We had irrigated on Saturday March 12 and did not have any problems with the system. Henry serviced the pump and then around 1:00 pm he started the pump and ran it for 12 to 15 minutes, we did not know it but our system had been vandalized on the lower end of our farm the part that was vandalized was not visible to the eye until the system was in operation (see sheriffs report attached, also there was vandalism last August to our corn fields on this same farm by four -wheelers) a stand pipe had been broken off, it discharged thru the field and down thru the woods into Candiff Creek (legal name but also known as Cundiff Creek). Henry Johnson was been back on our farm on March 17, 2016 and repaired the system, we talked to him about the discharge and he confirmed that the pump ran for about 12 to 15 minutes and that it would have released 50 gallons a minute, this would result in approximately 750 gallons of waste being spilled. We took our waste sample to the lab on Friday March 18 to comply with the sample process and this completed everything on the requirements of the permit. We have thoroughly inspected our system and to ensure we don't have this situation again, we will make sure that anytime we start the pump someone checks the system to make sure it has not been vandalized. Please let us know if we need to do anything further to comply, we strive to run our operation to the best of our ability and regret that this has happened due to someone's immature actions. As required by Condition Ill. I3.a. of your farm's Animal Waste Management System Permit (permit), our records document that the Division of Water Resources Winston-Salem Regional Office (DWR-WSRO) received notification within 30 minutes of your discovery of the discharge. Due to your exceptionally rapid response, short duration of the spill, and excellent compliance history, this office has decided to issue a Notice of Deficiency. You will recall that copies of the inspection report, incident report, and stream sample results were previously provided to Cundiff Creek Farm. Site Visit Observations: On March 15, 2016 DWR-WSRO staff documented that the source of the animal waste discharge was a damaged waste irrigation air relief valve located in solid -set irrigation field #5. Observations by WSRO, Surry Soil and Water Conservation District, and the Surry County Sheriffs Office indicate that the valve damage was due to recent vandalism. The discharge was precipitated by a routine pump test performed by the farm's irrigation company. The discharge traveled approximately 1000ft. through a dry ditch until flowing into Candiff Creek (class C waters of the State). From the confluence with Candiff Creek to the site of the fish kill was another 723ft. At the time of our investigation, WSRO staff observed that the waste in Candiff Creek had already flowed downstream of the fish kill site and that the surface water was clear with only a 450 W. Onsite measurements document that the upstream dissolved oxygen (DO) was 9.94mg/L while the downstream DO = 9.52mg/L. The upstream pH was 7.93 and the downstream pH was 7.98. Laboratory results report that the upstream fecal coliform was 81 CFU/100ml and 120 CFU/100m1 downstream. At the time of our investigation, there were no NC stream standard violations. Violations: The Division recognizes that the unpermitted discharge was caused by conditions out of your control. However, the discharge still violates NC General Statute NCGS 143-215.1 (a) which states in part that "no person shall ... make any outlets into the waters of the State" and Permit Condition I. 1. which declares that the facility should be operated as a non -discharge system to prevent the discharge of waste that reaches surface waters. Required Actions: 1. Please describe, in detail, the cause of the March 15, 2016 discharge. Police reports and report number(s) and any other observations should also be included. 2. If already completed, the entire waste management system should be inspected and assessed for any additional vandalism which may have occurred. Any repairs should be documented. 3. The release originated from a pump test and lasted no more than 12-15 minutes. The release was the result of a vandalized air relief valve on a remote area of the spray field. The resulting fish kill was observed by a downstream contractor who was working on a stream restoration project on the farm's property. The test was performed by an irrigation company who was hired by the farm. There was no indication of a problem with the test or that a release had occurred by those performing the test. Upon being notified there was a problem (within 30 minutes), the operator found where discharge had occurred and notified S&W. WSROS had staff on -site with S&W within an hour of the occurrence. The local sheriff's office was notified since there was an indication that the system had been vandalized. We do have a copy of the police report. The general policy is to issue a NOV in this circumstance, however due to the vandalism, the short duration and the response of the facility, we would like to consider issuance of a NOD instead. The facility completed all of their required permit actions related to a discharge without prompting. This facility has no history of non-compliance and in fact the operator has been nominated for operator of the year as they have been an exemplary farm. Mr. Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm earlier that afternoon to service the waste irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750 gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Surry SWCD, as well as the Bury County Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farm's nearby com fields were also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office). The discharge into Candiff Creek occurred from 2:00pm to 4:00pm. Discharge traveled 100011. until flowing into Candiff Creek. From confluence to fish kill was 723ft. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the species included (white sucker, rosyside dace, mountain mdbelty dace, and creek and bluehead chubs). Kin Hodges, fisheries biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead fish did not warrant payment to the Commission. WSRO received a telephone call from retired NC Wildlife Resources Commission employee, Joe Mickey, around 1:53pm on March 15, 2016 regarding a black, sudsy and odorous material in Cardiff Creek (Class C waters). Mr. Mickey called the WSRO again at 2:08pm to report that fish were now in distress and jumping and dying. Mr. Mickey reported that the fish kill was observed while he was working on a stream restoration project on property owned by Mike and Everett Johnson. After also notifying Mike . Johnson of the dead fish, Mr. Johnson arrived on site at 230pm. WSRO staff person, Gary Hudson was in the area and he and Surry County Soil and Water Conservation staff person, Tony Davis, arrived on site around 3:00 pm. They determined that a discharge had occurred at Cundiff Creek Farm, a 7650 feeder to finish permitted swine facility located on Long Dusty Trail (off River Siloam Road) in southern Surry County. The source of the discharge was a damaged waste irrigation air relief valve (#24) located in solid -set irrigation field #5. Mr. Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm earlier that afternoon to service the waste irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750 gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Surry SWCD, as well as the Surry County Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farms nearby com fields were also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office). The discharge into Cardiff Creek occurred from 2:OOpm to 4:OOpm. Discharge traveled 1000fl. until Flowing into Cardiff Creek. From confluence to fish kill was 723ff. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the species included (while sucker, rosyside dace, mountain redbelty dace, and creek and bluehead chubs). Kin Hodges, fisheries biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead fish did not warrant payment to the Commission. Tom Boyd, with the Division of Water Resources' Public Water Section, was also notified of the discharge at approximately 3:30pm. Mr. Boyd stated that he would notify the downstream water plant operators of the animal waste discharge. Melissa Rosebrock, WSRO animal waste inspector, was currently in Ashe County responding to another complaint and arrived on the Surry County site at 5:30pm. WSRO staff obtained up and downstream samples that were sent to the Division's laboratory in Raleigh to be analyzed for BOD, turbidity, fecat coliform, and nutrients. Water temperature, pH, specific conductance, DO and percent saturation were measured onsite. Several photographs were also taken during and after the discharge event. The upstream DO=9.94mg/L and the downstream DO=9.52mg/L. Upstream pH=7.93 while downstream pH=7.98. Ms. Rosebrock reviewed the permit requirements for responding to a discharge with both Everett and Mike Johnson. The five-day report was received by the WSRO on March 18, 2016. The Johnson's also submitted a copy of their most recent waste analysis report as required by their permit. Lagoon waste samples were also obtained and taken to Research & Analytical Laboratories, Inc. as per the permit. Cundiff Creek Farms 86-30 March 18, 2016 Melissa Rosebrock Division of Water Resources Winston Salem Regional Office Melissa, This is our written notification to comply with our permit that we have on our swine farm, as you know on March 15, 2016 we had our irrigation specialist Henry Johnson on our farm doing our spring servicing and check out of our