Reference the application of City of Wilmington and New Hanover County for a Department of the Army permit to expand the James A. Loughlin Northside Wastewater Treatment Plant (WWTP) facilities and construct an additional 19,400 linear feet of 30 inch PVC force main from the plant to the outfall located at the Cape Fear River, in Wilmington, New Hanover County, North Carolina. The US Army Corps of Engineers have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. This includes the project revision dated May 4, 2005, for the Smith Creek utility line crossing (directional bore) and placement of the outfall structure behind the US Army Corps of Engineers Cape Fear Harbor Line. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 3. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing. activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 5. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 6. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not 2 considered significant. 11. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 2. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 13. The West Indian manatee (Trichechus ntanatus), which is listed as a federally endangered species, has been reported in the waters of New Hanover County. In order to protect the West Indian manatee all work in the Cape Fear River should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed. 14. The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within (30) working days of the project completion. 15. The Permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The Permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. Below is a response to each of your concerns: 1. Please provide plans clearly showing the ne?v easement areas located iti jurisdictional wetlands and located outside of the allotivable 10' maintenance corridor. For all easement areas that exceed the 10' maintenance corridor in jurisdictional wetlands, please provide an explanation for why more than 10' is necessary for a maintenance easement. III addition, please quantify the total area of wetlands to be maintained outside of this 10' allolvable corridor. If the area exceeds one acre, mitigation may be required. The City of Wilmington and New Hanover County are proposing a 20' maintained corridor along the force main route, which is the minimum maintenance width allowed by the County. This project will result in 0.172 acre of temporary impacts (30'-wide construction easement) and 0.112 acre of permanent impacts (20'-wide maintained corridor) to 404 wetlands (please see the enclosed figures). 2. Please quanta separately the total area of proposed temporary impacts to 404 wetlands, coastal wetlands, and streams Please clearly identify and depict these temporary impacts on the site plaits. Because the City and the County now plan to directionally drill the force main under Smith Creek and its adjacent wetlands, proposed wetland impacts have been greatly reduced. The applicant is proposing 0.172 acre oftemporary impacts (30'-wide construction easement) and 0.11 acre of permanent impacts (20'-wide maintained corridor) to 404 wetlands. No coastal wetlands or streams will be impacted. 3. Anti-seep collars are not shown on the plaits. Please show on the plans where anti-seep collars will be installed in accordance with the following condition (WQC#3374), and provide a detail. Enclosed are drawings showing the location of anti-seep collars. 4. Water Quality Certification #3402 states the following: "Any wasteivater line that crosses any stream shown on the most recent version of the 1:24, 000 USGS topographic map or MRCS (SCS) County Soil Survey as permanent or intermittent shall be installed with no joints connected within the footprint of a stream channel or within 2 feet of the stream batiks. Otherwise, written concurrence from DWQ is required. " It has been deternined by this office that installation of numerous joints (20+) within the footprint of Sniith Creek is not acceptable. In addition, it has not been demonstrated adequately to this office that directionally drilling the force rttain belotiv Smith Creek is not a viable option. The applicant has revised the project and now plans to directionally drill the force main under Smith Creek. 5. It is the understanding of this office that the current project as proposed is not acceptable to the US Army Corps of Engineers (USACE) as previously discussed at the pre-application meeting Please discuss the necessary revisions to the proposed projectwithHenty Wicker of the USACE, and submit a copy of all revised plans along with the it formation requested above. Based on comments that we received from the U.S. Army Corps of Engineers and the Division of Water Quality during a meeting on January 28, 2005, revisions were made to the project. The applicant modified the diffuser location within the Cape Fear River and has agreed to cross Smith Creek via directional drill. Site maps that demonstrate these revisions were sent to the Corps, DWQ, and DCM in May of 2005. 