I am writing this letter to ask for an exemption to the requirements of having to do a sludge survey
every year; we completed a sludge survey on 12-16-09 and had an average depth of 22 inches on 24
places checked. With the size of our lagoon we feel that the sludge build up on a yearly basis is minimal.
We manage and maintain our lagoon to keep it in the best possible operating conditions. For those
reasons, we are asking permission to hold off of doing another sludge survey for five years. If you have

As you know we operate a farrow to wean swine facility. In September of 2006 we
completed our first annual sludge survey of our swine lagoon. The first animals were
placed in the buildings In June of 2005. After eleven years of operation we ealeul
an average depth of only ten Inches of sludge In the lagoon. Since we have only
accumulated 10 Inches of sludge In this time frame, I am respectfully requesting a
variance from the annual sludge survey until at least after September 3% 2009. That is
the date that our CCO will expire. Following that renewal date we would continue with
the annual survey as outlined by DWQ.1 would appreciate your help with this matter.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRYI, DRY2, DRY3, SLURI, SLUR2,
SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

Dear Mr. and Mrs. Murray:
Thank you for your letter dated February 19; 1998 regarding the regulation of odor
from the W-4 Farm owned by C.L. White.
On March 6, 1998 Jenny Rankin and Mike Mickey of this office performed an
inspection of the farm to make sure it was in compliance. The inspection found that
the facility had no violations to any section of their permit. This includes such things
as adequate buffer requirements, zero discharge from their lagoon and proper land
application of waste. An application of waste had been applied on February 14, 1998
to some of the farm's fields. A note was made that on that day it was fairly windy.
This is the type of day the White's would prefer not to land apply the waste because
the odor is more noticeable. Due to the extremely wet conditions this winter has
brought, they had to apply the waste anyway just to keep the level of their lagoon
within compliance and so the integrity of the lagoon was not threatened. Even though
the odor was greatly pronounced, the facility did not violate their permit.
I recognize that animal operations operated in compliance with state and federal water
pollution control laws may produce odors which are unpleasant to the surrounding
community. However, there are several management methods which can be use to
help reduce offensive odor such as increasing the size of a lagoon, using aerobic
treatment, and properly managing the waste in a timely manner. However, it is
unrealistic to expect odors to be entirely'eliminated.
Currently the Division of Water Quality (DWQ) has no legal authority to mandate the
abatement of odors emitted by animal operations. State air quality regulations
addressing the control of odorous emissions are not directed at animal operations.
Instead, those regulations principally concern emission control equipment to control

odors from industrial plants. In addition, there are no federal air quality regulations which
address odor emissions from animal feedlots.
Although the state currently has no jurisdiction over odors from animal operations, there are
certain regulatory controls which may be pursued at the local level. One option is for the local
county health director to determine whether odors from particular animal feedlot operations rise
to the level of a "public health nuisance" within the meaning of N.C. General Statute 130A-19
(copy attached). If the local county health director deems the, odors to be a public health
nuisance, then an abatement order may be issued.
Another option might be to contact an attorney to discuss whether you have any legal rights
under the doctrine of nuisance liability under North Carolina law, particularly N.C. General
Statute 1-539, 106-700, 106-701. However, there are some limitations placed on suits to abate
agricultural nuisances under these statutes. The DWQ has no authority to make such a
determination, and I am in no way suggesting that this or any other operation might constitute
a nuisance.

