Dear John:
Per our recent telephone conversation, I am providing a revised 8.5x11 drawing with two lots
removed from the Sagewood Subdivision preliminary plan (the lots are bisected by an excavated
ditch). The revised drawing is consistent with the 11x17 drawing submitted with the original
application request. Please reference my May 3rd (2001) correspondence for additional
information regarding avoidance and minimization measures for the proposed project.
During our telephone conversation you also requested that restrictive covenants be placed upon
the areas depicted as future phases. The applicant does not have definitive plans for these areas at
this time and seeks authorization for the road crossings only. The applicant requests written
clarification of the authority or grounds by which restrictive covenants are required for areas
outside the proposed project area (i.e. `future phases'). This clarification will assist us with
providing your office the necessary information for the processing of the general certification.

ininacts to the triangularly-shaped parcel of land on the northeastern line of the Sagewood
' subdivision property be accounted for in the permit for Sagewood subdivision. Of course,
particularly because of the location of that parcel on the line, it is entirely possible that wetland
impacts associated with its future development might have no connection to the Sagewood
subdivision project. We recognize the legitimacy of the staff's concern with respect to
wetlands impacts attributable to integration of the triangularly-shaped parcel Wo the
Sagewood subdivision infrastructure. lHowever, access to this parcel from Creekwood, Road
would have no necessary connection to or necessarily be involved in a common plant of,
development with the Sagewood subdivision. Therefore, Futch Creek Properties, LLC; is
willing to accept, and believe the staff's legitimate concerns should be sufficiently addressed , . ._,

on which no lots are presently planned but which may never necessarily be integrated into the
Sagewood subdivision. For lots within the Sagewood subdivision on which jurisdictional
wetlands are located, and for any parcels that are not presently designated as lots but which
necessarily would be integrated into the Sagewood subdivision, deed notices will be prepared
pursuant to Condition 5. For those other parcels, we propose as the "similar Mechanism" a
notification to be provided at closing upon the sale of,these properties as follows:
Purchaser is hereby notified that in the event that the Property which is the subject of
this conveyance is to be developed and integrated into the Sagewood subdivision;

Dear Danny:
I am writing your office in an attempt to resolve any outstanding issues regarding the 401
Certification for Sagewood Subdivision. This is the fourth written correspondence I have
provided to your office on behalf of the applicant since the time of the application submittal.
Oftentimes during regulatory permit reviews, we receive letters requesting additional information
in which the reviewing agency notifies us that an application is placed on hold until such time
that the supplemental information is provided. The only written correspondence we have
received from your office was a form letter dated April 19, 2001. I responded to this letter on
May P. There has not been any written correspondence from your office since that time (144
days thus far).
The following is a chronology of events since the time of the application submittal:
(1) Application submitted February 26, 2001;
(2) Form letter from DWQ dated April 19, 2001;
(3) Repeated phone calls placed from LMG to DWQ Raleigh office from April 26`h to
May 15'h requesting clarification of information requested;
(4) Written correspondence dated May 3, 2001 from LMG to DWQ - Raleigh attempting
to provide information necessary for processing of 401 Ceritfication;
(5) May (2001) phone conversation with John Dorney. Mr. Dorney asks for revised 8.5
x 11 drawing with two lots to be removed ("lots are not buildable as shown");
(6) Written correspondence dated May 30, 2001 from LMG to DWQ - Raleigh. Revised
drawing (with two lots removed) is forwarded to DWQ as requested. Response to
request for restrictive covenants on future phases is also provided at this time;
(7) Repeated phone calls from LMG to DWQ (Raleigh and Wilmington offices) in July
2001 in an attempt to find out status of 401 Certification;

