We are also requesting a 401 WQC from NCDWR for the above referenced impacts. The project is ±10.39 acres in size and is located at 1621 White Oak Church Road in Cary, Wake County (Latitude: 35.778990°N; Longitude: -78.921476°W). The project is located in the Cape Fear River basin and onsite waters drain to White Oak Creek. The Water Quality Classification for White Oak Creek is WS -IV; NSW and the Stream Index Number is: 16-41-6-(0.7). The cataloging unit for the site is 03030002. Proposed Project The purpose of the proposed project is to construct a townhome residential subdivision to meet the existing demand for housing in the Cary area. The overall proposed project consists of the construction of 30 townhomes, a daycare and associated infrastructure including roads, utilities and stormwater management. Standard commercial construction equipment and techniques will be used to construction the proposed project. WithersRavenel proposes use of NWP 29 for the proposed project because while the proposed daycare facility is part of the overall project; the wetland and stream impacts are required only the roadway to access the proposed townhomes. The proposed project has been designed to tie into the future Dominion Estates subdivision to the south in order to meet the Town of Cary interconnectivity requirements. Project History Eric Kulz of the Town of Cary issued a Buffer Determination (TCRB# 16-005) for the project area on 09/29/2016. A copy of the Buffer Determination Letter has been provided as an appendix. An approved Jurisdictional Determination (SAW -2016-02305) was issued for the project area on 03/30/2017. A copy of the Jurisdictional Determination has been provided as an appendix. Proposed Impacts The proposed impacts consist of: • 0.08 acres of permanent wetland impacts 163 If of permanent stream impacts • 23 If of temporary stream impacts Impacts #1, #2 & #3 (Impact Map B) The construction of the roadway will result in 94 If of permanent stream impacts (Impact #2) for installation of a 54" RCP culvert. Installation of the rip -rap dissipater below the culvert will result in 15 If of permanent stream impacts (Impact #3). The rip -rap dissipater is required to reduce flow velocity and prevent erosion of the stream and undercutting of the culvert. The rip -rap will be installed by burying the rip -rap such that the top of the rip -rap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of function of this section of stream channel. Installation of the 54" RCP culvert and upstream headwall will result in 13 If of temporary stream impacts (Impact #1) during construction. Impacts #4, #5 & #6 (Impact Map C) The construction of the roadway will result in 54 If of permanent stream impacts (Impact #5) and 0.08 ac of permanent wetland impacts (Impact #6) for installation of a 60" RCP culvert and road crossing. Installation of the 60" RCP culvert and upstream headwall will result in 10 If of temporary stream impacts (Impacts #4) during construction. The terminus of Stream 2 is within the road alignment, which is why there are no stream impacts associated with the rip -rap dissipater. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimize. Due to the narrow and linear shape of the site and the location of the streams and wetlands, impacts to wetlands and streams are required to access adjacent uplands and therefore impacts Page 2 of 4 White Oak Townhomes - NWP 29 PCN` i t h e rs Ra Ve n e l could not be avoided entirely. To minimize impacts the roadway has been designed to cross streams and wetlands at a perpendicular angle. The western road crossing has been designed to avoid wetland impacts located north and south within the crenulation. The eastern road crossing has been designed to cross the drainage as the stream stops, avoiding additional stream impacts necessary for a crossing. Construction techniques used to avoid or minimize the proposed impacts include the installation of erosion and sedimentation control devised prior to construction. Additionally, access to impact areas will be from high ground. Mitigation Stream Mitigation The proposed project will result in 163 If of permanent stream impacts, of which 148 If will result in functional loss as depicted in the table below. The proposed permanent stream impact (with functional loss) are 148 If; therefore, mitigation is not proposed. Wetland Mitigation The proposed project will result in 0.08 acres of permanent wetland impacts; therefore, no mitigation is proposed. Stormwater Management Plan The proposed stormwater management plan consists of three stormwater control measures (SCM), including a sand filter, stormwater wetland and stormwater wet pond. The SCMs have been designed to remove 85% TSS and TN removal rate of 30%, and therefore diffuse flow is not required. The proposed project will meet State and Local stormwater management requirements as outlined in the Town of Cary Land Development Ordinance. The proposed Stormwater Management Plan will be reviewed and approved by the Town of Cary as the certified municipality. Furthermore, site reviews did not identify any potential habitat for any federally protected species known to occur in Wake County. Therefore, the proposed project will have No Effect on federally protected species. Additionally, the project site is not located within the known range of the Cape Fear shiner, Tar River spinymussel, dwarf wedgemussel and yellow lance. Site reviews did not identify any potential habitat for bald eagle, red -cockaded, Michaux's sumac or Atlantic pigtoe. Streams 1 & 2 are intermittent streams fed by runoff, Stream 2 has a substrate consisting of saprolite and Stream 1 has a substrate consisting of saprolite, sand and gravel. Streams 1 & 2 have stop points within the site and each stream was observed with little or no water in the channel, therefore Streams 1 & 2 were not considered suitable habitat for Atlantic pigtoe (proposed for listing as Threatened). Based on the lack of habitat, lack of nearby records and the proposed activities, WR concludes that the project will have "no effect" on federally protected species or their critical habitat. 6.
