionally, you may recall that there was no violation
of the pH or dissolved oxygen standard either (I measured these on site). Even though there was a fish kill, it was a short,
quick discharge that dissipated quickly. Please let me know if anyone has questions or concerns.

Cundiff Creek Farm Discharge
Jon,
We have a permitted swine farm that had a release to surface waters (Class C — dry ditch to Candiff Creek) of 750 gallons in
March which resulted in a fish kill of 92 fish. The release originated from a pump test and lasted no more than 12-15
minutes. The release was the result of a vandalized air relief valve on a remote area of the spray field. The resulting fish kill
was observed by a downstream contractor who was working on a stream restoration project on the farm's property. The
test was performed by an irrigation company who was hired by the farm. There was no indication of a problem with the test
or that a release had occurred by those performing the test. Upon being notified there was a problem (within 30 minutes),
the operator found where discharge had occurred and notified S&W. WSROS had staff on -site with S&W within an hour of
the occurrence. The local sheriffs office was notified since there was an indication that the system had been
vandalized. We do have a copy of the police report. The general policy is to issue a NOV in this circumstance, however due
to the vandalism, the short duration and the response of the facility, we would like to consider issuance of a NOD
instead. The facility completed all of their required permit actions related to a discharge without prompting. This facility
has no history of non-compliance and in fact the operator has been nominated for operator of the year as they have been an

Please discard all preliminary reports that you have received. The attached are the "final' versions that went into our
databases. Additionally, I just left Everett a voicemail message letting him know that I will have to send an NOV, even
though from all accounts, observations, and reports, the valve damage was caused by vandals. I hated this happened
since Cundiff Creek Farm has had a wonderful compliance history in the 18 years I have known them. They responded
promptly to the discharge, which will be noted in the NOV, and have been very cooperative and have completed
everything thus far that the permit requires in the case of a discharge.

1-3. WSRO received a telephone call from retired NG Wildlife Resources Commission employee, Joe Mickey, around 1:53pm on
March 15, 2016 regarding a black, sudsy and odorous material in Cardiff Creek (Class C waters). Mr. Mickey called the WSRO
again at 2:08pm to report that fish were now in distress and jumping and dying. Mr. Mickey reported that the fish kill was observed
while he was working on a stream restoration project on property owned by Mike and Everett Johnson. After also notifying Mike
Johnson of the dead fish, Mr. Johnson arrived on site at 2:30pm.
WSRO staff person, Gary Hudson was in the area and he and Surry County Soil and Water Conservation staff person, Tony Davis,
arrived on site around 3:00 pm. They determined that a discharge had occurred at Cundiff Creek Farm, a 7650 feeder to finish
permitted swine facility located on Long Dusty Trail (off River Siloam Road) in southern Suny County.
The source of the discharge was a damaged waste irrigation air relief valve (#24) located in solid -set irrigation field #5. Mr.
Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm eadier that afternoon to service the waste
irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750
gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Suny SWCD, as well as the Sury County
Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farn's nearby corn fields were
also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office).
The discharge into Candiff Creek occurred from 2:00pm to 4:00pm. Discharge traveled 1000ft. until flowing into Cardiff Creek.
From confluence to fish kill was 723ft. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the
species included (white sucker, rosyside dace, mountain redbelly dace, and creek and bluehead chubs). Kin Hodges, fisheries
biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead
fish did not warrant payment to the Commission.
Tom Boyd, with the Division of Water Resources' Public Water Section, was also notified of the discharge at approximately
3:30pm. Mr. Boyd stated that he would notify the downstream water plant operators of the animal waste discharge.
Melissa Rosebrock, WSRO animal waste inspector, was currently in Ashe County responding to another complaint and arrived on
the Suny County site at 5:30pm. WSRO staff obtained up and downstream samples that were sent to the Division's laboratory in
Raleigh to be analyzed for BOD, turbidity, fecal coliform, and nutrients. Water temperature, pH, specific conductance, DO and
percent saturation were measured onsite. Several photographs were also taken during and after the discharge event. The
upstream DO=9.94mg/L and the downstream DO=9.52mg/L. Upstream pH=7.93 while downstream pH=7.98.
Ms. Rosebrock reviewed the permit requirements for responding to a discharge with both Everett and Mike Johnson. The five-day
report was received by the WSRO on March 18, 2016. The Johnson's also submitted a copy of their most recent waste analysis
report as required by their permit. Lagoon waste samples were also obtained and taken to Research & Analytical Laboratories,
Inc. as per the permit.

I am writing this letter to ask for an exemption to the requirements of having to do a sludge survey
every year; we completed a sludge survey on 9-15-09 and had an average depth of 1.379 feet on 24
places checked. We still use a product called Pit Remedy in all our houses year round; I think this has
helped with the sludge build up because last year's survey showed 1.379 feet of sludge. For those
reasons, we are asking permission to hold off of doing another sludge survey for five years. If you have

During the Fall or Winter of 2009-2010, a representative of your animal operation informed the
Division of Water Quality (DWQ) Winston-Salem Regional Office that there was inadequate freeboard in
the waste pond(s) or lagoon(s) serving the facility. The Animal Waste Management Permit (Section III. No.
13) states that the "Permittee shall report by telephone to the appropriate Division Regional Office as soon
as possible, but in no case more than twenty-four (24) hours following first knowledge of the... failure to
maintain storage capacity in a lagoon/storage pond greater than or equal to that required in ... this General
Permit." We appreciate the fact that you reported the problem of high waste level as required by your
permit and have worked with our staff to manage the problem once it occurred.
While we recognize the extraordinary weather conditions existing at the time, the lack of adequate
freeboard reported to our office still represents non-compliance with the Certificate of Coverage issued to
your facility. As you are aware, this non-compliance is subject to appropriate enforcement action by DWQ.
The factors that lead to non-compliance, efforts to notify DWQ of the problem, efforts made to resolve the
problem once identified, and efforts proposed to prevent future problems have all been factors in our
decision regarding enforcement. Upon review and consideration of the information submitted and/or
discussed with DWQ staff, the Winston-Salem Regional Office has determined that a Notice of Deficiency
(NOD) is appropriate and that no further compliance/enforcement actions will be taken by the Division for
the high waste levels occurring between October 2009 and March 2010.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
This may include, but is not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and / or more flexible application equipment, and main-

excellence in the field. In 1975, the Commission established the Wilbur E. Long, Jr. Operator of the Year

The WSRO is happy to recognize and nominate Mr. Everett H. Johnson for the "Wilbur
E. Long. Jr. Operator of the Year Award" for 2002 Mr. Johnson is the certified operator for
Cundiff Creek Farm, a feeder -to -finish swine operation with a design capacity of 7.650 hors. Mr.
Johnson is one of the most professional. knowledgeable and pro -active operators I have had the
pleasure to work with. He has a thorough understanding of the animal waste management
regulations and strives to keep abreast of any new policies and waste treatment innovations. He.
along with his brother Mike, runs a top-notch swine operation. both on paper. and in practice.
Mr. Johnson's operation is a wonderful example of how agribusiness and a healthy
environment can not only co -exist, but flourish. In 1998 Mr. Johnson began using Rhytase. a feed
grade enzyme. to increase phosphorous absomtion by the pigs thus reducing the amount of
phosphorous supplied in the diet and excreted for land application In 1999 Mr. Johnson
replace the facilitv's old watering system with new. $9000 water conserving stainless steel bowl
waterers in each of the finishing houses. While this news stem was at his own expense. Mr.
Johnson has also seen a 3540% reduction in total water usage on the farm which means there is
less animal waste to be land -applied, benefiting both the industry and the environment Due to
excellent animal waste management, Mr. Johnson is also able to meet all the conditions of his
General Permit without irrigating on weekends or on holidays. In 1989 Mike and Everett Johnson
were selected as the "1989 Conservation Farm Family" for both Surry County and for the
Northwest Region of North Carolina
Mr. Johnson stays busy off the farm as well He has 23 years of service with Carolina
Farm Credit Agency and is a licensed insurance agent Mr. Johnson also has both commercial
and private pilot licenses.
As a certified animal waste operator. Mr. Johnson's expertise and conscientiousness is
second to none. It is my opinion that Everett H. Johnson is a most deserving recipient of the
Wilbur E. Long Jr Operator of the Year for 2002 Your consideration of him is great

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRY 1, DRY2, DRY3, SLUR 1, SLUR2,
SLD1, and SLD2) and maintained in -the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

Air Ouality Inspection Questions
Please remember that a no check is an indication of compliance and a yes check indicated
a problem or potential problem. This is to keep consistent with the other questions on the
visitation form.

Interpretations to Air Oualitv Questions
Pipes discharging wastes into the lagoon or storage pond must be extended at or
beneath the surface of the lagoon or storage pond to avoid releasing gases from
agitated wastes. Discharges from lift stations are included. Milking parlor
wastewater is excluded.
2. Dead animals must be placed in covered dead box or buried within 24 hours after
knowledge of the death of said domesticated animal according to the methods
approved by the State Veterinarian for disposing of dead domesticated animals G.S.
106401. Refrigeration of dead animals is acceptable temporary storage until they are
picked up for rendering.
3. Evidence of wind drift includes visible residue located on a neighbor's property such
as vegetation, asphalt, roads, building structures, and/or public property such as roads.
4. Intake pipes for effluent removal must be placed in the aerobic layer of liquid
approximately 18 inches below the surface. A floating intake may be used. This may
not be evident, souse best judgement. Facilities using exclusively honey wagons,
will not be affected by this question.
Maintenance problems should include visible items, which prevent operation (i.e.
broken belt(s), missing or broken blade(s), inoperable shutters, etc.) Please use the
comment section to provide information of observed dust buildup or visible dust.
6. Animal feed storage bins storage areas located outside of houses, bams, and milking
parlors must have a temporary or permanent cover. Silage storage areas are not
excluded.
7. Animal flush tanks must either have cover or the pipe extended to the bottom of flush
tank. Either method is sufficient. A properly maintained tarp is acceptable as a cover
if it is effective in reducing odors. Tip tanks are excluded.