of New Forest Dr. Explanation provided at that time by Christian Preziosi of LMG;
(9) Written correspondence dated August 16, 2001 from LMG asking for written
notification of status of 401 Certification;
(10) Repeated phone calls (5) from LMG to DWQ during September 2001 inquiring about
status of 401 Ceritification.
The following is a summary of some of the related project issues:
The applicant has requested fill for 0.07 acres for three road crossings necessary to access his
property. This quantity of fill is under the threshold limit for a Section 404 PCN. The initial
design of the project depicted approximately 8 acres of impacts to 404 wetlands/waters and
CAMA AEC's. Upon advice from LMG, the applicant revised the plan such that only 0.07 acres
of fill is requested. This fill is necessary to cross severely incised ditches that were excavated
approximately 20 years ago (by other parties). These "waters" contribute to decreased water
quality of Futch Creek by serving as a direct conduit for sediment and nutrient loading from
upland sources (including US Highway 17). The applicant has made every attempt to avoid and
minimize impacts to wetlands and waters. In fact, the applicant is currently working with the
New Hanover County Tidal Creeks Program to develop a plan to restore functional bottomland
hardwood and stream habitat on-site. These negotiations have been severely jeopardized by the

All DWQ and CAMA field representatives that have visited the site have no objection to the
project as designed. During a phone conversation on August 16th, you had raised a question
regarding the placement of a cul-de-sac on New Forest Dr. (refer to site plan). As I had
responded to you at the time, the applicant had originally proposed a road crossing for the
adjacent wetland. Based upon advice from LMG, the applicant revised the project such that the
road would end in a cul-de-sac rather than crossing wetlands. As depicted on the plan, the cul-de-
sac stops before the wetlands and there are no lots planned around the cul-de-sac (as depicted on
the plan). The applicant is considering different means to access the future phase located on the
eastern side of this wetland area. The applicant intends to design a bridge or potentially access
this future phase from Creekwood Rd. (located to the northeast of the project site) so as not to
create adverse impacts to this wetland area. As is normally conditioned for NWP 14 401 General
Certifications, the applicant intends to place deed restrictions on all lots depicted on the site plan
to prevent future wetlands impact by individual lot owners.
I hope the information provided here is sufficient for the processing of the 401 Certification.

With respect to Condition number 5, DWQ can accept your redrafting of the one clause,
with one modification, the insertion of the word "will" which I highlight in bold. If you agree,
condition 5 will read as follows:
5. For lots within the Sagewood subdivision on which jurisdictional wetlands
are located, and for unplatted parcels on which jurisdictional wetlands
are located, which appear within the boundaries of the Sagewood
subdivision phase 1 plat and which adjoin and will have access to
Sagewood subdivision streets, the following notice shall be placed in the
deeds:
Jurisdictional wetlands are located on this
property. Authorization to impact the wetlands
must be obtained from the U.S. Army Corps of
Engineers and the N.C. Department of Environment
and Natural Resources. Any wetland impacts shall
be cumulative to the impacts permitted under the
404 permit issued by the U.S. Army Corps of
Engineers and the 401 certification issued by the
N. C. Department of Environment and Natural
Resources. To that extent, such cumulated impacts
may form the basis for mitigation requirements
imposed upon the developer or the purchaser, as a
result of reexamination of general certification

eligibility, potentially resulting in modification of
the certification and a requirement for an individual
404 permit.
For all other parcels containing jurisdictional wetlands, a notice
to the purchaser must be provided at closing on the sale of those
properties. The notice shall be signed by the Purchaser and a copy
shall be sent to the Division of Water Quality, referencing DWQ
Project #010315. The notice shall state as follows:
Purchaser is hereby notified that in the event that
the Property which is the subject of this conveyance
is to be developed and integrated into the Sagewood
subdivision, utilizing infrastructure installed as a
part of that subdivision, such development shall be
considered by the Division of Water Quality of the
N. C. Department of Environment and Natural
Resources to be part of a common plan of
development with Sagewood subdivision and any
wetland impacts shall be cumulative to the impacts
permitted under the 404 permit issued by the U.S.
Army Corps of Engineers and the 401 certification
issued by the N. C. Department of Environment and
Natural Resources for the Sagewood subdivision.
To that extent, such cumulated impacts may form
the basis for mitigation requirements imposed upon
the developer or the purchaser, as a result of
reexamination of general certification eligibility,
potentially resulting in modification of the
certification and a requirement for an individual
404 permit.
With respect to condition 4, we have agreed upon the following language:
4. As depicted on the site plans that accompanied the February 26, 2001
application, the cul-de-sac located at the terminus of road labeled as New
Forest Drive ends at the edge of an area of wetlands. The area located on
the other side of the wetland adjoining the cul-de-sac was indicated in a

