The revised drawing is consistent with the 11x17 drawing submitted with the original application request. Please reference my May 3rd (2001) correspondence for additional information regarding avoidance and minimization measures for the proposed project. During our telephone conversation you also requested that restrictive covenants be placed upon the areas depicted as future phases. The applicant does not have definitive plans for these areas at this time and seeks authorization for the road crossings only. The applicant requests written clarification of the authority or grounds by which restrictive covenants are required for areas outside the proposed project area (i.e. `future phases'). This is the fourth written correspondence I have provided to your office on behalf of the applicant since the time of the application submittal. Oftentimes during regulatory permit reviews, we receive letters requesting additional information in which the reviewing agency notifies us that an application is placed on hold until such time that the supplemental information is provided. The only written correspondence we have received from your office was a form letter dated April 19, 2001. I responded to this letter on May P. There has not been any written correspondence from your office since that time (144 days thus far). The following is a chronology of events since the time of the application submittal: (1) Application submitted February 26, 2001; (2) Form letter from DWQ dated April 19, 2001; (3) Repeated phone calls placed from LMG to DWQ Raleigh office from April 26`h to May 15'h requesting clarification of information requested; (4) Written correspondence dated May 3, 2001 from LMG to DWQ - Raleigh attempting to provide information necessary for processing of 401 Ceritfication; (5) May (2001) phone conversation with John Dorney. Mr. Dorney asks for revised 8.5 x 11 drawing with two lots to be removed ("lots are not buildable as shown"); (6) Written correspondence dated May 30, 2001 from LMG to DWQ - Raleigh. Revised drawing (with two lots removed) is forwarded to DWQ as requested. Response to request for restrictive covenants on future phases is also provided at this time; (7) Repeated phone calls from LMG to DWQ (Raleigh and Wilmington offices) in July 2001 in an attempt to find out status of 401 Certification; l 4. ?.. The following is a summary of some of the related project issues: The applicant has requested fill for 0.07 acres for three road crossings necessary to access his property. This quantity of fill is under the threshold limit for a Section 404 PCN. The initial design of the project depicted approximately 8 acres of impacts to 404 wetlands/waters and CAMA AEC's. Upon advice from LMG, the applicant revised the plan such that only 0.07 acres of fill is requested. This fill is necessary to cross severely incised ditches that were excavated approximately 20 years ago (by other parties). These "waters" contribute to decreased water quality of Futch Creek by serving as a direct conduit for sediment and nutrient loading from upland sources (including US Highway 17). The applicant has made every attempt to avoid and minimize impacts to wetlands and waters. In fact, the applicant is currently working with the New Hanover County Tidal Creeks Program to develop a plan to restore functional bottomland hardwood and stream habitat on-site. These negotiations have been severely jeopardized by the lack of response regarding the 401 Certification. All DWQ and CAMA field representatives that have visited the site have no objection to the project as designed. During a phone conversation on August 16th, you had raised a question regarding the placement of a cul-de-sac on New Forest Dr. (refer to site plan). As I had responded to you at the time, the applicant had originally proposed a road crossing for the adjacent wetland. Based upon advice from LMG, the applicant revised the project such that the road would end in a cul-de-sac rather than crossing wetlands. As depicted on the plan, the cul-de- sac stops before the wetlands and there are no lots planned around the cul-de-sac (as depicted on the plan). The applicant is considering different means to access the future phase located on the eastern side of this wetland area. The applicant intends to design a bridge or potentially access this future phase from Creekwood Rd. (located to the northeast of the project site) so as not to create adverse impacts to this wetland area. As is normally conditioned for NWP 14 401 General Certifications, the applicant intends to place deed restrictions on all lots depicted on the site plan to prevent future wetlands impact by individual lot owners. I hope the information provided here is sufficient for the processing of the 401 Certification. Please realize that both the applicant and I have attempted in every way to facilitate this process. We understand that you got involved in the review of this application late in the process and may not have been privy to some of the earlier discussions regarding this project. A contested case petition was filed in order to preserve the petitioner's rights while an answer was sought to a question which was posed by Christian Preziosi of Land Management Group in a series of conversations and letters to John Dorney and Danny Smith. The issue has to do with a demand that restrictive covenants be placed on property not part of the Sagewood Subdivision project, and an apparent prohibition on "future impacts as a result of road crossings or bridges . . . from either New Forest Drive or access of this phase from Creekwood Road." Mr. Preziosi was seeking clarification to these issues. The petitioner (1) wants to retain the option in the future to access from New Forest Drive or Creekwood Road by bridge or other means without impact to wetlands areas to connect to property not within the project; and (2) does not wish to place restrictive covenants on property outside the project area. The Petitioner recognizes that any development of adjoining property would require additional review and permitting. It seems premature to say now that Petitioner could not access the other property by bridge or other means, because that was out of the scope of the project for which the 404/401 was sought. They are not now seeking to do that, but want to retain the option. I think the concern of the wetlands group may have been that they did not want to be interpreted as foregoing their ability to review any such plans in the future, but if that is the case, we need to clarify. Secondly, the language in the 401 does not necessarily suggest that any restriction be placed on land outside the project area, but there has been some correspondence exchange which may have implied otherwise. This we could probably handle by letter, or, to the extent we have to clarify the language in the certification on the first issue, we could take care of both issues with the clarification. Now, that being said, what I view as merely a clarification, the wetlands group may have a much different idea about, but that is what needs to be determined. My guess on this one is that we are going to be able to reach an understanding once we can get from DWQ staff exactly what they are concerned about, but if I am mistaken, we need to know that too. Hope your 4th Circuit argument went well. Petitioner has been waiting on this a while (I did find a letter I sent to you --considerably less detailed than this e-mail -- back in March. It should be noted that there is no wetland fill requested. The property is divided into four sections based on the presence of waters of the US. Three road crossings are necessary to access sections of the property bisected by these excavated ditches. The proposed impact is submitted under NWP 14 and will total less than 0.10 acre. There is no means by which to access the property without crossing these ditches. Therefore, this represents the least damaging and practicable alternative. In addition, you requested the applicant to discuss how wetlands will not be impacted in the areas depicted as "Future Phase". The initial design for this project depicted lots in these areas. I have advised the applicant to redesign these areas to avoid impacts to existing jurisdictional wetlands. The applicant is in the process of redesigning these areas and would like to proceed in phasing the development. The applicant seeks to build the infrastructure (i.e. construct roadways) and provide buildable lots in upland areas only. There are no designs for the future phases. The applicant is aware than any potential future wetland impacts will be viewed cumulatively for the project. The initial design of this project depicted approximately 8 acres of impacts to 404 wetlands/waters and CAMA AEC's. There has been significant avoidance and minimization demonstrated by the applicant to reduce impacts to environmental resources. The applicant is now only requesting the opportunity to cross ditches originally excavated to enhance DOT stormwater run-off.
