Describe the overall project in detail, including the type of equipment to be used: The overall project consists of development of the site with a 40 lot single family residential sub -division. Primary site access will be provided from Gibsonville-Ossipee Road. In order to satisfy city requirements, secondary access is required to connect to an existing neighborhood that is located south of the site (Stone Ridge). The applicant proposes to construct Dolomite Drive, which will require a stream/wetland crossing. To facilitate development of the site and construction of the proposed stream crossing, clearing and grading the site is necessary. Graders, haulers, excavators and other heavy equipment will be used during site construction. 4. Jurisdictional Determinations 4a. The USACE responded to the application in an e-mail dated December 4, 2017. The e-mail stated that: "Please note that Phase 1 of Stone Ridge subdivision required a Corps authorization under NWP 39, verified for use on 10/19/2005 (SAW -2005-21192), for permanent impacts to 123 linear feet of stream and 0.08 acre of wetlands necessary for two road crossings (see attached). Given that the proposed impacts are for an additional phase in the Stone Ridge subdivision (same developer, shared amenities, etc.), the Corps views the proposed stream and wetland impacts as cumulative with earlier phases." The PCN application was withdrawn. This PCN application is for a stand alone subdivision (Preserve at Stone Ridge) with no shared amenities. Additionally, lot sizes and the price point for this neighborhood are separate. An approximate 4.18 acre tract is under contract that provides site access from Gibsonville-Ossipee Road. To satisfy City requirements, the Town of Gibsonville is requiring connectivity to an existing subdivision (Stone Ridge) that is located south of the site. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed residential sub -division to avoid other impact to streams and wetlands, specifically associated with lot/pad fill. The applicant has further demonstrated avoidance and minimization of stream and wetland impacts by proposing to construct head and end walls. The residences will utilize municipal sanitary sewer services and has been designed to avoid impact to jurisdictional features associated with sewer line connection. The sanitary sewer services will connect to existing sewer lines that cross the site. The applicant has designed the stream crossing to be buried 6 inches below the existing stream bed elevation to adequately allow aquatic passage. The remaining approximate 0.175 acres of wetlands and 992 linear feet of stream channel are being avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and best management practices will be used. A temporary coffer dam will be installed upgradient of the proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. Upon completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked. 2. David Bailey with the US Army Corps of Engineers was also present during the site visit. The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the USACE. The attached map accurately depicts all stream determinations conducted during the site visit. Please note that at the time of this letter, all perennial stream channels and jurisdictional wetlands found on the property are subject to the mitigation rules cited above. These regulations are subject to change in the future. In addition, the Jordan Lake Buffer Rules may apply to some streams at this location, please be sure to contact the local government for further information regarding the Jordan Lake Buffer Rules.
