APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Parker:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 520 linear feet
of streams for the purpose of constructing the shops of Winslow Bay at Hwy 150 near 1-77 as described in your application dated April
23, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers
3287 and 3289. These certifications allow you to use Nationwide Permit Number 14 and 39 when the Corps of Engineers issues them.
In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you
change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below. '
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in
order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the
date of this letter or the issuance of the 404 Permit (whichever is later).
2. An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts
specified in this Certification occur. The stormwater management plan must include plans and specifications for stormwater
management facilities which must include and extended detention wetlands designed to remove 85% TSS according to the most
recent version of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied
at the subject site, the facilities, as approved by this Office, shall be constructed and operational, and the stormwater management
plan, as approved by this Office, shall be implemented.
3. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify
DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached
form and return it to the 401/Wetiands Unit of the Division of Water Quality.
4. A grade control structure must be installed below the uppermost wetlands to prevent stream head cutting.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

I was faxed a response to our on hold letter for The Sops of Winslow
Bay; 01 00626; Iredell. I met with the engineer and as the letter
explains, the location of the entrance road off NC 150 and the highway
access for adjacent properties as approved by NCDOT will impact the
wetlands that I wanted to preserve regardless. They have indicated that
the stormwater / wetland they propose to construct downstream will
mitigate for the loss of the wetland as well as treat the offsite
stormwater coming down the channel. Therefore, I recommend that we
issue the 401 contingent upon the contruction of the stormwater
facility.
You should also find comments for Long Bay S/D, Bridgewater ; 01 1106;
Catawba Co. on filemaker.

Dear Mr. Parker:
The Division of Water Quality has reviewed your plans for the discharge of fill material
into 520 linear feet of streams and 0.03 acres of wetlands located at NC 150 near 1-77 in Iredell
County for construction of the shops of Winston Bay. Insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with
15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described
below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H
.0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place
your project on administrative hold.
Please provide us with information supporting your position that states your project must
be constructed as planned and that you have no practicable alternative to placing fill in these
waters and/or wetlands. Specifically can you
1. move the entrance road off of NC 105 westward to avoid wetland impact,
2. install a grade control structure below the uppermost wetlands to prevent stream
headcutting and
3. contruct a constructed wetland instead of a wet detention pond since this a WS-IV
watershed and
4. comply with all buffer requirements of the water supply rules on perennial stream show on
USGS topo maps?
Any documentation such as maps and narrative that you can supply to address
alternative designs for your project may be helpful in our review of your 401 Certification
. Please respond within three weeks of the date of this letter by sending a copy of this
information to me and one copy to Peter Colwell, Mooresville Regional Office at (704) 663-1699. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this
project and we will consider the project as withdrawn. If you have any questions, please telephone ,.

allowed assuming no practical alternatives, and bua must be minimized, stormwater must be
diverted away from surface waters, and DOT must useffollow their BMPs document.

plan, but local govt can be more protective. If SEC plan is needed, must comply with bua/buffer
requirements.
010626 (S&EC Consultants, Inc., Iredell Co.) - the site is most likely in the WS-IV-CA of Lake
Norman. No new roads in CA to the extent practicable; if allowed must minimize bua, divert
stormwater, use BMPs. Private roads must be included in the bua calculations. The state

The purpose of this letter is to request the use of Nationwide Permit 39 for construction of the
proposed The Shops of Winslow Bay project. The proposed The Shops of Winslow Bay
project is located west of Mooresville, NC off Highway 150 near Interstate I-77 (35°35'53.52 N,
80-52'15.30" W). The site is shown on the attached USGS Topo Quad vicinity map.
Construction of the project will comply with all of the general conditions stated within
Nationwide Permits 14 and 39.
Proposed permanent impacts to jurisdictional waters will total 0.30 acres for impacts associated
with road crossings, pond dam construction, flooding, and a storage facility. Proposed stream
channel impacts total 520 linear feet and are associated with either water quality pond
construction (125 If) or pond flooding (395 If). The proposed water quality pond will contain a rn
fore bay and littoral shelves. Final stormwater plans will be furnished by Jeff Roach at R.L. r r"r 1
Horvath & Associates (919) 490-4990. Proposed stormwater treatment will be designed to O
remove 85% TSS as per the latest version of DWQ's Stormwater best Management Practices
manual.
Minimization and avoidance can be demonstrated through the dedication of 19 acres of high
quality real estate as common area for a park. In addition, plans call for the use of arched culverts
and avoid impacts to perennial channels (see justification letter). In the opinion of S&EC,
proposed channel impacts will occur on non-significant channels (lack aquatic life). Project
planners propose 400 feet of arched culvert with no impact to Waters (see attached).
Included are: (1) a completed Pre-Construction Notification application, (2) signed Agent
Authorization Form, (3) USGS Site Vicinity Map, (4) Site Plans, (5) Justification Letter, (6)
Wetland Data Forms, and (7) a check for $475 to NCDWQ for 401 fees.