2 We hope this letter adequately addresses all of your questions regarding theNorthside WWTP project. Loughlin WWTP Upgrade and Expansion }'FTUt'i?3?y'a s7C)W-MMi R riWXH Smith Creek Crossing Dear Mr. Caldwell: This letter is being written in response to a letter received by this office on April 25, 2005, from McKim and Creed, requesting written clarification as to the Division of Water Quality's position on installing the proposed force main under Smith Creek via directional drill versus open cut. Please note that the CAMA Major application received by DWQ on September 29, 2004, did not request an open cut across Smith Creek due to previous comments form the NC Division of Marine Fisheries. The application requested to lay ball and joint ductile iron pipe and allow the pipe to settle 1-2 feet below the mud bottom. The use of ball and joint pipe within the footprint of the stream channel is not allowed under the General Water Quality Certification for utility lines. Joints within the stream channel can be considered on a case-by-case basis by DWQ, but written concurrence is required. Due to the length of the sewer line crossing the stream and the number of the joints proposed (450 linear feet of pipe and more than 20 joints), the width and depth of the Smith Creek at this location, and the fact that the US Army Corps of Engineers requires the pipe be located at least two feet below the streambed, this office was not willing to give written concurrence for the project as proposed. Reference in the letter from McKim and Creed is made to the fact that a FONSI was issued on this project. The issuance of a FONSI does not mean that the project complies with all conditions of the local, state and federal permits required. Thank you for your cooperation on this matter. City of Wilmington and New Hanover County Northside Wastewater Treatment Plant Page Two PROJECT DESCRIPTION The project site is located at the James A. Loughlin Northside Wastewater Treatment Plant facility on North 23`d Street adjacent to Smith Creek and the Cape Fear River in New Hanover County. To locate the property travel north approximately four miles from Market Street (US Highway 17) on 23`d Street towards the New Hanover County International Airport. The project entrance will be located on the left at 2311 N. 23`d Street. The applicants' facility is on a 43 acre tract of land which averages approximately 25 feet above mean sea level. Highground development on the tract consists of existing buildings and associated treatment structures. Buildings include an administration and maintenance facility located at the northeastern entrance. Associated structures include an anaerobic digester and sludge storage facilities located behind the administration building; an aeration tank and blower building located on the southern end adjacent to 23`d Street; two secondary clarifiers and a effluent pump lift station which serves the existing force main. Along the southwest end of the treatment facility the project corridor includes approximately 12.2 acres of high ground for facilities expansion, including approximately 4.5 acres for the sewer line easement and lift station. The project corridor towards the Northeast Cape Fear River would follow along the Seaboard Coastline Railroad, N.C. Department of Transportation Smith Creek Project and CP&L right-of-ways. Also proposed includes a 30' utility right-of-way with a 10' construction easement on both sides of the right-of-way extending from the existing lift station site approximately 19,400 linear feet to the terminus of the project at the Cape Fear River. Vegetation within the corridor near the lift station site consists of hardwood species including Bald Cypress (Taxodium distichum), Black Gum (Nyssa sylvatica), Pond Pine (Pinus serotina) and Sycamore (Platanus occidentali). High marsh vegetation along the shoreline of Smith Creek consists of mixed coastal and "404" type wetlands. 