connection with the construction of a road (including, but not limited to a
driveway) from the Sagewood subdivision to the afore described "future
development" area shall be considered part of a common plan of
development with the Sagewood subdivision and shall be cumulative to the
impacts authorized by this 401 certification. To that extent, such
cumulated impacts may form the basis for mitigation requirements or may
be used to reexamine eligibility for general certification thresholds,
potentially resulting in modification or revocation of this certification.
If you concur with this language, Danny Smith will modify the 401 as described today
and seek to obtain Mr. Domey's signature as soon as he returns to the office. Upon the receipt
of the modified 401, we need your agreement to file a Notice of Withdrawal of your client's
Petition with the Office of Administrative Hearings. There is no need for you to draft a
Settlement Agreement once we reach agreement on the wording and you agree to filing a Notice
of Withdrawal upon receipt of the modified 401.

You have our approval, in accordance with the attached conditions and those listed below, to place
fill material in 190 linear feet of streams as depicted in the Pre-Construction Application dated Feburary 26,
2001 (received March 2, 2001) for the placement fill for three road crossings on the tract know as the
Sagewood Subdivision at US 17 between Futch Creek Rd. and Creekwood Rd. in New Hanover County,
North Carolina. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3289. This certification allows you to use Nationwide Permit Number
14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us a
new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. In order to prevent violations of the turbidity standards (50 NTU's in streams and rivers not
designated as trout waters by DWQ; 25 NTU's in all saltwater classes, and all lakes and
reservoirs;) compliance Division of Land Resources is required.
2. Approved _sediment and erosion control devices and practices which equal or exceed those
outlined in the most recent version of the "North Carolina Sediment and Erosion Control
Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from
the Division of Land Resources in the DEHNR Regional or Central Offices) shall be properly
implemented.
3. Waste, spoil or fill shall not be placed, dumped or located in wetlands or waters beyond the
footprint of ditches proposed for fill as depicted in Pre-Construction Notification Application
dated February 26, 2001.

4. As depicted on the site plans that accompanied the February 26, 2001 application, the cul-de-
sac located at the terminus of road labeled as New Forest Dr. must end no further than the
edge of the wetlands. Further, as indicated in your September 24, 2001 additional information
response, no lots are proposed to be platted around the end of the cul-de-sac. Also, no
additional impacts are proposed to result from access of the area depicted as "future
development". Specifically, future impacts as a result of road crossings or bridges will not
occur from either New Forest Dive or access of this phase from Creekwood Road.
Accordingly, these stipulations are incorporated as respective conditions of this certification.
5. Wetland deed notification or some other similar mechanisms is required to be placed on all
lots with jurisdictional wetlands with in 120 days of the date of the certification issuance.
6. All sediment and erosion control measures placed in wetlands or waters shall be removed and
the natural grade restored after the Division of Land Resources releases the project or the
project is determined to stabilized.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

