On September 15, 2017, the Division of Water Resources (DWR) approved the restoration plan submitted
on your behalf by Mr. Doug Dorman of Atlantic Environmental Services, Inc. (your consultant) in response
to NOV-2017-PC-0307. Within the restoration plan approval, the DWR required that upon completion of
the restoration, a written annual monitoring report (including photos) must be submitted on or before
June 1 of each year for a three-year period to document that the trees and vegetation have survived and
that the wetlands have been stabilized and successfully restored. To date, the DWR has not received the
approved annual monitoring reports for the 1St (2018) or 2nd (2019) years of monitoring. It is the
expectation of the DWR that the required annual monitoring report for 2019 be provided to this Office
on/or before July 10, 2019.
Please note that until the documented survival of 85 percent emergent coverage and 260 trees per acre
have been achieved at the end of 3 years of monitoring within the sample plots the violation will remain
open and subject to further civil penalty assessment. This Office appreciates your attention to this
