As you recall, staff from the State's Division of Water Quality (Division) Winston-Salem Regional Office
visited your beef cattle operation on February 15, 2011. This visit was the result of a complaint received by our
office alleging the run-off of cattle waste into Rock Creek. At the time of our complaint investigation, staff
determined that approximately 68 beef cattle had access to over 700 feet of an unnamed tributary to Rock
Creek. The unnamed tributary flows from a fresh water pond located on your property and through a severely
denuded pasture, also on your property. Rock Creek and its tributaries are classified as WS-V/NSW waters of
the State within the Cape Fear River Basin. As a result of our complaint investigation the following water
quality concerns have been documented:
Turbidity Violation
Stream samples were obtained and analyzed for fecal coliform, dissolved oxygen (DO), pH, specific
conductance, nutrients, biochemical oxygen demand (BOD), and turbidity. Laboratory results document a
violation of the State Water Quality standard for turbidity. The upstream sample from the freshwater pond
measured 90 NTU and the downstream sample measured 120 NTU. The water quality standard for turbidity in
this section of Rock Creek is 50 NTU (maximum). Turbidity is the measure of relative clarity of a liquid.
Clarity is important when producing drinking water for human consumption and in many manufacturing uses.
Significant evidence exists that controlling turbidity is a competent safeguard against pathogens in drinking
water. The results suggest that excessive cattle activity in and around the freshwater pond may be contributing
to the turbidity violation as well. The Division recommends that cattle be excluded from all surface waters,
including the freshwater pond and that conditions causing the turbidity violation be abated immediately.

Potential Fecal Coliform Violation
The upstream (freshwater pond) fecal coliform measurement was 760 colonies per 100 ml while the
downstream sample measured >12,000 colonies per 100 ml. Please be aware that the State's water quality
standard for fecal coliform is only 200 colonies per 100 ml (maximum). Given that the fecal coliform level was
so highly elevated downstream of the cattle, there is the probability for future fecal coliform standard violations
should the Division obtain a total of five samples within 30 days that result in a geometric mean greater than
200 colonies/100 ml.
Other Parameters of Concern
There is no water quality standard for specific conductance, however, the freshwater pond specific conductance
measured 167µs/cm while the downstream was 433µs/cm. Specific conductance is an important water -quality
measurement because it provides an indirect measure of the amount of dissolved material in the water and can
be an indicator of water pollution.
On the date of our investigation there were no violations of the State's water quality standard for DO or pH,
although there is certainly the potential for future violations during rain events and if conditions are allowed to
deteriorate further. Additionally, there is no water quality standard for BOD or nutrients.
The water quality concerns described above are especially problematic since the affected water body is
classified as a water supply with a supplemental nutrient sensitive classification (WS-V/NSW). Surface water
classifications are designations applied to water bodies, such as Rock Creek, which define the uses to be
protected within these waters and carry with them an associated set of water quality standards to protect those
uses. Since Rock Creek is subject to growths of microscopic or macroscopic vegetation requiring limitations on
nutrient inputs, the discharge of nutrients (usually nitrogen and phosphorus) is limited. Please be aware that
any current and future violations are subject to a civil penalty assessment of up to $25,000 per day for
each violation.

The Division requests that you respond in writing within thirty (30) days of receipt of this Notice. Your
response should include a plan and specific descriptions detailing how and when the water quality concerns are
to be or have been addressed. Please direct your correspondence to my attention at the address contained in the
letterhead. We also urge your continued cooperation with the Alamance County Soil and Water Conservation
District/Natural Resource Conservation Service for any technical assistance you may need.

3. Today's visit was the result of a complaint received 2/10/2011 alleging that waste from the feedlot was discharging into a tributary
(Rock Creek). Rock creek is classified WS-V/NSW. Approximately 38 cows and 30 calves on a completely denuded "pasture" and 34
heifers in another pasture (vegetated).
pH and DO was in compliance. Samples were also taken and analyzed for BOD, nutrients, turbidity, and fecal coliform. Fecal
coliform in pond is 760 col/100 ml and specific conductance is 167us/cm, while downstream fecal coliform was >12,000 col/100 ml
and specific conductance was 433us/cm. Turbidity was 90 NTU in the pond and 120 NTU downstream. NOV to be sent for fecal
coliform and turbidity. Approximately 744+feet of impact. Cattle have unrestricted access to the freshwater pond (upstream sample
site).
