connect Otter Way and Sand Dollar Drive within the existing portion of Wind Over Waves
Phase II. The road will have a 50' wide right-of-way and a 20' wide paved surface,
Septic systems are proposed for all 57 lots and preliminary approval from Dare
County is attached.
Anticipated impacts
Approximately :1:283,140 ft2 of uplands will be disturbed (grading, filling, etc.) as a
result of the development activities.

Project setting
Brian Rubino with Quible & Associates, on behalf of Billy Roughton, has requested
the attached application be processed underthe Express Permit Review Program, fora
57-lot subdivision under the name of Wind Over Waves.
The project site is located on NC 12 in the Town of Salvo on the Pamlico Sound and
Midgett Cove in Dare County, North Carolina. The proposed project site comprises :t38.25
acres, is currently undeveloped, and is Phase III of the Wind Over Waves Subdivision
development.
The rectangular shaped site is bordered by NC 12 and Pamlico Sound, The
property is divided into three distinct sections, The area adjacent NC 12 on the west side
of the site is a wooded area dominated by pines with an under story of vines, herbaceous
shrubs, upland grasses, and sporadic Spartina patens,
The center third of the site is a meadow with cedar, wax myrtle, silverling, golden
rod, Juncus roemerianus, and S. patens. Although Coastal Wetland species are present,
this area is not subject to regular or irregular flooding and has not been claimed as a
Coastal Wetland under the jurisdiction of the Division of Coastal Management. In addition,
the US Army Corps of Engineers (USACOE) delineated the property 5 years ago and did
not claim the bulk of this area as a Section 404 wetland under their jurisdiction.
The remaining third of the site abuts Pamlico Sound to the west and an unnamed
tributary to the south and southeast. This area has been delineated as a Coastal Wetland
under the jurisdiction of the Division of Coastal Management and contains Spartina
alterniflora, J. roemerianus, Distichlis spicata, and S. patens. This Coastal Wetland area
transitions into the meadow described above and Tom Walker of the USACOE has
delineated a portion of this area immediately adjacent to the Coastal Wetland as Section
404 wetlands.
The project site is bordered on the north (upstream) side by developed single-family
properties (Phase II of Wind Over Waves) with similar vegetation. The site is bordered on
the south (downstream) side by an unnamed tributary to the Pamlico Sound and then by
undeveloped property vegetated similar to the applicant's.
Pamlico Sound in this area is classified asSA-NSW by the Environmental
Management Commission and is open to shell fishing. The site ranges from 0 to :t3' above
the normal water level.
Project description
The applicant proposes to subdivide the property into 57 residential building lots.
The lots will range in size from 0.34 acres to 0.80 acres. A :t2,790' long asphalt loop road

Mr. Moye:
The enclosed CAMA Major Application Package is for the Wind Over Waves, Phase III project
in Salvo, Dare County, North Carolina. The property is located on the west side of NC 12 in
Salvo, NC and includes a 38.25 acre parcel (total Phase III area landward of the normal water
line). The proposed project in entirety includes a 57 lot residential subdivision. The site plan
accurately depicts the project as proposed. The lots will be individually sold and built upon by
future property owners at a later date. A CAMA Major Permit is required due to the location of
a small portion of the proposed road lying within the 75 ft Estuarine Area of Environmental
Concern (AEC), and the total disturbance associated with roadway construction exceeding 1
acre, thus requiring a DWQ Stormwater Management Plan and a DLRErosion and
Sedimentation Control Plan. A stormwater Permit (No. SW7050909) was issued on September
26, 2005 and an Erosion and Sedimentation Control Plan (Dare-2006-012) was issued on May
1 , 2006.
The enclosed site plan indicates the entire roadway and highlights the proposed area of
disturbance within the AEC. The total proposed impervious coverage within the AEC is 6,756
sq.ft. (1.27%) and the total ground disturbance within the AEC will be 15,120 sq,ft. and includes
road surface, grading and installation of underground utilities (water, electric and cable).
There is no proposed wetland impact associated with the project. Similarly, no disturbance is
proposed within the 30 ft vegetative buffer. The confirmed Section 404 wetland line confirmed
by USACE on January 3, 2002, and the current coastal wetlands line established by NCDCM in
August 2006 are depicted on the site plan. Prior to expiration of the existing Section 404
wetlands plat, USACE has agreed to adopt the more restrictive wetlands line which is the
coastal wetlands line. This will be done when the nationwide moratorium on issuance of
USACE jurisdictional determinations is lifted.

crowned center underlain by aggregate subgrades.

