Hi Becky,
For Mark's "protection" it would be good for him to have something in writing which sates what the
allowable/recommended plant available nitrogen (PAN) rate is for the crop receiving animal waste. Sounds like he will have
that information in the nutrient management plan you are writing for him. INC obviously doesn't regulate what he applies to
his VA fields but I told him it would be a good idea to keep a record, so that if he ever had to, that he could prove he was
only applying waste/nitrogen at agronomic rates. Thanks for assisting Mark on his VA fields, he's one of my good ones!

Sorry for the delayed response as I've been on the road the past two days with coal ash hearings, thus the late response
tonight.
Regarding the guy you left the message about, if he is attempting to line the area with the fabric then place concrete
block, brick etc for erosion control, that is fine.
If he is using waste material(s) attempting to fill in the area to level the ground to stop erosion, then he can only use the
items in the law/rules as fill. See here

He could also use used broken up asphalt, but not liquid asphalt. But definitely no fabric balled up and/or metal, etc.

A permit is not required for beneficial fill activity that meets all of the following conditions:
(1) The fill material consists only of inert debris strictly limited to concrete, brick, concrete block,
uncontaminated soil, rock, and gravel.
(2) The fill activity involves no excavation.
(3) The purpose of the fill activity is to improve land use potential or other approved beneficial reuses.
(4) The fill activity is not exempt from, and must comply with, all other applicable Federal, State, and
Local laws, ordinances, rules, and regulations, including but not limited to zoning restrictions, flood
plain restrictions, wetland restrictions, mining regulations, sedimentation and erosion control
regulations. Fill activity shall not contravene groundwater standards.

On February 28, 2001 Melissa Rosebrock of the Division of Water Quality's Winston-Salem
Regional Office performed a compliance inspection at the Mark Bray Farm. While record keeping was
improved over last year, there are other concerns that warrant your attention.
Specifically, Ms. Rosebrock noted that waste samples were not taken within 60 days of the July,
September, and November waste applications. As you are aware, waste samples are to be taken within 60
days of all waste applications. It was also noted that 1998 and 1999 soil test results were not available for
review. Please note that waste and soil analysis, once obtained, should be kept for a minimum of five
years. Failure to have complete records is a violation of North Carolina General Statute 143-
215.10C and your Certified Animal Waste Management Plan (CAWMP).
During the inspection, it was discovered that animal waste and soil were washing off some of the
cattle lots. While the discharge of waste from the lots was not reaching waters of the State on the date of
the inspection, the potential certainly exists for a discharge to waters in the future, particularly if
conditions deteriorate. To eliminate the possibility of any type of waste getting into surface waters of the
State,we recommend that you scrape the lots as soon as possible. Per conversations with Ms. Rosebrock,
it is our understanding that you will begin construction of a stock trail and stream crossing in July to
eliminate some of these concerns. We urge your continued cooperation with the Stokes County Soil and
Water Conservation District on your proposed construction.
Additionally, the CAWMP lists 4.15 acres as the usable acres for Tract-1195 Field-8. As you
stated during the inspection, the area is actually around 2.2 acres now that the poultry houses have been
constructed. Please contact your technical specialist to have your CAWMP revised to reflect this change.
