APPROVAL of Neuse River Buffer Rule (15A NCAC 02B.0233) Authorization Certificate
Dear Sir or Madam:
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to
impact approximately 7,414 ft2 of Zone 1 and 4,120 ft2 of Zone 2 of the protected riparian buffers for the
purpose of constructing the Dam Rehabilitation at the subject property as described within your
application dated December 21, 2004. In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control and Non-discharge regulations.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner, must be given a copy of this authorization and approval letter and is thereby responsible
for complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Authorization are met. No other impacts are approved including incidental
impacts:

An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive
velocities through the protected stream buffers and will not re-concentrate before discharging into

3. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to infringe
within the buffer, wetland or water prior to any land disturbing activities to ensure compliance
with 15A NCAC 2B .0233.
4. No Impacts Beyond those in Application
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre-construction Notification. All
construction activities, including the design, installation, operation, and maintenance of sediment
and erosion control Best Management Practices, shall be performed so that no violations of state
water quality standards, statutes, or rules occur.
5. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent
modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center,
Raleigh, NC, 27699-1650.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B. This Authorization Certificate shall
expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B
.0233. If you have any questions or would like a copy of the buffer rules, please call (919) 733-1786.
This letter does not authorize any impacts to either Waters of the United States or Waters of the State.
Please contact the US Army Corps of Engineers (USACE) or NC Division of Water Quality (DWQ) if
any impacts are proposed to either of these waters.

Dear Ms. Burdette and Mr. Dorney,
Please find attached the completed PCN Application Form for the Bridgewater Subdivision Dam Rehabilitation
in Holly Springs, Wake County. Bridgewater Subdivision is a residential subdivision owned by Forest Hills
Development, LLC. The Town of Holly Springs requires that the existing on-site dam be improved, in order to
reinforce its integrity and safety, as part of Bridgewater Subdivision. The site plan for the property is illustrated
in Bridgewater Subdivision - Layout Sheet (C-1.1). The site of the proposed dam rehabilitation is detailed in
Bridgewater Subdivision - Existing Pond Evaluation (C-22.0).
This application describes impacts to Neuse River buffers resulting from the proposed rehabilitation of the on-
site dam. As displayed on Dam Rehabilitation - Neuse River Buffer, Stream, and Wetland Impact Map (EX-
1.0), there are no impacts to streams or wetlands and one impact to Neuse River Buffers. The proposed Neuse
River Buffer impacts result from the removal of vegetation on the upstream and downstream slopes of the dam
and grading required to reduce the angle of the downstream slope to more stable level.
The proposed dam rehabilitation is based on recommendations provided by GeoTechnologies, Inc. in the
attached letter, dated August 31, 2004, following a thorough geotechnical investigation of the dam. The impacts
for this project have been minimized to the extent of practicality while still allowing access for machinery and
the proposed improvements.
The copy of this PCN Application package supplied to the USACE is a courtesy copy, since no impacts to
Section 404 jurisdictional features are proposed. Thank you in advance for your time spent reviewing this PCN

III. Project Inforrnation
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks; such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to 'a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

at the time of this application: The property is primarily undisturbed pines and mixed
hardwoods. The western and northwestern portions of the property have been cleared and

10. Describe the overall project in detail, including the type of equipment to be used: The
project entails the rehabilitation of an existing dam The rehabilitation will include: the
removal of existing vegetation on the upstream and downstream slopes of the dam, removal
and reworking _(drying and recompacting) of portions of the downstream slope-, and flattening
of the downstream slope to reduce the dam's slope to an acceptable angle (2 5H•1V) and
strengthen the dam. Equipment used will include but is not limited to trackhoe excavators
bulldozers, rollers, and other grading and construction equipment
11. Explain the purpose of the proposed work: The purpose of the proposed work is to
rehabilitate and reinforce the existing dam_
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
A Jurisdictional Determination was issued for this site on June 29, 2004 (USACE AID#
200421194). Concurrence meetings for the site were held by Ms Debbie Edwards of the
Raleigh Regional Office of the NC DU on September 8 2003 and Ms Jennifer Burdette of the
USACE Raleigh Regulatory Office on October 10, 2003 The first application was submitted on
June 4, 2004 and was withdrawn. The second application for this site was submitted to the
USACE and DM on July 27 2004. The second application was withdrawn from the DM and
a more comprehensive version was submitted to the Express Review Program on August 19,
2004. A courtesy copy of the Express Review PCN Application package was submitted to the
USACE on August 19, 2004 as well. The application was approved by DM on September 16,
2004 (DWO EXP No. 04-1251)• Approval was received from USACE on October 31, 2004
(AID # 200421194).
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.