the property (for Nationwide Permit numbers 14, 18, 21, 26, 29 and 38). All
streams (intermittent and permanent) on the property must be shown on the
map. Map scales should be 1 inch equals 50 feet or 1 inch equals 100 feet or
their equivalent
b. If available, representative photograph of wetlands to be impacted by project.
C. If delineation was performed by a consultant, include all data sheets relevant
to the placement of the delineation line.
d. Attach a copy of the stormwater management plan, if required.
e. What is land used of surrounding property? Residential and Commercial
f. If applicable, what is proposed method of sewage disposal? Municipality
g. - Signed and dated agent authorization letter, if applicable.
NOTE: Wetlands or Waters of the U.S. may not be impacted prior to:
1. Issuance of a Section 404 Corps of Engineers Permit,
2. Either the issuance or waiver of a 401 Division of Environmental
Management (Water Quality) certification, and
3. (in the twenty coastal counties only) A letter from the North Carolina
Division of Coastal Management stating the proposed activity is consistent
with the North Carolina Coastal Management program.

The Shops of Winslow Bay is a 450,000 SF Retail Development placed on 52.33 acres located
near the intersection of Highway 150 and Interstate 77 in Mooresville, NC. This letter is to discuss
the justification for the wetland impacts requested in the Preconstmction Notification being
submitted by S&EC for this project. We request that DWQ and USACE issue the requested 401
and 404 permits for the following reasons:
• The overall project limits consists of 71.36 acres with 12,000 sf of jurisdictional waters
located on site. We have redesigned the Site Plans three times in order to minimize and
avoid possible impacts incurred by this development. The original Site Plan included the
filling of all wetlands and 1,574 if of channels on our site. Upon confirmation of the
location of the wetlands and channels by S&EC, retaining walls, steel arch pipes and the
relocation of the proposed buildings and parking spaces were included in the revised
designs to minimize the impacts on the wetlands and channels.
• The driveway crossing from Highway 150 has been located to minimize the impact of the
grading work on the channel. To eliminate impacts on the existing channel associated with
the driveway crossing from Highway 150, a Low Profile Steel Arch Pipe is proposed for
this crossing. The remaining impacts include construction of the slopes necessary to place
the amount of fill necessary to install the arch pipe. According to the delineation
completed by S&EC, there are 4,185 if of stream channel on site. The proposed impacts
to these channels include 5201f of stream impacts, including 3951f attributed to "flooding"
because of the new water quality pond while the remaining 125 if are for the pond's dam
and forebay grading work. According to S&EC, the impacts are proposed for non-
significant stream channels. The impacts on the non-significant stream are minimized
while also providing water quality treatment for the site and upstream drainage area.
• This site is subject to the requirements of Section 14 of the Town of Mooresville Zoning
Ordinance; NC Legislature Chapter 160A, Article 8, Section 174, General Ordinance
Authority; and NC Legislature Chapter 143, Article 21, Watershed Protection Rules for
development in Protected and Critical Watershed Districts for Lake Norman and the
Catawba River. A water quality pond is designed for construction in the existing channel
and will treat 10.09 acres of upstream drainage areas along with 100% of the proposed

shopping center development. See attached Wetland Impact Maps for the location of the
proposed Water Quality Pond.
• There are 2,597 If of channels located on this site that are subject to the buffer
requirements as established in Section 14 of the Town of Mooresville Zoning Ordinance
which restricts development within a 100 foot buffer along stream channels. The
construction of the water quality pond will be located in this buffer with permission from
the Town of Mooresville with vegetation remaining in all other areas of the channel.
• The total site area is 71.36 acres with 19.21 acres being dedicated to the Winslow Bay
Homeowner's Associates for use as Public Open Space, Recreation Areas, Landscape
Areas and a Homeowner's boat storage facility.
Due to the items listed above, our request for the issuance of the appropriate Nationwide
Permits is reasonable and justified. Please contact our wetlands consultant, Wendell Overby with

The purpose of this letter is to request the use of Nationwide Permit 39 for construction of the
proposed The Shops of Winslow Bay project. The proposed The Shops of Winslow Bay
project is located west of Mooresville, NC off Highway 150 near Interstate I-77 (35°35'53.52 N,
80°52' 15.30" W). The site is shown on the attached USGS Topo Quad vicinity map.
Construction of the project will comply with all of the general conditions stated within
Nationwide Permits 14 and 39.