404 wetlands were delineated and approved by the Army Corps.of Engineers on October 5, 2001. Wetland species were primarily of Narrow-leaved Cat-tail (Typha angustifolia), Saw Grass (Cladium jamaicense), Salt Reed Grass (Spartina cynosuroides) and Bull Rush (Scirpus, spp.). A small band of Smooth Cordgrass (Spartina alterniora) approximately 25 feet wide is located at the terminus end of the project at the Cape Fear River, waterward of an existing headwall. The Wilmington-New Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those areas above the 100 year flood elevation as Urban Transition. The waters of the Cape Fear River are classified as SC Swamp waters and the waters of Smith Creek are classified as C Swamp waters@ by the Division of Water Quality from the source to the Cape Fear River. Smith Creek is considered Inland Waters by cooperative agreement between Division of Marine Fisheries and North Carolina Wildlife Resources Commission. The Division of Marine Fisheries classifies the waters within Smith Creek and the Cape Fear River as Primary Nursery Area (PNA) and it is closed to the taking of shellfish. City of Wilmington and New Hanover County Northside Wastewater Treatment Plant Page Three PROPOSED PROJECT: The applicants propose to expand the James A. Loughlin Northside (WWTP) facilities and construct an additional 19,400 linear feet of 30 inch PVC force main from the plant to the outfall located at the Cape Fear River. The proposed project would expand the plant's existing permitted capacity of 8.0 million gallons per day (MGD) to 16.0 MGD. The proposed force main would follow the same alignment of this existing force main along Smith Creek, which would terminate to a proposed new outfall. The proposed outfall would be installed adjacent to the existing outfall located near the Coastline Convention Center on the Cape Fear River. The 30 inch effluent force main would be installed adjacent to an existing 30 inch force main from the treatment facility to the existing lift station located at Walnut Street and would terminate at the landward toe of the shipping channel of the Cape Fear River. The sections of the force main crossing Smith Creek and part of the Cape Fear River would incorporate 30 inch ball and joint ductile iron pipes. The section crossing Smith Creek would be laid beneath the surface mud bottom approximately 1-2 feet at no greater of an angle (stress point) than 15 degrees. This method would allow the PVC pipes to settle before connection without trenching creek bottom. The section on the Cape Fear River would be accomplished with a directional bore under the river bottom approximately 4 feet in depth and terminate at a new effluent diffuser "T", which would run perpendicular to the shipping channel and be aligned approximately 8 feet landward of the toe of its slope. The 19,400 linear foot corridor consists of a 30' wide utility right of way with 10' wide construction easements on each side of the right of way. Disturbance within the corridors would involve the use of a mechanical excavator (backhoe) to trench, place bedding sand and stone, bed pipe, and backfill to original grade. The applicant states that logging mats would be used to reduce damage from heavy equipment and all disturbed areas would be re- vegetated immediately after backfilling per the erosion control plan. Proposed upgrades to the treatment plant facility would include new mechanical bar screens with 1/8 inch openings and high efficiency fine grit removal; primary clarifiers and new primary sludge pumps; secondary, or biological, treatment would be implemented by adding suspended growth activated sludge for carbonaceous BOD and ammonia reduction by nitrification. Two secondary clarifiers would be added adjacent to the existing secondary clarifiers with a new return activated sludge pump station; a new effluent pump station would be added to the existing effluent pump station for the proposed force main; a rotary drum dryer for the primary treatment and stabilization method for sludge that will produce a Class A sludge; a new anaerobic digester adjacent to the existing digester and a single stage wet scrubber for odor removal of both influent and the sludge. The proposed effluent pump station and force main from the WWTP are within the 30 foot Coastal Shoreline AEC. A portion of the force main and diffuser located at the outfall on the Cape Fear River is within the 75 foot Estuarine Shoreline AEC. Upland facility upgrades are located outside CAMA AEC. The Division of Land Resources has issued a Letter of Approval for the sedimentation and erosion control plan for the project. The Division of Water Quality has issued a previous state NPDES Permit # N00023965 for the existing force main. The Division of Water Quality issued a Finding of No Significant Impact (FONSI) an Environmental Assessment (EA) submitted on October 7, 2003. These are prerequisites for the issuance of a NPDES Discharge Permit and 401 Water Quality Certification by the Division of Water Quality. 10. ANTICIPATED LV PACTS The installation of the 30 inch force main would result in the excavation of approximately 1.2 acres of mixed coastal/404 wetlands and approximately 0.026 acres of creek bottom. All areas will be returned to the original grade and will be re-vegetated immediately upon backfilling. If construction is timed to avoid periods of peak biological activity and conducted in strict accordance with the approved sedimentation and erosion control plan, long-term impacts should be minimal.