On April 19, 2001, this office requested additional information to address the area
labeled as "future phase" on the February 26, 2001, Pre-construction Application. A
written response was received by this office (dated May 3, 2001; received May 8, 2001)
indicating that a future phase was in process of being redesigned, that Futch Creek
Properties would like to proceed with phasing the development, and that all lots would be
buildable and located in upland areas. Finally, in a May 30, 2001(see attached),
correspondence stated that we will not be able to issue this 401 Certification until the
redesign is completed and submitted for review. '
Also, you explained in your August 16, 2001, correspondences that you have
provided two other correspondences to this office, dated May 3, 2001, and May 30, 2001.
This Office's files do not indicate a correspondence received from you dated May 30,
2001.
With respect to Sagewood Subdivision, the road labeled New Forest Dr. dead-
ends at a cul-de-sac adjacent to wetlands. Typically, cul-de-sacs have lots surrounding
the "turn around" area in an effort to provide efficient lot presentation and infrastructure
placement. In this instance it appears that no lots are proposed on the wetlands side of
the cul-de-sac. Rather, it appears that a future road crossing is proposed. Please provide
a written response within 15 days of receipt of this letter. This response should provide
specifically address of each of the following items:
_ 1) _ Please indicate_ whether a_road crossing will _occur_beyond the-terminus of the___
currently proposed New Forest Drive. If a road crossing is to be installed beyond the
proposed cul-de-sac location please modify your maps, plans, and application
accordingly. If no impacts are proposed beyond the cul-de-sac on New Forest Drive
please indicate the alternative access and lot layout to the area indicated as "future
phase" such that impacts from a road crossing or new lots additions to wetlands or
waters are avoided.
2) If no road crossing -is proposed beyond the New Forest Drive cul-de-sac please
indicate if you wish to redesign the placement of your cul-de-sac and lot
configuration.
3) You should also provide documentation such as maps, narratives, and any additional
information that you feel is appropriate for your project in our review of your 401
Certification.

design will need to be done and all wetland impacts applied for before we can issue

5) Finally, it is this office's understanding that you have discussed this matter with Rick
Shiver, Water Quality Supervisor of Wilmington Regional Office and that you desire
to address this matter through the use of deed restrictions. This is satisfactory with
this office. However, it will be necessary for you to provided plans that accurately
show all lots in the area labeled as "Future Phase", any wetland fill (if any) needed to
make these lots buildable, the placement of the cul-de-sac and wetlands within each
lot.
Finally, in your letter you indicated the intent of the applicant to violate the North
Carolina Administrative Code by proceeding with the project if a written response is not
received within in two weeks. Please note that violations of a 401 Certification, failure
to properly secure a 401 Certification, violations of wetland, and stream standards are
subject to civil penalty assessment of up to $25,000.00 a day for each day the violation
continues. Accordingly, it is a concern of this office that this development may chose to
proceed in a manner in the future that would violate Administrative Codes. This office
intends to conduct appropriate follow-up compliance reviews in coordination with
Regional Office staff to help affirm compliance with Administrative Code.

This case involves a project in New Hanover County. The Petitioner (Futch
Creek Properties LLC) received a 401 -certification dated November 5, 2001.
A contested case petition was filed in order to preserve the petitioner's
rights while an answer was sought to a question which was posed by Christian
Preziosi of Land Management Group in a series of conversations and letters
to John Dorney and Danny Smith. The issue has to do with a demand that
restrictive covenants be placed on property not part of the Sagewood
Subdivision project, and an apparent prohibition on "future impacts as a
result of road crossings or bridges . . . from either New Forest Drive or
access of this phase from Creekwood Road." Mr. Preziosi was seeking
clarification to these issues. The petitioner (1) wants to retain the
option in the future to access from New Forest Drive or Creekwood Road by
bridge or other means without impact to wetlands areas to connect to
property not within the project; and (2) does not wish to place restrictive
covenants on property outside the project area.
The Petitioner recognizes that any development of adjoining property would
require additional review and permitting. It seems premature to say now
that Petitioner could not access the other property by bridge or other
means, because that was out of the scope of the project for which the
404/401 was sought. They are not now seeking to do that, but want to retain
the option. I think the concern of the wetlands group may have been that
they did not want to be interpreted as foregoing their ability to review any
such plans in the future, but if that is the case, we need to clarify.
Secondly, the language in the 401 does not necessarily suggest that any
restriction be placed on land outside the project area, but there has been
some correspondence exchange which may have implied otherwise. This we
could probably handle by letter, or, to the extent we have to clarify the
language in the certification on the first issue, we could take care of both
issues with the clarification.
Now, that being said, what I view as merely a clarification, the wetlands
group may have a much different idea about, but that is what needs to be
determined. My guess on this one is that we are going to be able to reach
an understanding once we can get from DWQ staff exactly what they are
concerned about, but if I am mistaken, we need to know that too.
Hope your 4th Circuit argument went well. Petitioner has been waiting on
this a while (I did find a letter I sent to you --considerably less detailed
than this e-mail -- back in March. I expect it got lost in the shuffle and
I have not followed up as I should), so I would appreciate it if we can get
on this as soon as you can when you get back from Richmond. If you are
headed up to Asheville, maybe we can talk about it then.