VI. Proposed' impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream ci-iannels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. AH,wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The Town of Holly Springs requires that the existing on-site dam be improved in order to
reinforce its integrity and safety part of Bridgewater Subdivision A geotechnical
investigation of the dam recommended that all vegetation be removed from the upstream and
downstream slopes and that the downstream slope be flattened to a more stable angle The
impacts from these improvements were minimized to the greatest extent practicable while still
allowing access for machinery and the improvements.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strinizide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a

description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the

Requiring execution and recording of deed restrictions with restrictive covenants:
The Permittee shall cause to be recorded in the Register of Deeds for Wake County restrictive covenants for the
purpose of maintaining proposed conservation areas totaling 20.2 acres in their natural state in perpetuity. The
permittee shall also cause to be recorded a plat, showing the subdivision plan for the property, the boundary of the
conservation areas, and the boundary of jurisdictional waters of the United States. The restrictive covenants and
plat, as approved by the Corps of Engineers, shall be recorded prior to the sale or conveyance of any.lots, phases,
or other property within the subdivision. The permittee shall enforce the terms of the restrictions set forth in the
deed, and, prior to conveyance of the property, shall take no action on the property described in the deed
inconsistent with the terms thereof.

accomplished prior to initiation of any impacts to jurisdictional areas (fill, mechanized landclearing, culvert

Regional Conditions
For all NWPs that involve construction of culverts, measures will be included in the construction that will
promote the safe passage of fish and other aquatic organisms. For all culvert construction activities, the
dimension, pattern, and profile of the stream, (above and below a pipe or culvert), should not be modified by
widening the stream channel or by reducing the depth of the stream. Culvert inverts will be buried at least one
foot. below the bed of the stream for culverts greater than 48 inches in diameter. For culverts 48 inches in diameter
or smaller, culverts must be. buried below the bed of the stream to a depth. equal to or greater, than,20 percent of
the diameter of the culvert.
Utility Line Installations
The areas of waters of the United States that are disturbed will be limited to the minimum necessary to
install.the utility line. The construction corridor authorized by this permit will not exceed forty (40) feet
in width in the wetland areas.
Upon completion of the work, only a twenty (20) foot wide maintenance corridor or less is allowed by
this permit within the wetland areas.
Permittee shall seed wetland areas with wetland seed mixture only. Fescue grass will not be utilized
in the wetland areas.

Gentlemen:
GeoTechnologies, Inc. has completed the authorized geotechnical investigation to evaluate the
existing pond embankment located within the proposed Bridgewater subdivision in Holly Springs, North
Carolina. This report presents the findings of our investigation and our recommendations concerning the
existing configuration of the embankment.
PROJECT AND SITE DESCRIPTION
It is our understanding that consideration is being given to incorporating an existing pond
embankment into development plans for the proposed Bridgewater subdivision in Holly Springs, North
Carolina. Based on provided information and our on-site observations, the pond embankment is currently
up to 12 feet in height with a typical crest width of 15 to 20 feet. The water level within the pond was about
6 feet below the embankment crest at the time of our site visit, and it appears that the water level is
maintained with an uncontrolled trench opening located near the southern abutment. The base of the trench
appears to mostly be weathered rock or rock, with steep and exposed. fine-grained sidewalls. A small
diameter outlet pipe was observed near the middle portion of the downstream toe; however, the pipe was
discharging a.very small volume of water relaoyp to the trench.
The downstream slope appears to have been constructed at an average angle of approximately
1.6H:1 V, with some flatter and steeper sections, The upstream slope could not be completely observed, but
appears to have been constructed at an angle of about 23HA V or flatter. Since no topographic information
was provided, these slope angles should be conaidered.approximate. Numerous small to medium diameter
trees were present on the slopes.
At the time this report was issued, no information regarding proposed alternations to the existing
embankment configuration were provided, and therefore we have assumed that 'approximately the same
configuration is being proposed as part of the new development. GeoTechnologies has been informed by
our client that the embankment has been classified as a low hazard or Class W structure by the North

