Proposed lake on Vista property at Bills Mountain
Application for certification under Section 401 of the Clean Water Act
Dear Ms. Karoly:
I urge you to deny certification for the construction of the subject dam and lake.
My land abuts the subject property exactly downstream of the proposed dam on what my
family has always known as Cedar Branch, which is, in fact, the name of my farm. This
stream runs through my pastures, under US 64-74A Highway, and thence into the Broad
River. It is the primary source of water for my horses.
Horses will not drink muddy water. As far as I can determine, my stream would essentially
run dry while the subject lake was filling, which would be an extreme hardship for me and
my horses, even assuming it eventually returned to normal flow and clarity.
If the subject dam were ever to fail, the potential threat to my land and livestock is obvious.
I'm sure you are aware of the potential for washing away sections of US 64-74A Highway as
well as potentially devistating effect on local fish and wildlife in the Broad River.
I feel the potential danger in allowing the construction of the subject lake far outweighs any
future advantage that might accrue to the public. In fact, it appears to me that my safety,
water supply and property value as well as the safety and integrity of the public highway and
Broad River Ecosystem would be sacrificed, primarily to increase the future land sale price
for the developers of Vista. Is this tradeoff fair? I don't think so.