My husband and I are writing you again to let you know how
you have mistreated all of your neighbors by placing this hog
farm close to our homes.
Our serene log house at 111 Howards Way was built as a
place to get away from our busy lifestyle and rest and enjoy
God's nature which surrounds all of the Dobson area. And at some
point in our life, we had hoped to retire to this log house.
We visited there this past Saturday and Sunday, February
14th and 15th. We had plans to trim some hedges and get outside
to enjoy the sunshine which we haven't had much of lately. The
smell from your hog farm was the strongest we have ever had to
contend with. It actually made us sick to our stomachs from
being outside for 30 minutes trying to cut some bushes. Needless
to say, we had to stay indoors while we were there. Even then,
the odor was so strong it was in our home. The odor was there
when we arrived about noon and it lasted until we went to bed.
Sunday was -some better.
A neighbor came by our place for a visit about 2:00 p.m. on
Saturday. We stood outside to talk. He said he had to leave
after about 15 minutes because the smell was so bad. He said it
had never been quite that bad at his house.
You can't imagine what this makes us feel like after
investing time and money into..a place like we have there. I am
hearing from all the neighbors who have to put up with this every
day of their life that they are also sick of it. There is no way
to even guess how much money has been lost in real estate value
in the Dobson area because of this farm.
Is there not anything you can do to relieve the odor of this
farm? You owe.this to.your friends and neighbors. We continue
to feel very strongl:y'that our rights have been violated.

We are writing to go on record with the North Carolina
Division of Environmental Management relative to a hog farm that
has been built less than a mile from our log home in Dobson,
North Carolina. The enclosed letter has been written to the
owner, Charles Larry (C. L.) White, and will explain who we are
and our situation. His telephone number is 910 366-4443.
We feel that our environmental rights have been violated
because of the short distance of this farm to our home and the
terrible odor it causes.
We have been told that your department has no control over
the odor this hog farm causes. Is this correct?
My understanding from talking with Mike Mickey on June 14th
that your department could get involved if there was a runoff of
the lagoon or seepage that would cause unsafe drinking water or a
change in the color of the water or dead fish in the streams.
Is this correct?
We have complained to the Surry County Health Department
through Jim Mahone, telephone 910 401-8325, about this hog farm
and our concern for our drinking water. We have ordered a
bacterial water test to be done so that we can compare our water
tests down the road to be certain seepage hasn't occurred from
this 3 1/2 acre lagoon.
We understand from the Surry County Environmental Health
Department at Level Cross, 910 401-8325, through Jim Higgins that
they have no rules through their department that would allow them
to enforce against animal waste and odor.

We understand from the Soil Conservation Service in Dobson,
901 386-8109 through Greg Goings, that when this hog farm was
built their agency had a 750-foot from a house ruling. This is
unfortunate for other landowners!
Now we understand through Mr. Goings that the law has been
changed to require 1500 feet from a house or 2500 feet from a
church.
We strongly feel that our rights have been violated. We
should appreciate hearing from you.

In accordance with your application received on July 8, 1997, we are forwarding this Certificate of
Coverage (COC) to Farm No. 86-28,'authorizing the operation of an animal waste collection, treatment,
storage and land application system in accordance with the State's General Permit (attached). This
approval shall consist of the operation of this system including, but not limited to, the management of
animal waste from the W4 Farms; located in Surry County, with an animal capacity of no greater than
2400 Farrow to Wean and the application to a minimum of 67 acres of land as specified in the Certified
Animal Waste Management Plan (CAWMP).
The COC shall be effective from the date of issuance until December 31, 2001. Pursuant to this
COC, you are authorized and required to operate the system in conformity with the conditions and
limitations as specified in the General Permit, the facility's CAWMP, and this COC, with no discharge of
wastes to surface waters. An adequate system for collecting and maintaining the required monitoring data
and operational information must be established for this farm. Any increase in waste production greater
than the certified design capacity or increase in number of stocked animals above the number authorized by
this COC will require a modification to the CAWMP and this COC and shall be completed prior to actual
increase in either wastewater flow or number of animals.
In accordance with General Statue 143-215.1OC, Animal Waste Management Plans shall include
the following components:
- A checklist of odor sources and best management practices to minimize these sources.
- A checklist of insect sources and best management practices to minimize these sources.
- Provisions set forth for acceptable methods of disposing of mortalities.
- Provisions regarding emergency action plans.
Your existing Certified Animal Waste Management Plan must include the above elements, by
December 31, 1998. Documentation of the certification must be available to inspectors onsite. Submittal
of the amended certification statement shall be required upon renewal of your permit coverage in 2001.
Please be advised that any violation of the terms and conditions specified in this COC, the General
Permit or the CAWMP may result in the revocation of this COC.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.
