After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3492, which can be viewed on our web site at http://h2o.enr.state. nc. us/ncwetlands. The General Certification allows you to use Regional Permit No. 198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). In addition to the requirements of the certification, you must also comply with the following conditions: 1. All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers so as not to re-concentrate before discharging into the stream (as identified in 15A NCAC 2B .0243 (5)). 2. No trees will be removed during the construction/renovation of the dock. 3. Upon completion of the project, the applicant/responsible party shall complete and return the enclosed "Certificate of Completion" form to the Division of Water Quality's 401/Wetlands Unit. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. ERBRWH Re: Preconstruction Notification Application Form BOSWORTH PROJECT Pursuant to our conversation I enclose five copies of your Preconstruction Notification (PCN) Application form. As you might recall we reviewed this project on the phone just before Christmas. The final plans will not be known until after a site visit by Mallory Liles. He is the Duke Power and Crescent Resources Lake Management person assigned to Lake Wylie. The project will cover the maximum 1,000 square feet allowed by Lake Management, but the exact lay out will not be determined until after the site visit. The main issue we need to address in the on site visit is the permissible location and configuration of the dock to comply with the local rule that the dock extend no more than 1/3 the distance from one shore line to the other. The drawings attached to your application show a lesser square footage because the final portions can not be drawn without this site visit. Who knows the reason for the chronology, but Mallory will not make a site visit until this documentation is filed with you. I think we both agreed that the impact on the lake is the same regardless of the exact configuration of the dock as it is a floating dock and no dredging is involved. Hopefully we can move past this chicken and egg issue and get me out of the confused state I find my self in. Probably just the combination of old age and burecracy. In the section on Project information there is a request for various matters. 1. Vicinity map. I have printed the maps on us directions from downtown Charlotte to the site with details on each segment. 2. Site Plan. I have included a print out from Polaris showing my property with the foot prints of all structures. Additionally I include a survey showing the last leg of Langston Drive and the entire pertinent portion of Lake Wylie. 3. Other. Additionally I enclose two additional items. First is a Polaris drawing of the property showing the approximate location of the dock and secondly a drawing of the dock as desired. On this drawing I indicated the square footage of each segment. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan.