Proposed permanent impacts to jurisdictional waters will total 0.30 acres for impacts associated rT1
with road crossings, pond dam construction, flooding, and a storage facility. Proposed stream
channel impacts total 520 linear feet and are associated with either water quality pond = r rt
construction (125 If) or pond flooding (395 If). The proposed water quality pond will contain a v
fore bay and littoral shelves. Final stormwater plans will be furnished by JeffRoach:at R.L.
Horvath & Associates (919) 490-4990. Proposed stormwater treatment will be designed to
remove 85% TSS as per the latest version of DWQ's Stormwater best Management Practices
manual.
Minimization and avoidance can be demonstrated through the dedication of 19 acres of high
quality real estate as common area for a park. In addition, plans call for the use of arched culverts
and avoid impacts to perennial channels (see justification letter). In the opinion of S&EC,
proposed channel impacts will occur on non-significant channels (lack aquatic life). Project
planners propose 400 feet of arched culvert with no impact to Waters (see attached).
Included are: (1) a completed Pre-Construction Notification application, (2) signed Agent
Authorization Form, (3) USGS Site Vicinity Map, (4) Site Plans, (5) Justification Letter, (6)
Wetland Data Forms, and (7) a check for $475 to NCDWQ for 401 fees.

The Shops of Winslow Bay is a 450,000 SF Retail Development placed on 52.33 acres located
near the intersection of Highway 150 and Interstate 77 in Mooresville, NC. This letter is to discuss
the justification for the wetland impacts requested in the Preconstruction Notification being
submitted by S&EC for this project. We request that DWQ and USACE issue the requested 401
and 404 permits for the following reasons:
• The overall project limits consists of 71.36 acres with 12,000 sf of jurisdictional waters
located on site. We have redesigned the Site Plans three times in order to minimize and
avoid possible impacts incurred by this development. The original Site Plan included the
filling of all wetlands and 1,574 if of channels on our site. Upon confirmation of the
location of the wetlands and channels by S&EC, retaining walls, steel arch pipes and the
relocation of the proposed buildings and parking spaces were included in the revised
designs to minimize the impacts on the wetlands and channels.
• The driveway crossing from Highway 150 has been located to minimize the impact of the
grading work on the channel. To eliminate impacts on the existing channel associated with
the driveway crossing from Highway 150, a Low Profile Steel Arch Pipe is proposed for
this crossing. The remaining impacts include construction of the slopes necessary to place
the amount of fill necessary to install the arch pipe. According to the delineation
completed by S&EC, there are 4,185 if of stream channel on site. The proposed impacts
to these channels include 5201f of stream impacts, including 3951f attributed to "flooding"
because of the new water quality pond while the remaining 125 if are for the pond's dam
and forebay grading work. According to S&EC, the impacts are proposed for non-
significant stream channels. The impacts on the non-significant stream are minimized
while also providing water quality treatment for the site and upstream drainage area.
• This site is subject to the requirements of Section 14 of the Town of Mooresville Zoning
Ordinance; NC Legislature Chapter 160A, Article 8, Section 174, General Ordinance
Authority, and NC Legislature Chapter 143, Article 21, Watershed Protection Rules for
development in Protected and Critical Watershed Districts for Lake Norman and the
Catawba River. A water quality pond is designed for construction in the existing channel
and will treat 10.09 acres of upstream drainage areas along with 100% of the proposed

shopping center development. See attached Wetland Impact Maps for the location of the
proposed Water Quality Pond.
There are 2,597 if of channels located on this site that are subject to the buffer
requirements as established in Section 14 of the Town of Mooresville Zoning Ordinance
which restricts development within a 100 foot buffer along stream channels. The
construction of the water quality pond will be located in this buffer with permission from
the Town of Mooresville with vegetation remaining in all other areas of the channel.
The total site area is 71.36 acres with 19.21 acres being dedicated to the Winslow Bay
Homeowner's Associates for use as Public Open Space, Recreation Areas, Landscape
Areas and a Homeowner's boat storage facility.
Due to the items listed above, our request for the issuance of the appropriate Nationwide
Permits is reasonable and justified. Please contact our wetlands consultant, Wendell Overby with
S&EC, if you have any questions or need any additional information.

Dear John:
On 16 July 2001, a meeting was held between Pete Colwell with the Mooresville office
of DWQ, Wendell Overby with S&EC and myself concerning your comments dated 30
May 2001 on the proposed impacts for the aforementioned project.
Our only concern was with comment #1 relative to the westward shift of the NC 150
entrance drive to miss a small wetland. We have been in discussion with NCDOT
regarding the driveway location and access points off NC 150 for the land on either side
of our entrance. NCDOT is restricting access to NC 150 for our neighbor to the east and
west and requiring a connection off the driveway a minimum 250 feet off NC 150.
(Please see the attached drawing showing the drive connections) The location of this
drive, even with the entrance shift will apparently impact the wetlands. We are proposing
a water quality (wetlands) pond in a location that will service not only our site but also
13+acres of upstream land east and south of our site including the area served by the
impacted wetlands. It is our belief that the benefits received by the constructed wetlands
will greatly offset negative impacts of the existing wetland.
The remaining three comments: (2) the installation of a grade control structure; (3)
incorporation of constructed wetlands with the water quality pond; and (4) comply with
the associated buffer requirements will be incorporated into our Construction Documents.
We expect to complete the CD's within the next 30 days and will submit all supporting
calculations and drawings to your office for final review.