irrigation pump. We had irrigated on Saturday March 12 and did not have any problems with the system. Henry serviced the pump and then around 1.00 pm he started the pump and ran it for 12 to 15 minutes, we did not know it but our system had been vandalized on the lower end of our farm the part that was vandalized was not visible to the eye until the system was in operation (see sheriff's report attached, also there was vandalism last August to our corn fields on this same farm by four -wheelers) a stand pipe had been broken off, it discharged thru the field and down thru the woods into Cundiff Creek (legal name but also known as Cundiff Creek). Henry Johnson has been back to our farm on March 17, 2016 and repaired the system, we talked to him about the discharge and he confirmed that the pump ran for about 12 to 1S minutes and that it would have released 50 gallons a minute, this would result in approximately 750 gallons of waste being spilled. We will be taking our waste sample to the lab on Friday March 18 to comply with the sample process. To ensure we don't have this situation again, we will make sure that anytime we start the pump someone will check the system to make sure it has not been vandalized again. We had irrigated on Saturday March 12 and did not have any problems with the system. Henry serviced the pump and then around 1:00 pm he started the pump and ran it for 12 to 15 minutes, we did not know it but our system had been vandalized on the lower end of our farm the part that was vandalized was not visible to the eye until the system was in operation (see sheriff's report attached, also there was vandalism last August to our corn fields on this same farm by four -wheelers) a stand pipe had been broken off, it discharged thru the field and down thru the woods into Candiff Creek (legal name but also known as Cundiff Creek). Henry Johnson has been back to our farm on March 17, 2016 and repaired the system, we talked to him about the discharge and he confirmed that the pump ran for about 12 to 15 minutes and that it would have released 50 gallons a minute, this would result in approximately 750 gallons of waste being spilled. We will be taking our waste sample to the lab on Friday March 18 to comply with the sample process. To ensure we don't have this situation again, we will make sure that anytime we start the pump someone will check the system to make sure it has not been vandalized again. We did see some live fish so it was not a total kill. Mike Johnston? (landowner) was very cooperative and this spill might have been the result of vandalism or just an equipment malfunction. Computers are such fun! I hate that this happened to Mike, he is a good guy who tires to do the correct thing. He has one of the best managed farms in the county according to Tony. I had no idea the problem was from his hog waste system, I didn't even know he had hogs. I was just reporting what was real problem that was occurring right before my eyes. Mike was on top of the problem once he was notified by Tony. I even went with him to track down the problem area and I followed the run-off creek with pockets of waste sludge to Candiff Creek. Discharge? Based upon the Compliance and Enforcement Guidance, there should be an NOV because it was a discharge to water of the state and a fish kill was associated with it. The circumstances can lead you in determining if a civil penalty enforcement would be warranted or not (perhaps not, based on the information provided). Because of the discharge and the fish kill we cannot take no action. We can talk about this more — just give me a call. I know there is a level of enforcement discretion allowed. If you strongly feel that only an NOD is warranted, then I would suggested talking to Jon Risgaard before issuing either. As far as the incident portal, yes. The release originated from a pump test and lasted no more than 12-15 minutes. The release was the result of a vandalized air relief valve on a remote area of the spray field. The resulting fish kill was observed by a downstream contractor who was working on a stream restoration project on the farm's property. The test was performed by an irrigation company who was hired by the farm. There was no indication of a problem with the test or that a release had occurred by those performing the test. Upon being notified there was a problem (within 30 minutes), the operator found where discharge had occurred and notified S&W. WSROS had staff on -site with S&W within an hour of the occurrence. The local sheriffs office was notified since there was an indication that the system had been vandalized. We do have a copy of the police report. The general policy is to issue a NOV in this circumstance, however due to the vandalism, the short duration and the response of the facility, we would like to consider issuance of a NOD