Carolina Department of Environment and Natural Resources (NCDENR). ;ed,on this classification. the
dam currently wall not be regulated by the State Dam Safety Program.
INVESTIGATIVE TECHNIQUES
Subsurface conditions for the existing embankment were investigated by drilling two soil test
borings at the approximate locations shown on the attached Figure 1. The boring locations were established
in the field' by estimating distances from existing site landmarks, and therefore the indicated locations
should be considered approximate. The borings were advanced to depths of about 15 feet below site grade
with standard penetration testing performed at selected intervals to evaluate the consistency and density of
the subsurface soils. Additionally, GeoTechnologies used a ii inch diameter steel probe rod to evaluate the
near surface soils on the embankment slopes.
SUBSURFACE CONDITIONS
A generalized subsurface profile prepared from the boring data is attached to this report as Figure 2
to graphically,y, illustrate subsurface conditions encountered at this site. More detailed descriptions of the
conditions encountered at the individual boring locations are then presented on the boring records.
The results of our borings indicate that the embankment fill soils typically consisted of
approximately 12 to 14 feet of silty and clayey materials that exhibited penetration resistances ranging
from 4 to 20 blows per foot (bpf). Underlying the fill materials, the borings encountered a thin silty layer to
a depth of about 15 feet. The silty materials exhibited penetration resistances of at least 6 bpf. With
increasing depth, both of the borings encountered partially weathered rock at a depth of approximately 15
feet. Partially weathered rock is defined as material whose standard penetration resistances are in excess of
100 bpf. but which may be penetrated by the soil drilling process. Both of the borings were terminated
within the partially weathered rock. Groundwater was encountered in each of the borings at a depth of
approximately 10 feet below grade at the time of boring completion.
RECOMMENDATIONS
The following recommendations are made based upon a review of the attached boring data, our
understanding of the planned construction, and past experience with similar projects and subsurface
conditions. Once embankment details become more finalized, GeoTechnologies will need to be provided
with that information so that these recommendations may be confirmed, extended, or modified as
necessary. Once these additional details are known, more specific modification details (specifications) can
be provided
Existing Embankment.. With a few exceptions, the results of our borings indicate that the core
section of the embankment. fill was generally well compacted. Our experience has been that well
compacted fill materials that are at or near optimum moisture content will exhibit penetration resistances of
at least 6 bpf. Therefore, our borings suggest that most of the fill was adequately compacted, with a few
marginal zones where penetration resistances of 4 to 5 bpf were encountered. Additionally, the fill appears
to be low permeability material that would be suitable to impound water. Although the initial foundation
material underlying the fill encountered in boring B-1 was slightly organic, it was not excessively soft or

