Dear Mr. Templeton:
Per our previous conversation, we are requesting a variance from a requirement in the
Supplement to Permit Cover Sheet for our existing NPDES permit that identifies the transfer of
wastewaters to the 400,000 gallon storage tank for treatment and discharge to South Fork
Catawba River. .
In pursuit of closing out this NPDES permit,we propose to pump the wastewater from each tank
directly to the permitted Outfall 1 rather than consolidating into a single tank. Additionally,
because the remaining wastewater is accumulated storm water on sludge remaining in the tanks,
and previous testing has indicated no further treatment will be needed prior to release, we would
prefer to minimize disturbance of the sludge that would be caused by consolidation.
Our plan for discharge would be to test each of the four tanks containing waste water for the
parameters required in our NPDES permit(two species toxicity, BOD, TSS, Total Phenolics,
PAHs, Total Phosphorus and Total Nitrogen), and for VOCs at your specific previous request.
Once acceptable test results are received and reported to NCDEQ, and our written plan for
discharge is approved by the DWR Mooresville Regional Office, our subcontractor,Monark
Industrial, will use a Sunbelt rental submersible pump mounted on a floating platform to pump
the wastewater in each tank to Outfall 1 via rented hoses. During discharge, daily effluent
samples will be collected for field and lab analysis per our NPDES permit. Pumping will stop
when the water level is 1-2 ft. above the sludge line in each tank.

Once wastewater discharge has been completed, sludge removal will proceed according to an
approved plan provided separately by Geosyntec, who has contracted directly with the NCDEQ.
We are requesting a response to this variance request as soon as possible to allow sampling to