instead. The facility completed all of their required permit actions related to a discharge without prompting. This facility has no history of non-compliance and in fact the operator has been nominated for operator of the year as they have been an exemplary farm. WSRO received a telephone call from retired NG Wildlife Resources Commission employee, Joe Mickey, around 1:53pm on March 15, 2016 regarding a black, sudsy and odorous material in Cardiff Creek (Class C waters). Mr. Mickey called the WSRO again at 2:08pm to report that fish were now in distress and jumping and dying. Mr. Mickey reported that the fish kill was observed while he was working on a stream restoration project on property owned by Mike and Everett Johnson. After also notifying Mike Johnson of the dead fish, Mr. Johnson arrived on site at 2:30pm. WSRO staff person, Gary Hudson was in the area and he and Surry County Soil and Water Conservation staff person, Tony Davis, arrived on site around 3:00 pm. They determined that a discharge had occurred at Cundiff Creek Farm, a 7650 feeder to finish permitted swine facility located on Long Dusty Trail (off River Siloam Road) in southern Suny County. The source of the discharge was a damaged waste irrigation air relief valve (#24) located in solid -set irrigation field #5. Mr. Johnson reported that their irrigation specialist (Henry Johnson) had been at the farm eadier that afternoon to service the waste irrigation pump. The irrigation specialist started the pump at 1:00pm and ran it for 12-15 minutes. Based on calculations, 750 gallons of animal waste was discharged into Cardiff Creek. Observations by WSRO, Suny SWCD, as well as the Sury County Sheriffs Office indicate that the valve damage was due to recent vandalism (OCA#16030215). The farn's nearby corn fields were also vandalized by 4-wheelers in August 2015 (report on file with sheriffs office). The discharge into Candiff Creek occurred from 2:00pm to 4:00pm. Discharge traveled 1000ft. until flowing into Cardiff Creek. From confluence to fish kill was 723ft. Approximately 92 fish (2-5 inch in length) were killed by the discharge. Per Mr. Mickey, the species included (white sucker, rosyside dace, mountain redbelly dace, and creek and bluehead chubs). Kin Hodges, fisheries biologist with the NC Wildlife Resources Commission was notified. Mr. Hodges determined that the size and quantity of the dead fish did not warrant payment to the Commission. Tom Boyd, with the Division of Water Resources' Public Water Section, was also notified of the discharge at approximately 3:30pm. Mr. Boyd stated that he would notify the downstream water plant operators of the animal waste discharge. Melissa Rosebrock, WSRO animal waste inspector, was currently in Ashe County responding to another complaint and arrived on the Suny County site at 5:30pm. WSRO staff obtained up and downstream samples that were sent to the Division's laboratory in Raleigh to be analyzed for BOD, turbidity, fecal coliform, and nutrients. Water temperature, pH, specific conductance, DO and percent saturation were measured onsite. Several photographs were also taken during and after the discharge event. The upstream DO=9.94mg/L and the downstream DO=9.52mg/L. Upstream pH=7.93 while downstream pH=7.98. Ms. Rosebrock reviewed the permit requirements for responding to a discharge with both Everett and Mike Johnson. The five-day report was received by the WSRO on March 18, 2016. The Johnson's also submitted a copy of their most recent waste analysis report as required by their permit. Lagoon waste samples were also obtained and taken to Research & Analytical Laboratories, Inc. as per the permit. Dead animals must be placed in covered dead box or buried within 24 hours after knowledge of the death of said domesticated animal according to the methods approved by the State Veterinarian for disposing of dead domesticated animals G.S. 106401. Refrigeration of dead animals is acceptable temporary storage until they are picked up for rendering. 3. Evidence of wind drift includes visible residue located on a neighbor's property such as vegetation, asphalt, roads, building structures, and/or public property such as roads. 4. Intake pipes for effluent removal must be placed in the aerobic layer of liquid approximately 18 inches below the surface. A floating intake may be used. This may not be evident, souse best judgement. Facilities using exclusively honey wagons, will not be affected by this question. Or' of Ge Rea`°�a� O Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly, requires a certified operator for each animal waste management system that serves 250 or more swine by January 1, 1997. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on -going basis in many counties throughout the state for the past several months and will continue to be offered through December 31,1996.
