Klimek, P.E., Director DWQ Project # 04-1243 Harnett County On July 29, 2004, the Division of Water Quality (DWQ) received your application dated July 29, 2004 to impact 2.19 acres of wetlands to construct two small commercial buildings. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Plan Details a. Please provide the location of any proposed stormwater management practices. The proposed project is located within one mile of and potentially draining to an ORW. A storm water permit is required for this project. Since this project drains to Outstanding Resource Waters, a constructed wetland will be needed b. Please provide details for the stormwater management practices. c. Please specify the percent of project imperviousness area based on the estimated built-out conditions. d. Pope (property owner), we hereby request written authorization from the U.S. Army Corps of Engineers and NC-DWQ to cover permanent impacts to jurisdictional wetlands. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. Impacts will proceed in two tracts and an ingress/egress easement (totaling 3.6 acres) subdivided off of a larger 20.95 acre tract, of which 8.95 acres are jurisdictional wetlands. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger 20.95 acre tract in order to accommodate a significantly larger area of . commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. In order to mitigate for proposed impacts to jurisdictional wetlands, the client proposes donation of the remaining wetlands on site (i.e. preservation) and payment to the North Carolina Environmental Enhancement Program (NC-EEP). Wetlands being impacted are Cypress/Black Cum ecosystems that are seasonally flooded in the Winter. 19. Reason(s) for Discharge Nearly half of the 20.95-acre site's area is occupied by jurisdictional wetlands (confirmed by the USACE AID# 200200447), and their prevalence and orientation on the property have made the development of a site plan that completely avoids the wetland areas nearly impossible and a site plan that minimally impacts them difficult. The site plan proposed in this application is one of three considered, and proposes the least impacts to jurisdictional wetlands. Proposed impacts as a result of the placement of fill material onsite, total 2.19 acres, which if approved, will proceed on two tracts and an ingress/egress easement (all of which total 3.6 acres) subdivided from the larger 20.95-acre tract under William Pope's ownership. The subdivided tracts are adjacent to highway 421, and the portions of the property immediately adjacent to the Black River (behind the proposed development area) will remain undeveloped. 21. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger 20.95 acre tract in order to accommodate a significantly, larger area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. Pope (property owner), we hereby request written authorization from the U.S. Army Corps of Engineers and NC-DWQ to cover permanent impacts to jurisdictional wetlands. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. Impacts will proceed in two tracts and an ingress/egress easement (totaling 3.6 acres) subdivided off of a larger 20.95 acre tract, of which 8.95 acres are jurisdictional wetlands. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger 20.95 acre tract in order to accommodate a significantlylarger area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. In order to mitigate for proposed impacts to jurisdictional wetlands, the client proposes donation of the remaining wetlands on site (i.e. preservation) and payment to the North Carolina Environmental Enhancement Program (NC-EEP). Pope (property owner), we hereby request written authorization from the U.S. Army Corps of Engineers and NC-DWQ to cover permanent impacts to jurisdictional wetlands. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 fl. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. Impacts will proceed in two tracts and an ingress/egress easement (totaling 3.6 acres) subdivided off of a larger 20.95 acre tract, of which 8.95 acres are jurisdictional wetlands. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger 20.95 acre tract in order to accommodate a significantly larger area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. In order to mitigate for proposed impacts to jurisdictional wetlands, the client proposes donation of the remaining wetlands on site (i.e. preservation) and payment to the North Carolina Environmental Enhancement Program (NC-EEP). Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Envin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger. 20.95 acre tract. in order to accommodate a significantly_large_r area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. Pope (property owner), we hereby request written authorization from the U.S. Army Corps of Engineers and NC-DWQ to cover permanent impacts to jurisdictional wetlands. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. Impacts will proceed in two tracts and an ingress/egress easement (totaling 3.6 acres) subdivided off of a larger 20.95 acre tract, of which 8.95 acres are jurisdictional wetlands. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger 20.95 acre tract in order to accommodate a significantly _1arger_area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. In order to mitigate for proposed impacts to jurisdictional wetlands, the client proposes donation of the remaining wetlands on site (i.e. preservation) and payment to the North Carolina Environmental Enhancement Program (NC-EEP). Nature of Activity (Description of project, include all features) The proposed project entails the placement of fill material into jurisdictional wetlands in order to prepare the site for the construction of hvo small commercial buildings and their associated parking facilities. Wetlands being impacted are Cypress/Black Cunt ecosystems that are seasonally flooded in the Winter. 19. Project Purpose (Describe the reason or purpose of the project, see instructions) The purpose of the proposed project is the construction of two small commercial building and their associated parking facilities. This commercial development will help meet the growing demand for such facilities in the area. USE BLOCKS 20-22 IF DREDGED AND/OR FILL MATERIAL IS TO BE DISCHARGED 20. Reason(s) for Discharge Nearly half of the 20.95-acre site's area is occupied by jurisdictional wetlands (confirmed by the USACE AID# 200200447), and their prevalence and orientation on the property have made the development of a site plan that completely avoids the wetland areas nearly impossible and a site plan that minimally impacts them difficult. The site plan proposed in this application is one of three considered, and proposes the least impacts to jurisdictional wetlands. Proposed impacts as a result of the placement of fill material onsite, total 2.19 acres, which if approved, will proceed on two tracts and an ingress/egress easement (all of which total 3.6 acres) subdivided from the larger 20.95-acre tract under William Pope's ownership. The subdivided tracts are adjacent to Highway 421, and the portions of the property immediately adjacent to the Black River (behind the proposed development area) will remain undeveloped. 21. Pope (property owner), we hereby request written authorization from the U.S. Army Corps of Engineers and NC-DWQ to cover permanent impacts to jurisdictional wetlands. Since proposed impacts are in excess of the Nationwide permitting thresholds (i.e., greater than 0.5 acres of impacts to jurisdictional wetlands), this package constitutes an individual permit application. An Engineer Form 4345 is attached, which includes an agent authorization form. The proposed project, which consists of a small business park, is located immediately south of Highway 421, approximately 1000 ft. west of the Black River, between the towns of Dunn and Erwin in Harnett County, NC. S&EC performed a detailed wetland delineation for the site in May 2001, which was approved by the USACE (AID# 200200447). On April 2, 2003 a site meeting was held with Mr. Ken Averette of the NC Division of Water Quality and Ms. Jennifer Frye of the US Army Corps of Engineers (USACE) to discuss the submittal of this site plan for the required 401 and 404 permits. On June 12, 2003 a site meeting was held with Mr. Howard Hall of the US Fish and Wildlife Service and Mr. Bennette Wynne of the NC Wildlife Resources Commision to discuss the site and the proposed site plan. Proposed impacts to jurisdictional wetlands include 2.19 acres as a result of placing fill material for site preparation. Impacts will proceed in two tracts and an ingress/egress easement (totaling 3.6 acres) subdivided off of a larger 20.95 acre tract, of which 8.95 acres are jurisdictional wetlands. The proposed site plan requests the least amount of impacts of the three initially considered. In the first plan (Scheme 1), three tracts totaling 7.95 acres were split off of the larger-20.95 acre tract in order to accommodate a significantly larger area of commercial development. Scheme 1 proposed impacts to jurisdictional wetlands totaled 4.7 acres. A second plan (Scheme 2) was considered in which 6.5 acres were divided off the larger main tract into three tracts with total proposed wetland impacts of 4.1 acres. The final site plan (scheme 3), represented both the smallest acreage of land divided from the larger tract and the least amount of impacts proposed to jurisdictional wetlands. The proposed Scheme 3 is the plan requesting approval. It is apparent by viewing the wetland delineation for the property that any traditional development proposal will entail impacts to jurisdictional wetlands due to their abundance and orientation on the property. The proposed site plan marks a substantial decrease in the extents of proposed impacts as considered in previous site plans, and in order to make property development feasible, wetland impacts in excess of 1 acre are likely necessary. In order to mitigate for proposed impacts to jurisdictional wetlands, the client proposes donation of the remaining wetlands on site (i.e. preservation) and payment to the North Carolina Environmental Enhancement Program (NC-EEP).