· A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then forward
a copy of the deed or other instrument under which the
owner claims title, plus written permission from the
owner to carry out the project.
· An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 W' by 11" white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description. )
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of Engineers
regarding that agency's use of larger drawings.) A site
or location map is a part of plat requirements and it
must be sufficiently detailed to guide agency personnel
unfamiliar with the area to the site. Include highway or
secondary road (SR) numbers, landmarks, and the like.

· A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

The Washington Regional Office received a complete Stormwater Management Permit
Application for Wind Over Waves - Phase III, on September 8, 2005, Staff review of
the plans and specifications has determined that the project, as proposed, will comply
with the Stormwater Regulations set forth in Title 15A NCAC 2H.1 000. We are
forwarding Permit No. SW7050909, dated September 26, 2005, for the construction of
the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be
subject to the conditions and limitations as specified therein, and does not supercede
any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. ThiS request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7447. Unless such demands are made this permit shall be final and binding.

I. DESIGN STANDARDS
1.
Each of the 57 lots is limited to a maximum of (see Table 1) square feet of built-
upon area, as indicated in the approved plans. CAMA regulations may reduce
the allowable built-upon area for those lots within the AEC.
The overall tract built-upon area percentage or lot sizes for the project must be
maint~ined at 25% per the requirements of Section .1005 of the stormwater
rules,
Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit
Projects covered by this permit will maintain a minimum 30 foot wide vegetative
buffer between all impervious areas and surface waters,
The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3:1 (H:V) as defined in the
stormwater rules and approved by the Division.
All roof drains must terminate at least 30' from the mean high water mark.

II. SCHEDULE OF COMPLIANCE

1.
Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of
any built-upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at
optimum efficiency to include:
a. Inspections
b. Sediment removal.
c. Mowin~J and revegetating of the side slopes,
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications. .
The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any of the items shown on the approved plans, including
the ~tormwater management system, design concept, built'-upon area,
detqils, etc.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or to the
drainage ar~a.
e. Further subdivision, .acguisition, or sellin~oftheproject area.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved plan.
The Director may determine that other revisions to the project should require a
modification to the permit.
The permittee shall submit all information requested by the Director or his
representativ~ within the time frame specified in the written information request.
No piping shall be allowed except that minimum amount necessary to direct
runoff beneath an impervious surface such as a road and that minImum amount
needed under driveways to provide access to lots.
Unless specified elsewhere, permanent seeding requirements for the swales
must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
The permittee is responsible for verifying that the proposed built-upon area does
not exceed the allowable built-upon area. Once the lot transfer is complete, the
built-upon area may not be revised without approval from the Division of Water
Quality, and responsibility for meethig the builf-upon area limit is transferred to
the i~dividual propf,3rty owner, pro~ided th~t the permittee complies with the
reqUirements of Section 11.11 of thiS permIt.. .. '.
Within 30 days of completion of the project, the permittee must certify in writing
that the project's stormwater controls, and impervious surfaces have been
constructed within substantial intent of the approved plans and specifications.
Any deviation from the approved plans must be noted on the Certification.

Deed restrictions are incorporated into this permit by reference and must be
recorded with the Office of the Register of Deeds prior to the sale of any lot.
Recorded deed restrictions must include, as a minimum, the following
statements related to stormwater management:

The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW7050909, as issued by
the Division of Water Q'uality under NCAC 2H.1000.
The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater .
Management Permit.
These covenants are to run with the land and be binding on all persons
and parties claiming under them.
The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina,
Division of Water Quality.
Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
The maximum built-upon area per lot is (see Table 1) square feet. This
allotted amount includes any built-upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the pavement. Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and
coquina, but does not include raised, open wood decking, or the water
surface of s~imming pools.
Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings,
is strictly prohibited by any persons.
Each lot will maintain a 30' wide vegetated buffer between all impervious
areas and surface waters.