permeable, and it appears that the embankment was founded within a ter: `mot of very hard materai a:-both
boring locations.
Although our borings indicate that the core of the embankment is generally well compacted,
probing along the downstream slope face and toe indicated soft materials were present to depths of
approximately 12 to 24 inches, with some deeper areas also encountered. Additionally, observations of the
downstream slope indicate that there may have been some minor sloughing in the past in some of the
steeper areas. In general, the downstream slopes are steeper than normal for this type of structure. Small to
medium diameter trees were observed on both the upstream and downstream slopes, and we anticipate that
these trees, including organics and root systems will need to be removed as part of any modification.
Typically, it is recommended that this type of vegetation not be allowed on dam slopes.
Slope stability analysis performed incorporating the above information indicates that the
downstream slopes currently exhibit a safety factor against a deep-seated failure of about 1.3, with a lower
safety factor against an infinite slope (shallow) failure. Based on these considerations, it is our
recommendation that the downstream slopes be modified to increase both safety factors to about 1.5. As
discussed below, we advise that stability be improved by reworking and flattening the downstream slopes.
Once all of the existing vegetation is removed from both of the slopes, we advise that between 12
to 18 inches of the outer material on the downstream slope face be removed Subsequently, we advise that
the underlying 6 to 12 inches of material be reworked (dried and recompacted) in-place. Once this work is
completed, the slope can be flattened with approved compacted fill to an angle of 2.511: IV, or with a fabric
and rip-rap detail to an angle of 2H. IV. If rip-rap is used, a minimum thickness of 2 feet should be placed,
meaning that the bottom width of the rip-rap will be 6 to 7 feet in some areas to flatten the slope. If soil is
used to flatten the slope, the we must be protected against downstream erosion where ,it approaches the
creek near the southern abutment. Incorporating a less substantial fabric and rip-rap detail on the upstream
slope face will help control erosion. Details regarding these recommendations can be provided once
modification plans become more finalized.
Foundation eparation. Where the downstream toe will be extended to flatten the slope, the limits
of the new foundation should be evaluated by a geotechnical engineer. Based on the results of our probing,
we would generally anticipate that firm soils would be exposed at approximately 1 to 2 feet below grade;
however, it is likely that some deeper soft soil will be encountered in the lowest lying areas. Therefore,
some undercut type repairs are likely in these areas. Additionally, it should be recognized that some water
may enter the undercut excavation, and this water will require control during construction by the
contractor. Although it should be recognized that repairs will be required no matter what time of the year
that the construction begins, we recommend that modification operations be completed during the typically
wanner and drier summer months in order to reduce the impact that extended; periods of wet and cool
weather could have on the repair and construction process.
Existing Discharge Trench. As previously indicated, it appears that water levels within the pond are
currently maintained by an uncontrolled open trench along the southern abutment of the dam. Based on our
visual observations, it appears that the trench bottom has been scoured to relatively consistent weathered
rock or rock. with the sides of the trench consisting of clayey and silty soils that are erodable. At the time
of our observation, the trench appeared to be maintaining the water level inside the pond at a safe height;
however, an evaluation of the trench to function as a spillway for the structure was beyond the scope of this

ii-- estigation Modification plans for the embankment should mcla,,a a.hydrogeologic evalualion of the
need for a controlled spillway. The proposed development may change the required spillway capacity :or
the dam. If the pig located near the central portion of d dam will be abandoned, %:c recommend that the
pipe either be removed or grouted in-place.
Available Borrow Sources. An evaluation of potential borrow areas was not performed as part of
this investigation, and we recommend that an investigation of these areas be performed if modifications
will include fill placement. Suitable fill material should consist of low to moderate plasticity silts or clays
having a Unified Soil Classification of ML or CL During actual construction, density tests should be
performed on a full-time basis to identify any potential problem areas. Fill materials may be placed at
moisture contents 2% dry of optimum to 2% wet of optimum. All fill soils should be compacted to a
minimum of 95% of the standard Proctor maximum dry density, and the fill should be benched into the
existing slope.;
Recommendations for Inter ill aW a e. If soil fill will be used to flatten the downstream slopes,
consideration should be given to installing a toe drain. This drain is to intercept the phreatic surface which
will eventually develop within the embankment. Water intercepted by the toe drain should then be carried
away from the embankment in a downgradient area. Details regarding the toe drain configuration and
location can be provided once embankment modification details become more finalized. A toe drain would
not be recommended if rip-rap is placed on the downstream face.
Seepage Estimates. In order to calculate existing seepage quantities, a phreatic surface was
estimated from the existing pool elevation to the downstream toe. Seepage quantities through the
embankment and foundation were estimated with flow nets. Our analysis indicates that total seepage losses
= through the embankment and foundation should be less than 50 gallons per day. However, it should be
recognized that the actual seepage quantities could vary depending upon the flow through the abutments,
the consistency of the embankment fill, the structure of the native soil which does include some quartz
,zones, or the competency of the shallow partially weathered rock or rock foundation materials. Therefore,
actual seepage losses could be higher or lower than our estimate.
