After reviewing your application, we have determined that the Division of Water Quality (DWQ) General- Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: The applicant proposes to construct a 12' x 50' boat ramp with riprap stabilization, community pier, 10 boat slips, gravel access, gravel parking area, and fill in abandoned agricultural ditches on his property. The only current development on the property is the construction of gravel roads leading to cul-de-sac's outside the 75-foot estuarine shoreline AEC buffer. PROJECT SETTING The location of the proposed development site is within a 120-acre tract of farmland that is being converted to a 61-lot residential subdivision with a common access area, located at the end of Jacocks Lane (SR1325) in the.New Hope community of Perquimans County. The development site is located on the western shoreline of Little River near to and south of Deep Creek Point. The width of Little River at this point is approximately 1 mile (5,280 feet). The developer has dedicated a 2.1-acre lot for a community water access area. The property is mostly flat and vegetated with indigenous weeds and field grasses. The southeastern and northwestern shorelines of the property consist of low banks (0-5 feet) with an average 2.5-feet wide strandplain sandy beach. A cypress fringe shoreline of 404'wetlands lies between the sandy beach shorelines. The property has an irregular shoreline that is approximately 300 linear feet. The adjacent property to the northwest is undeveloped with a cypress swamp fringe along the shoreline, and the adjacent property to the southeast is farmland with an extensive cypress swamp along the shoreline. There was no observed presence of submerged aquatic vegetation or shellfish in the vicinity of the ramp/dock site on December 2, 2004. Reviews of available information suggest that there are no known archeological sites or geologic formations associated with the applicant's property. The waters of Little River in this area are classified as SC by the Division of Environmental Management and are closed to shellfish harvesting. The water depths at the site range from 1 foot near shore, 2 to 3.5 feet in pier boat slips, and 3.5 feet at waterward end of pier, and the bottom is fine sand and silt. DEVELOPMENT PROPOSAL In order to provide water access for the interior lots of the subdivision, the applicant proposes to construct a community boating access area that consists of a 6-feet wide by 210-feet long pier, five 3-feet wide by 12-feet long finger piers, five mooring pilings, a 12-feet wide by 50-feet long concrete boat ramp, a 355-feet long gravel driveway to the boat ramp, and an approximately 56-feet wide by 127-feet long gravel parking area. There is no request for restrooms, gasoline, sewage pumpout, or dredging with this development proposal. The applicant indicates that approximately 1.7 cubic yards of riprap stabilization and 3.22 cubic yards of dirt fill material will be required for the ramp foundation below the normal water level, and 3.98 cubic yards of dirt fill material will be required for the ramp foundation in the upland area. In addition, three farm ditches in the upland area will be filled, totaling an average of 92 cubic yards, to match grade. The pier structure will have 10 designated mooring slips and is setback 1,000 feet from the nearest property line to the northwest. FIELD INVESTIGATION REPORT: Coastal Land Development Page 3 ANTICIPATED IMPACTS The proposed pier will project approximately 210 feet out into Little River, and will shade approximately 1,520 square feet of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC) and 50 square feet of uplands within the Estuarine Shoreline (ES) AEC. The proposed boat ramp, associated dirt fill and shoreline riprap stabilization required for construction will result in approximately 338 square feet of PTA, EW AEC's being filled, and approximately 321 square feet of uplands within the ES AEC being filled. Approximately 13,590 square feet of upland area including roads, ditches, etc. will be graded, filled, or disturbed. The three farm ditches total 2,475 square feet to be filled in the upland AEC area. The ramp approach will result in 705 square feet of ES, AEC and 3,552 square feet of upland area being covered by crushed rock. The parking area will result in 7,190 square feet of upland being covered by crushed rock. This constitutes 4.7% of impervious surface coverage within the estuarine shoreline AEC. Each boat slip will be approximately 12 feet by 20 feet, and the entire mooring area will occupy 1,200 square feet. Boating activity will increase in this area resulting in a possible increase in water turbidity, and may result in toxicants from hull paint and maintenance products to accumulate in the sediment near the boat slips. This will be the first pier along this shoreline. There are no expected navigational impacts due to the pier structure. Filling of the man-made farm ditches will allow even flow of water across the property, rather than the diversion of water and possible erosion and water turbidity at the ditch outflow points into Little River during high rainfall events. A wetland area (outside of the AEC) consisting of 1.56 acres of 404 jurisdictional wetlands on the property will be placed under a conservation easement to NCEEP as a requirement of the Nationwide # 14 permit mitigation.