The Division of Water Quality has reviewed your plans for the discharge of fill material
into an unreported amount of wetlands located at Sagewood Subdivision in New Hanover County
for residential development as described in your application dated March 2, 2001. Insufficient
evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the
proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as
incomplete until we receive this additional information, we are requesting (by copy of this letter)
that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must
be constructed as planned and that you have no practicable alternative to placing fill in these
waters and/or wetlands. Specifically your May 8, 2001 response states that redesign of the
"Future Phase" area is proceeding. DWQ will not be able to issue this 401 Certification until that
redesign is done and submitted for review. Any documentation such as maps and narrative that
you can supply to address alternative designs for your project may be helpful in our review of your
401 Certification.

This letter is in response to your request for additional information regarding proposed road
crossings at a site development located east of US Highway 17 in northern New Hanover County,
NC. After repeated attempts to contact you, I am supplying the following information that may
assist with your processing of the 401 Certification request.
Your letter dated April 19, 2001 states, "Insufficient evidence is present in our files to conclude
that your project must be built in waters and/or wetlands." It should be noted that there is no
wetland fill requested. The property is divided into four sections based on the presence of waters

excavated ditches. The proposed impact is submitted under NWP 14 and will total less than 0.10
acre. There is no means by which to access the property without crossing these ditches.
Therefore, this represents the least damaging and practicable alternative.
In addition, you requested the applicant to discuss how wetlands will not be impacted in the areas
depicted as "Future Phase". The initial design for this project depicted lots in these areas. I have
advised the applicant to redesign these areas to avoid impacts to existing jurisdictional wetlands.
The applicant is in the process of redesigning these areas and would like to proceed in phasing the
development. The applicant seeks to build the infrastructure (i.e. construct roadways) and
provide buildable lots in upland areas only. There are no designs for the future phases. The
applicant is aware than any potential future wetland impacts will be viewed cumulatively for the
project.
The initial design of this project depicted approximately 8 acres of impacts to 404
wetlands/waters and CAMA AEC's. There has been significant avoidance and minimization
demonstrated by the applicant to reduce impacts to environmental resources. The applicant is
now only requesting the opportunity to cross ditches originally excavated to enhance DOT

stormwater run-off. DWQ field representatives visited the site and did not provide any negative
comments regarding the request for the 401 certification.
Since I have not received any response from you clarifying your request for additional
information, I trust that the information contained in this letter will be sufficient for your
processing of this application.

The Division of Water Quality has reviewed your plans for the discharge of fill material
into an unreported amount of wetlands located at Sagewood Subdivision in New Hanover County
for residential development as described in your application dated March 2, 2001. Insufficient
evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the
proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as
incomplete until we receive this additional information, we are requesting (by copy of this letter)
that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must
be constructed as planned and that you have no practicable alternative to placing fill in these
waters and/or wetlands. Specifically can you discuss how wetlands will not be impacted in the
acres shown as "Future Phase" on the site plan? Any documentation such as maps and narrative
that you can supply to address alternative designs for your project may be helpful in our review of
your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this
information to me and one copy to Joanne Steenhuis, Wilmington Regional Office at (910) 395-
3900. If we do not hear from you in three weeks, we will assume that you no longer want to pursue