The permittee shall submit a copy of the recorded deed restrictions which
indicates the approved built-upon area per lot within 30 days of the date of
recording.
If the permittee sets up an Architectural Review Committee (ARC) to review
plans for compliance with the restrictions, the plans reviewed must include all
proposed built-upon area (BUA). Any approvals given by the ARC do not relieve
the lot owner of the responsibility to maintain compliance with the permitted BUA
limit.
The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit' a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and-certification in' writing to the" Director
that the changes have been made.
Stormwater conveyances will be located in either dedicated right-of-way (public
or private), recorded common areas or recorded drainage easements. The final
plats for the project will be recorded showing all such required easements, in
accordance with the approved plans.

III. GENERAL CONDITIONS
1. Failure to abide by the conditions .and limitations contained in this permit may
subjeCt the Permittee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition,
4, The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or.terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1 000; and North Carolina General
Statute 143...215.1 et. al. .
5. The permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. A formal permit reqlJest must pe submitted
to the Division of Water Quality accompanied by the appropriate fee,
documentation from both parties involved, and other supporting materials as may
be appropriate, The approval of this request will be considered on its merits, and
mayor may not be approved.
6. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the permit transfer request. Transfers to third
parties by the permittee where the required documentation has not been
submitted to the Division does not relieve the permittee of responsibility for
transferring the permit. .
7. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state and federal) which have jurisdiction. If
any of those permits result in revisions to the plans, a permit modification must
be submitted.. . .
8. The permittee grants permission to DENR Staff to enter the property during
business hours for the purposes of inspecting the stormwater management
system and it's components.
9. The permittee shall notify the Division of Water Quality of any name,
ownership or mailing address changes within 30 days.

The Environmental Management Commission classifies the area within 575 feet of the normal
highwater mark of the Sound as a High Quality Water Zone, All disturbed areas within this
zone must be provided with a ground cover sufficient to restrain erosion within the shorter of
15 working days or 60 calendar days of completion of construction,
In 1973, the Sedimentation Pollution Control Act (copy available upon request) was enacted.
It established a performance oriented program with the objective of PREVENTING sediment damage to
adjoining properties and/or natural resources resulting from land disturbing activities through the use of
reasonable and appropriate Best Land Management Practices, based on the approved plan and changing site
conditions, during the course of the project. AS THE DECLARED RESPONSIBLE PARTY YOUR

saftly withstand the runoff resulting from a 10 year storm event - 6,5 - '7

and maintained between the land-disturbing activity and any adjacent
property or watercourse;

the land disturbance and the providing of a ground is minimized;
a Dermanent Bound cover. sufficient to restrain erosion, must be Drovlded
within the shorter of 15 working or 90 calendar days after completion of
construction or development; and,
except in the case of an emergency, a revised erosion and sedimentation
control plan must be submitted to and approved by this office prior to
initiating any significant changes in the construction, grading or drainage
plans;
this approval is based, in part, on the accuracy of the information provided
in the Financial Responsibz1ity/Ownership form submitted with the project
plans, You are required to file an amendedform if there is any change in
the information included on the form. This approval and the financial
responsibility/liability cited in it dQes not automatically transfer with a
change in project ownership, .
Be advised that his letter givers notice of our right of periodic inspection to ensure compliance with the

Enclosed please find one copy of the "Application for Approval..." together. with one copy of
the referenced engineering plans bearing the Division of Environmental Health stamp of approval
and signature of the Public Water Supply Section Chief for the referenced project. These engineer-
ing plans are approved under Division of Environmental Health serial number 00-02267, dated
September 20, 2000.
Engineering plans and specifications prepared by David A. Deel, P.E., call for the installation
of approximately 6,295 feet of 6-inch and 1,338 feet of 2-inch water mains and appurtenances to
serve 95 residential lots in the Pipkin Salvo Subdivision in Dare County. The project will be an
extension of the Dare County Water System and will connect to an existing main along NC 12. All
construction will be in accordance with the Dare County standard specifications. Dare County
Water System has agreed to supply water to this expansion.
Please note that an "Authorization to Construct" requires both this approval of
Engineering Plans and Specifications and submittal of a complete Engineer's Report and
Water System Management Plan, No construction shall be undertaken, and no contract for
construction, alteration, or installation shall be entered into until the Department issues an
Authorization to Construct letter in accordance with 15A NCAC 18C ,0305(a),
.One copy of each enclosed document is being forwarded to our Washington Regional
Office. The third copy is being retained in our permanent files.
