An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Signature of Permittce Calabash Marina and Fish House ADDITIONAL CONDITIONS Structure Replacement Permit #74-05 Page 2 of 4 2) This permit authorizes only the replacement of the deteriorated commercial building within its previously existing footprint. No portion of the new commercial building shall be located outside of the previously existing building footprint. 3) All remnants of the old structure shall be immediately removed to an approved high ground disposal area. Any debris resulting from removal of the structure(s) that falls into the water during demolition shall be immediately removed. 4) The work on the existing parking area shall not exceed the limits of the previously existing parking area. Docking Facilitv 5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) The authorized structures and associated activity shall not cause an unacceptable interference with navigation. ?) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) This permit authorizes a maximum of five boat slips. Calabash Marina and Fish House Permit #74-05 Page 3 of 4 ADDITIONAL CONDITIONS NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Basin Excavation 13) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the U.S. Army Corps of Engineers. 14) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 15) No vegetated wetlands shall be excavated or filled, even temporarily. 16) No excavation shall take place at any time outside of the area indicated on the attached workplan drawing(s). 17) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 18) No spoil material is to be placed within 30 feet of the normal high water line. Sedimentation and Erosion Control 19) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 20) A ground cover sufficient to restrain erosion shall be provided for all disturbed areas within 30 calendar days of completion of any land disturbing activities. 21) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 4 .. Calabash Marina and Fish House Permit #74-05 Page 4 of 4 ADDITIONAL CONDITIONS General 22) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina., No claim shall :be made against the United States or the state of North' Carolina on account of any such removal or alteration. 23) It is possible that the authorized structures may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The pennittee shall not hold the State of Forth Carolina or the United States liable for any such damage. 24) In order to ensure compliance with all conditions of this permit, the permittee shall schedule an onsite preconstruction meeting with representatives of the Division of Coastal Management and the U.S. Army Corps of Engineers. This preconstruction meeting shall be held prior to the initiation of any development activities authorized by this permit. 25) An as-built survey shall be performed on the new building and docking facilities, and copies of the survey provided to the U.S. Army Corps of Engineers and Division of Coastal Management, within 60 days of completion of construction of these portions of the project. 26) If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he shall immediately notify the District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910) 251-4511, who will initiate the required State and Federal coordination. 27) The federally endangered West Indian manatee (Trichechus manatits), has been reported in North Carolina waters. In order to protect the manatee, all work should be done between November 1 and May 31. If work must be done outside of this time frame, the permittee shall adhere to enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina". NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including a building permit from the Town of Calabash. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action ID. No. 200401127. NOTE: The Division of Water Quality has assigned the proposed project DWQ Project No. 042002. The excavated material will be disposed of at an upland disposal area located at Herman C. Frye property in Bug Hill, adjacent to the Waccamaw River, Columbus County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The Permittee shall schedule an onsite preconstruction meeting between its representatives, the contractor's representatives and the appropriate Corps of Engineers Regulatory Project Manager prior to undertaking any work to ensure that there is a mutual understanding of all terms and conditions contained within the Department of the Army permit. The Permittee shall notify the Corps of Engineers Regulatory Project Manager a minimum of thirty (30) days in advance of the scheduled meeting in order to provide that individual with ample opportunity to schedule and participate in the required meeting. 3. Matting will be required for all equipment crossings and work in wetlands during the demolition and construction of the facility. The demolished old structure will be immediately removed to high ground. No double handling of material will be allowed in waters of the US or wetland areas. 4. This permit does not authorize the interference with any existing or proposed Federal project, and the Permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 5. No attempt will be made by the Permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 6. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-3282 at least two weeks prior to beginning work and upon completion of work. 8. The Permittee must install and maintain, at its expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on all authorized facilities constructed within navigable waters of the United States. 9. It is possible that the authorized structure may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the Permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats and barges. The Permittee will not hold the United States liable for any such damage. 10. Only the structures shown on the attached plan in the water are authorized to be in the water. If any portion of the other structures located above the mean high water are damaged and falls into the water, the damaged portion of the structure must be removed from the water immediately. 12. This Department of the Army permit does not obviate the need to obtain other Federal, State, or local authorizations required by law. 13. All construction must conform to the North Carolina State Building Code requirements (and withstand 130 MPH, 3 second gusts as stated in the International Building Code, 2003 edition). 14. Any changes in the plans for the development or construction will require a re-evaluation and modification of this permit. 15. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 16. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. 17. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 18. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 19. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 20. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 21. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 22. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 23. In order to protect juvenile finfish resources, no excavation or filling activities will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers. 24. All excavated materials will be confined landward of the mean high water level elevation contour within adequate dikes or other retaining structures to prevent spillover of dredged materials into any vegetated wetlands or surrounding waters. 25. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 26. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water level elevation contour to prevent gully erosion and siltation. 27. Excavation will not exceed 4 feet below the elevation of mean low water. 28. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 4 29. The West Indian manatee (Trichechus ntanatus), which is listed as a federally endangered species, has been reported in the waters in Brunswick County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed. PROJECT SUMMARY: The applicant proposes to replace an existing commercial structure waterward of the normal high water line, replace existing docking facilities, dredge an existing boat basin, and refurbish an existing parking area. PROJECT DESCRIPTION The proposed project is located on a developed piece of land in a waterfront residential/commercial area of Calabash, Brunswick County, NC. The property is on the mainland side of the AIWW along the Calabash River in the western portion of the county. The site can be reached by traveling NC HWY 17S towards South Carolina. Turn south onto HWY 179 at Calabash, and follow this road into town. Just past the intersection with Thomasboro Road, make a right turn onto Riverview Drive. Proceed down towards the river and begin to round the curve. The site is on the right and is marked with a wooden sign that reads "Calabash Marina". The total project area is 0.32 acres in size. High ground elevations average approximately 4' above MHW with a gradual slope up towards the road. Vegetation on the upland portions of the tract includes Pine trees (Pinus sp.), LiveOak (Quercus virginiana) and other Oaks. Highground soils consist of sand. Salt Meadow Cordgrass (Spartina alterniflora) is the dominant coastal wetland species in the project area. The tract is zoned Commercial by Brunswick County, although the area is a mix of residential and commercial uses. The CAMA Land Use Plan Classification for the project area is Community. Currently, there is a concrete driveway/parking area and a commercial building with docking facility at the site. The building has been used in the past as a ship store, night club, fish house, etc... Brunswick County provides municipal water and sewer services. The waters of the Calabash River have been classified SA by the NC Division of Water Quality and are open to the taking of shellfish in the project area. The area is not considered to be Primary Nursery Area by the Division of Marine Fisheries. PROPOSED PROJECT The applicant proposes to replace the existing commercial structure and boat docking facilities, to dredge the existing boat basin, and to refurbish existing parking area. The applicant proposes to replicate the structures as they now exist - i.e., the facilities would not be expanded beyond the existing dimensions. No additional dockage or building area is proposed. The proposed replacement structure would be a two story commercial building constructed largely over marsh, as is the existing building. Its footprint is approximately 280 sf and the enclosed area square footage (both levels) would be approximately 2560 sf. It is rimmed on two sides by walkways that are part of the pier/dock facility, and on one side by a 20' x 36 ``/z'open deck. There is also a 31' x 6' covered walkway adjoining the dock walkway on the river side of the building beneath the upper level walkway porch. The drive way/parking area that would be improved is 130' x 60', or 7,800 sf. The main pier walkway would be 6'x 76'. Two platforms, one 70' x 6' and one 90' x 7', would conjoin the structure to serve both docking and ship store needs. Finger piers would complete the docking structure. These would be 24' x 8',17' x 8', and 20' x 6'. Total square footage of docking facilities would be 1548 sf. The number of slips would be five. Water depths at the location of the docking facility are approximately 3.5 feet MLW. Dredging is not proposed under the docks in the Calabash River. The boat basin/boat lift area to be dredged is 60' x 30', or 1800 sf. It would be excavated to a depth of 4 ft MLW. Approximately 215 cubic yards of silt and sand would be excavated by dragline or backhoe. The material would be removed from the site and disposed of at an upland site in Columbus County. This excavation is considered maintenance. Calabash Fish House and Marina December 2, 2004 Page 3 The proposal is one that under the current regulations would be considered non-conforming. In particular, the location of the structure, which includes a store and restaurant, below the normal high water represents a non-water dependant use over coastal wetlands. This is inconsistent with T15A 7H.0208 (a)l of the General Use Standards for the Estuarine and Ocean Systems AECs which states that "uses which are not water dependant shall not be permitted in coastal wetlands, estuarine waters, and public trust areas." In addition, the length of the docks exceeds that which is allowed by T15A NCAC 7H.0208(b)(6)(J) since it exceeds'/4 the width of the waterbody. However, the existing structures have been in place for decades, and may be replaced if they meet the criteria set out in T15A NCAC 7J .0211. 10. ANTICIPATED IMPACTS The proposed piers, docks, and walkways would not result in the shading of any additional wetlands or the incorporation of any additional Estuarine Waters or Public Trust Area Approximately 1548 sf, or 0.04 acres, would be remain incorporated by the dock and pier components of the project. The boat lift will be used to transfer boats to the water and will not result in the incorporation of Public Trust Waters. The shallow bottom of the boat basin would be excavated a maximum of 8 feet below the existing grade (to - 4 feet MLW). Temporary impacts to water quality would likely result from construction of the project. In total, approximately 7800 square feet of coastal marsh, public trust waters, and estuarine waters will be reincorporated by the commercial Fish House building and docking facilities. All of this area is currently covered by the existing facilities at the site. No wetlands, waters or marsh will be filled in conjunction with this proposal. A total of .32 acres of previously developed land area would be affected by this project. Redevelopment of the parking area shall not result in any more impervious surface coverage over the tract. No Section 404 jurisdictional wetlands would be impacted by the project. Approximately 1548 square feet of public trust, estuarine waters would be remain covered by the building, piers and walkways, and finger piers should this proposal be built as proposed.