Dear Mike A. Johnson:
The Division of Water Quality modified the Swine Waste Operation General Permit originally issued to
this facility on July 28, 1997. In accordance with the issuance of the revised General Permit, we are
forwarding this Certificate of Coverage (COC) to Mike A. Johnson, authorizing the operation of the
subject animal waste collection, treatment, storage and land application system in accordance with
General Permit AWG100000. This approval shall consist of the operation of this system including, but
not limited to, the management of animal waste from the Mike A. Johnson Farm, located in Surry
County, with an animal capacity of no greater than 7650 Feeder to Finish and the application to land as
specified in the Certified Animal Waste Management Plan (CAWMP).
The COC shall be effective from the date of issuance until April 30, 2003, and shall hereby void
COC No AWS860030 dated July 28, 1997. The COC shall hereby incorporate by reference any specific
conditions of the previous COC issued to this facility. The purpose of this COC is to allow coverage
under the revised General Permit. Please review the revised General Permit (enclosed) and pay
particular attention to Condition II.10 regarding tree removal from lagoon embankments, Condition Ill.1
regarding inspection frequency of the waste treatment, storage and collection system and Condition III.6
regarding notification requirements for system failures, spills and emergencies. Pursuant to this COC,
you are authorized and required to operate the system in conformity with the conditions and limitations
as specified in the General Permit, the facility's CAWMP, and this COC, with no discharge of wastes to
surface waters. An adequate system for collecting and maintaining the required monitoring data and
operational information must be established for this farm. Any increase in waste production greater than
the certified design capacity or increase in number of stocked animals above the number authorized by
this COC will require a modification to the CAWMP and this COC and shall be completed prior to
actual increase in either wastewater flow or number of animals.
Please be advised that any violation of the terms and conditions specified in this COC, the
General Permit or the CAWMP may result in the revocation of this COC, or penalties in accordance
with NCGS 143-215.6A through 143-215.6C including civil penalties, criminal penalties, and injunctive
relief.

You are hereby notified that Mike A. Johnson Farm, in accordance with G.S. 143-215.10C, must
apply for coverage under an Animal Waste Operation General Pernut. Upon receipt of this letter,, your
farm has thirty (30) days to submit the attached application and all supporting documentation. In
accordance with Chapter 626 of 1995 Session Laws (Regular Session 1996), Section
19(c)(2), any owner or operator who fails to submit an application by the date specified
by the Department SHALL NOT OPERATE the animal waste system after the specified
date. Your application must be returned within thirty (30) days of receipt of this letter. Failure to submit
the application as required may also subject your facility to a civil penalty and other enforcement actions
for each day the facility is operated following the due date of the application.
The attached application has been partially completed using information fisted in your Animal
Waste Management Plan Certification Form. If any of the general or operation information listed is
incorrect please make corrections as noted on the application before returning the application package. The
signed original application, one copy of the signed application, two copies of a general location map, and
two copies of the Certified Animal Waste Management Plan must be returned to complete the application
package. The completed package should be sent to the following address:

You were notified by letter dated November 12, 1996, that you were required to designate a
certified animal waste management system operator as Operator in Charge for the subject facility by
January 1, 1997. Enclosed with that letter was an Operator in Charge Designation Form for your
facility. Our records indicate that this completed Form has not yet been returned to our office.
For your convenience we are sending. you another Operator in Charge Designation Form for your
facility. Please return this completed Form to this office as soon as possible but in no case later
than April 25, 1997. This office maintains a list of certified operators in your area if you need
assistance in locating a certified operator.
Please note that failure to designate an Operator in Charge of your animal waste management
system, is a violation of N.C.G.S. 90A-47.2 and you will be assessed a civil penalty unless an
appropriately certified operator is designated. Please be advised that nothing in this letter should be
taken as absolving you of the responsibility and liability for any past or future violations for your
failure to designate an appropriate Operator in Charge by January 1, 1997.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

The Permits and Engineering Unit has completed a preliminary engineering review of the subject
application. Additional information is required before we can continue our review.
1. The waste utilization plan (or, nutrient management plan) has the signature page missing. It
should be signed and dated by the owner and the technical specialist as part of the Certified Animal
Waste Plan (CAWMP) as required in item I (3) of the General Permit Application Form.
2. The total capacity of the lagoons (1,363,060 cu. ft.) appears inadequate for this facility (7650
Feeder to Finish). Please provide us with the assumptions and calculations made in arriving this capacity.
Please reference the subject farm number when providing the requested information. All
information should be signed, and submitted in duplicate to my attention by August 8, 1997 at the
address below. Please note that failure to provide this additional information on or before the above
requested date can result in your application being returned as incomplete.
