On behalf of Loyd Builders, we are requesting authorization from the USACE to use NWP 29 for
136 If of permanent stream impacts for construction of the construction of a 12 ft driveway to
access the buildable area within the parcel for construction of a residential dwelling. We are also
requesting a 401 WQC from NCDWR for the above referenced impacts, as well as Riparian Buffer
Authorization for 4,621 sf (Zone 1: 3,054; Zone 2: 1,567) of permanent impacts to Neuse River
Riparian Buffers.
The project is ±2.58 acres in size and is located at 5412 Aztec Drive in Raleigh, Wake County
(Latitude: 35.861674°N; Longitude: -78.726250°W). The project is located in the Neuse River
Basin and onsite waters drain to Turkey Creek. The Water Quality Classification for Turkey Creek
is B; NSW and the Stream Index Number is: 27-33-29-9-2. The cataloging unit for the site is
03020201.
Proposed Project
The purpose of the proposed project is to construct a 12 ft wide driveway to facilitate construction
of a residential dwelling within the buildable area of the parcel.
The overall proposed project consists of the construction of a residence including a dwelling,
driveway and utilities. Standard commercial construction equipment and techniques will be used
to construction the proposed project.
Project History
Onsite wetlands were delineated by WithersRavenel on 04/09/2019. A preliminary JD Request
and all supporting data has been included in support of our delineation, and WR is not requesting
issuance of the JD in conjunction with the issuance of the NWP 29.

All depicted streams were determined to be streams in the field and therefore buffer subjectivity
was conceded and a formal Buffer Determination from NCDWR was not requested.
Proposed Impacts
The proposed impacts consist of:
• 136 If of permanent stream impacts
• 4,621 sf (Zone 1: 3,054; Zone 2: 1,567) of permanent buffer impacts
Stream Impacts
Impacts #1A, #1B & #1C (Stream Impact Map 1-2)
The construction of the 12 ft driveway will result in 53 If of permanent impacts to Stream 1(Impact
#1A) for the construction of a 12 ft wide driveway and installation of a 42" RCP culvert.
Construction of the 12 ft wide driveway requires 53 If of permanent impacts to Stream 1 due to
the steep topography of the valley adjacent to the stream. Installation of the rip -rap dissipaters
above and below the culvert will result in 15 If of permanent stream impacts (Impacts #113 & #1C).
The rip -rap dissipaters are required to reduce flow velocity and prevent erosion of the stream and
undercutting of the culvert. The rip -rap will be installed by burying the rip -rap such that the top
of the rip -rap matches the pre -construction contours of the natural stream bed, allowing for the
passage of aquatic life and preventing a loss of function of this section of stream channel.
Impacts #2A, #213 & #2C (Stream Impact Map 1-3)
The construction of the driveway will result in 37 If of permanent impacts to Stream 2 (Impact
#2A) for installation of a 24" RCP culvert. Construction of the 12 ft wide driveway requires 37 If
of permanent impacts to Stream 2 due to the steep topography of the valley adjacent to the
stream. Installation of the rip -rap dissipaters above and below the culvert will result in 31 If of
permanent stream impacts (Impacts #2B & #2C). The rip -rap dissipaters are required to reduce
flow velocity and prevent erosion of the stream and undercutting of the culvert. The rip -rap will
be installed by burying the rip -rap such that the top of the rip -rap matches the pre -construction
contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss
of function of this section of stream channel.
Buffer Impacts
Impact #1 (Buffer Impact Map 1-2)
The construction of the driveway will result in 4,621 sf (Zone 1: 3,054; Zone 2: 1,567) of
permanent buffer impacts at the western stream crossing (Stream 1).
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimize.

Due to the narrow and linear shape of the site, street access and the location of the streams,
impacts to streams and buffers are required to access adjacent uplands and therefore impacts
could not be avoided entirely. To minimize impacts the driveway has been designed to cross
streams and buffers at a perpendicular angle. Stream impacts have been minimized by designed
the driveway with 3:1 backslopes to transition driveway fill to nature grade.
Additionally, the rip -rap dissipators will be installed by burying the rip -rap such that the top of the
rip -rap matches the pre -construction contours of the natural stream bed, allowing for the passage
of aquatic life and preventing a functional loss.
Construction techniques used to avoid or minimize the proposed impacts include the installation
of erosion and sedimentation control devised prior to construction. Additionally, access to impact
areas will be from high ground.
Mitigation
Stream Mitigation
The proposed project will result in 136 If of permanent stream impacts, of which 90 If will result
in functional loss as depicted in the table below.
The proposed permanent stream impacts (with functional loss) are 90 If; therefore, mitigation is
not proposed.
Buffer Mitigation
The proposed driveway is meets criteria for "Driveway Crossings in a subdivision that cumulatively
disturb equal to or less than 150 If or one-third of an acre of riparian buffers", which is classified
as an "Allowable" use in the Neuse River Riparian Buffer Rules Table of Uses. Therefore, mitigation
is not required.
The current request is for 136 If of permanent stream impacts and 4,621 sf (Zone 1: 3,054; Zone
2: 1,567) of permanent buffer impacts (see the attached maps and PCN for details).

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as
NCNHP GIS data to identify if there were any known occurrences of listed species on or near the proposed project. The
review of the NHP data did not identify any recent occurrences of federally listed threatened or endangered species or
critical habitat on the subject property; however, there was 1 known species occurrence (Atlantic pigtoe) within 1.0 miles
of the project, see attached NCNHP project review letter. Please note, the Atlantic pigtoe is proposed for listed as
threatened, but is not currently listed. The known occurrence of the Atlantic pigtoe occurs in Crabtree Creek and is
approx. 1 mile away at the nearest point of the project.
The site review did not identify any potential habitat for bald eagle, red -cockaded woodpecker or Michaux's sumac within
the undeveloped woodlands onsite. The proposed project is outside the range of the Cape Fear shiner, Tar River
spinymussel and yellow lance. Despite the project being in the USFWS range of the dwarf wedgemussel and Atlantic
pigtoe; streams 1 & 2 were determined to be intermittent in the field and therefore were not considered potential habitat.
Therefore, the proposed project will have No Effect on federally protected species or their critical habitat.

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.

Review Area
1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:
