High Point, NC 27265 Subject: Kensington Road Site APPROVAL of 401 Water Quality Certification and Isolated Wetlands Permit with Additional Conditions Dear Mr. Perillo: You have our approval, in accordance with the attached conditions, to place permanent fill in 0.31 acre of isolated wetlands in order to construct an elementary school at the subject site in Union County, as described in your application received by the Division of Water Quality on December 21, 2004. After reviewing your application, we have determined that the impact is covered by the State General Permit for Impacts to Isolated Wetlands and Isolated Waters (IWGP100000). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. In addition to the requirements of the certification, you must also comply with the following conditions 1. The Mooresville Regional Office shall be notified in writing once construction of the project has begun. 2. A final written stormwater management plan shall be approved in writing by this Office prior to the construction of any permanent facilities at the subject site. Stormwater discharge points shall be constructed in a manner such that the potential receiving streams or wetlands at the site will not be impacted due to sediment accumulations, scouring or erosion of the stream banks. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. b. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 5. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable 6. Please send photographs upstream and downstream of each culvert site to document correct installation along with the Certificate of Completion form. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Proposed Impacts I 22.5 - Acre Kensington Drive Site December 16, 2004 Isolated Wetlands Permit Application Project No. 2004-0774 I Executive Summary The 22.5-Acre Kensington Drive Site is located in Waxbaw, North Carolina, approximately 1/4 mile west of the Kensington Drive - Waxhaw-Marvin Road intersection (Attachment A - Figures 1 and 2). This project proposes to develop approximately 22.5 acres of open fields and wooded areas into an elementary school. Davis-Martin-Powell and Associates has contracted Carolina Wetland Services, Inc. (CWS) to provide wetland permitting services for this project (Attachment B). The results of the on-site field investigation conducted by CWS indicate that there is one isolated, non jurisdictional wetland area (Wetland AA) located within the project limits. On-Site jurisdictional areas were field-verified by NIs. Amanda Jones of the U. S. Army Corps of Engineers (USACE) on October 27, 2004. Existing Conditions The 22.5-Acre Kensington Drive Site is located in Waxhaw, North Carolina, approximately 1/4 mile west of the Kensington Drive - Waxliaw-Marvin Road intersection (Attachment A - Figures 1 and 2). This project proposes to develop approximately 22.5 acres of open fields and wooded areas into an elementary school. Davis-Martin-Powell and Associates has contracted Carolina Wetland Services, Inc. (CWS) to provide wetland permitting services for this project (Attachment B). The following sections describe the existing conditions of the project area. Current Land Use The current land use for the site is undeveloped wooded areas with maintained fields. The site has been cleared and graded and the on-site pond has been drained. According to the Soil Survey of Union County' (Attachment A - Figure 2), on-site soils consist of Tatum gravelly silty clay loam (TbB2 and TbC2) and Secrest-Cid complex (ScA). Tatum gravelly silty clay loam soils are well drained and exhibit moderate permeability and medium water capacity. Secrest-Cid complex soils typically exhibit slow permeability, moderate water capacity, and a low to moderate shrink-swell potential. Jurisdictional Delineation On August 27, 2004, CWS's Andrea Hughes, and Patti Kelly delineated on-site jurisdictional waters of the U.S z within the project area. Jurisdictional areas were delineated on-site using the U.S. Anny Corps of Engineers (USACE) - Routine On-Site Detennination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual.3 Routine On-Site Data Forms representative of the non jurisdictional, isolated wetland area (Wetland AA) and adjacent upland areas have been included as Attachment D. The results of the on-site field investigations conducted by CWS indicate that there is one isolated, non jurisdictional wetland area (Wetland AA) located within the project limits (Attachment A - Figure 3). Wetland AA is located in the northwest corner of the site and is approximately 0.3 I acres. This area exhibited features typical of a wetland: inundated soils, drainage patterns, oxidized root Lilannels, and gleved soil color (Attachment D - DP1). Upland areas have been recently graded therefore there was no observable vegetation. Pre-Application''Meetings jurisdictional delineation of the on-site features. All present parties agreed that the 0.31-acre On October 27, 2004, Ms. Amanda Jones of the USACE field-verified the results of the wetland area lacks a surface water connection and therefore is isolated and non jurisdictional. Agency Correspondence Cultural Resources A letter was forwarded to the State Historic Preservation Office (SHPO) on November 30, 2004, to determine the presence of any areas of architectural. historic, or archaeological significance that would be affected by the project. As of the date of this submittal, no response has been eccived from SHPO. Proteeted Speeie3 A letter was fo?war led to the North Carolina Natural Heritage Program (NCNHP) on November 30, 2004, ?o determine the pn::;cnce of any federally-listed species or critical habitat located within the project area. In a letter dated December 13. 2004, the NCNHP stated that there is "a record of the Federally Endangered Schweinitz's sunflower (Helianthus schtiveinit. ii) less than '/4 mile to the east of the proposed site." The known population of Schweinitz's sunflower was found in 1997 alongside Waxhaw Marvin Road, from the intersection of Kensington Drive south to the bridge over Twelve Mile Creek. The NCNHP correspondence letter and Elcment Occurrence Report have been included as Attachment E. Recent on-site construction activities, including the clearing of vegetation and surface regrading, have removed any potential habitat for on-site populations of Schweinitz's sunflower. These construction activities followed the approval of Nationwide Permits 14 and 39 by the USACE (Action Id. 200431042) and North Carolina Division of Water Quality (NCDWQ Project Id. 04-0883). Section 404/401 permits have been included as Attachment F. 3 22.3 - Acre Kensington Drive Site December 16, 2004 Isolated "Wetlands Permit Application Project X o 2CO4-0774 Purpose and Need for the Project This project proposes to develop approximately 22.5 acres of woods and open fields into an elementary school. The purpose of this project is to provide an elementary school to an area that is experiencing significant population growth. The proposed site plan includes an elementary school building, parking lots, and playing fields (Attachment G - Figure 4). Avoidance and Minimization There are no on-site jurisdictional waters that will be impacted by this development. Impacts to non jurisdictional Wetland AA are necessary to accommodate both parking lots and the main drive entrance to the school (Attachment G - Figure 5). This site is ideally located for a school development and provides for the growing needs of this area. Proposed Impacts to On-Site Features Unavoidable impacts to on-site features will total approximately, 0.31 acre -f non- urisdictional isolated wetlands (Attachment G - Figure 5). This project proposes to completely fill the 0.31 acre wetland to accommodate construction of the project. On-Site grading operations have led to the discovery of a large amount of rock. This rock makes it difficult to reach the grades necessary for the construction of the school without filling this isolated wetland area. Oil behalf of Davis- Martin-Powell and Associates, CWS is submitting an Isolated Wetlands Permit application with attachments in accordance with North Carolina Administrative Code T15A: 02H.1300 (Attachment C). (SR 1301) As you know, the potential of the plants along the east side of the road just north of Twelve Mile Creek (9065) is in jeopardy. Note the enclosed map. A new development, Quellin, is being graded now. The northern end is well under way and the developer wants to move the plants (opposite Kensington Dr.) as he moves toward the creek. ?n April I checked and could find only 7 dried stems from last year. On July 16 I did a cursory check and could find no plants. On July 19 three of us did a close check (looking under the thickly overgrown woody growth) and found 5 clumps, 3 single stemmed and 2 multiple stemmed. These were marked with yellow tape. The restriction on mowing has allowed the roadside woody growth to cover the site. Although there are a few open spots, there are no plants in these openings. These plants have been proposed as the beginning of the Cane Creek Park Preserve for Union Co. While there on the 1901, we noted a new group of plants along the west side of the road, 0.6 mi. south of the junction with Gray Byrum Road. We counted 125+ stems (map), and then across the road =5+ stems adjacent to the Quellin development. Both of these appear to be new. The 125+ stems occur along the roadside between the ditch and the disturbed secondary growth woods border, between mail box 4100 and the fire hydrant. No obvious development pressure appears at present. However, the 25+ directly across the road could be impacted by Quellin any day. I would propose moving the few remaining plants opposite Kensington and the 25+ as part of those for the Preserve. This needs to be done this fall. The developer is cooperative.
