Dear Ms. Karoly:
On behalf of MAEVCO, LLC, thank you for assistance from your office. We are
pleased to submit the following project to you for DWQ 401 after-the-fact approval using
Nationwide Permits (NWP) 18 and 29 for these non-riparian wetland impacts. Birchwood
Homes is an 18-lot residential subdivision in southern Nashville, North Carolina.
Jurisdictional Impacts:
Impacts associated with this constructed project are to jurisdictional wetlands. NWP
18 will be used for the detention pond wetland impact (0.028-acre) on Lot 36. NWP 29 will
be used for the remaining lot and road wetland impacts. Mitigation for the 0.243-acre
wetland impacts will be provided by the NCEEP in-lieu fee mitigation program. The majority
of the impacts are associated with Par Drive and four adjacent lots. The proposed path of
Par Drive will provide access to this property from Golfers Lane. Upon Par Drive entering the
property, the road was immediately curved to the east to avoid the western wetland areas.
The stormwater pond on Lot 36 was strategically placed to avoid the western wetland areas
and large ditch while discharging to this adjacent ditch. The pond was also placed in an area
where the pre-existing flow discharged. As outlined in our previous meetings and
discussions, it is our understanding that the impacted wetlands conducted and proposed will
be allowed to remain.
Stormwater Detention & Treatment:
The existing dry detention basin was designed according to the Town of Nashville Pre-
and Post-Development stormwater control. This includes the 2- and 10-year storms. It is our
understanding that no modifications to this existing pond will be requested per previous
communications. Please also refer to the attached Dry Detention Extended Basin Worksheet,
Checklist, and signed Operation & Maintenance Agreement. The May 3, 2007 Division of Land
Resources Approval Letter is also attached for your files.

While under construction, temporary, custom sedimentation basins will be installed
outside of the wetland areas to protect them against sedimentation along with other appropriate
sedimentation and erosion control measures in compliance with Town of Nashville, Nash
County, & NC Sedimentation and Erosion Control requirements.
Future Project Plans & Cumulative Impacts:
Future Development of the western half of this site is anticipated. However, given current
economic conditions, no reasonable timeframe has been currently established. As a part of the
initial phase of development, improvements were made to an existing ditch along the southern
property line. These improvements have facilitated improved drainage of the entire site.
Additionally, the original approved jurisdictional determination (JD) for the site expired earlier this
year. Therefore, in order to accurately determine future potential impacts, as well as, avoidance
and minimization, a new JD will be provided prior to future development per the approved August
19, 2009 404 permit. This coupled with overall site drainage improvements with the initial
development, a conditional approval of the 401 permit application is appropriate, with any future
impacts to wetlands considered cumulative as also set forth in the 404 permit.

Sediment fence and numerous check dams were placed in the roadside swales and large southern ditch to protect
downstream water quality. Minimal grading was conducted in the pre-existing ditch in front of Lots 8 &9 and the access
area to Golfers Lane. Large logging mats were used during the initial clearing and grading to avoid additional wetland
impacts.

Notice of Violation stated that approximately 12,000 square feet of wetlands and 765 linear feet of intermittent stream channel
were impacted. After subsequent site visits with Mike Horan (DWQ), Thomas Brown (COE), & Jean Manuele (COE) and
other involved parties on May 17, 2007, June 6, 2007, and thereafter, it was determined that southern drainageway was an
ephemeral non-jurisdictional ditch. Also, the road and adjacent areas impacts along with the stormwater pond area was
determined to be approximately 0.195 acres. Attempts to minimize wetland impacts to less than 1/10`h acre were conducted
while the jurisdictional determination was on-hold due to the Rapanos Supreme Court isolated wetlands moratorium.

January 12, 2009, to fill or otherwise impact 0.293 acres of 404/wetland, and 0.00 square feet of zone 1
Tar-Pamlico River basin protected riparian buffer, and 0.00 square feet of Zone 2 Tar-Pamlico River basin
protected riparian buffer, to construct th; proposed residential development at the site. On February 20,
2009; March 24, 2009, June 4, 2009, and June 17, 2009; the DWQ reeeived'additional information from
you, -however, the DWQ has determined that your application remains incomplete and/or provided
inaccurate information as discussed below. On Jun 4, 2009, the DWQ received your response to our April
24, 2009, "Request For More Information" correspondence. You did not respond to the following requests
(restated below) from that correspondence.
1. Are there plans to develop the remaining areas of the site that do not show lot lines on the
submitted plans?
2. The stub for Preston Drive on the adjacent property provides access to the west side of the
Birchwood Homes sites. Please provide the final site plan for the west side of the development
along with any proposed wetland impacts.
For these reasons your permit application is hereby considered returned. Once you have redesigned
your project to address the problems and inadequacies with your application as it was submitted, you will
need to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate fee.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state federal or local
government permits, regulations or authorizations associated with the proposed activity including SL 2008-152• An Act to Promote
Compensatory Mitigation b Private Mitigation Banks.
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.

This office has reviewed the subject Erosion and Sedimentation Control Plan. We find
the plan to be acceptable and hereby issue this letter of approval. If any modifications,
performance reservations, or recommendations are applicable, a list is enclosed and is
incorporated as a part of this letter of approval. The enclosed Certificate of Approval should be
posted at the job site. In addition, it should be noted that this plan approval shall expire three (3)
years following the date of approval, if no land-disturbing activity has been undertaken, in
accordance with Title 15A, North Carolina Administrative Code (NCAC) 46.0029.
If any modifications are not incorporated into the plan and implemented in the field, the
site will be in violation of the Sedimentation Pollution Control Act of 1973 (North Carolina
General Statute (NCGS), 113A-61.1).

Acceptance and approval of this plan is conditioned upon your compliance with
applicable federal and state water quality laws, regulations and rules. This could include the
Division of Water Quality under stormwater or other specific water quality standards, and the
U.S. Army Corps of Engineers under Article 404 jurisdiction. Our approval does not supersede

Since this project disturbs one or more acres, one such approval relates to the
stormwater that will discharge from your project. This runoff is permitted pursuant to the
National Pollutant Discharge Elimination System (NPDES) administered in North Carolina by the
Division of Water Quality (DWQ). Attached is the General Stormwater NPDES Permit,
NCG010000, as revised October 1, 2001, covering your activity. You are responsible for
complying with the General Permit requirements and.are subject to enforcement by DWQ for
any violations of the General Permit.

existing buffers along watercourses in the Tar-Pamlico River Basin became effective on January
1, 2000. The Tar-Pamlico River Riparian Area Protection and Maintenance Rule (15A NCAC 2B
.0259) applies to all perennial and intermittent streams, lakes, ponds and estuaries in the Neuse
River Basin with existing vegetation on the adjacent land or "riparian area". In riparian areas
with existing vegetation in the first 30 feet directly adjacent to the stream, the rule prohibits land
disturbance or new development within the first 30 feet of land next to the water (the remaining
20 feet of the total buffer must be revegetated upon completion of any proposed land-disturbing
activity). In riparian areas with existing vegetation that is less than 30 feet wide, the rule
prohibits land disturbance or new development within the area that contains the existing
vegetation (but not the entire 50 foot riparian area). For more information about this riparian
area rule, please contact the Division of Water Quality's Wetland/401 Unit at 919-733-1786, or a
Division of Water Quality representative at this regional office.

Operation and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.
The dry extended detention basin system is defined as the dry detention basin, outlet
structure, pretreatment including forebays and the vegetated filter if one is provided.

Important maintenance procedures:
- The drainage area will be managed to reduce the sediment load to the dry
extended detention basin.
- Immediately after the dry extended detention basin is established, the vegetation
will be watered twice weekly if needed until the plants become established
(commonly six weeks).
- No portion of the dry extended detention pond will be fertilized after the first
initial fertilization that is required to establish the vegetation.
- I will maintain the vegetation in and around the basin at a height of
approximately six inches.
- Once a year, a dam safety expert will inspect the embankment.
After the dry extended detention basin is established, it will be inspected once a quarter
and within 24 hours after every storm event greater than 1.0 inches (or 1.5 inches if in
a Coastal County). Records of operation and maintenance will be kept in a known set
location and will be available upon request.
